09/19/16: Google Chrome beta allows background YouTube play; Twitter got 243,000 average viewers during TNF; 20th Century Fox sues Netflix

Good morning. It’s Monday September 19, and this is your first early morning digital briefing.

TODAY’S CODEBREAKER

Private Exchange: In programmatic ad buying, a private exchange is an ad exchange that is open only to an invited group of buyers. Private exchanges are usually run by major publishers; they allow brands and publishers to work with partners of their choice.

TOP NEWS

Twitter’s first foray into NFL streaming is complete. The results weren’t jaw-dropping, but they were decent: During last week’s Thursday Night Football live-stream, Twitter garnered 2.1 million unique viewers, and 243,000 average per-minute viewers. Viewers watched an average of 22 minutes of the game. Those numbers are absolutely dwarfed by CBS’s linear numbers (48.1 million viewers total), but fairly strong for a live-streamed event. The question going forward: Will Twitter’s TNF live-streams increase in audience size, or will they lose viewership as the novelty wears off? If you’re curious about how Twitter’s other upcoming live-streaming partnerships will fare (and there are a lot of them), then you should be paying close attention.

If Les Moonves is to be believed, Twitter won’t dominate the NFL live-streaming landscape forever. The CBS chief says that NFL games will be coming to the network’s All Access SVOD service “in the not-too-distant future.” "I anticipate before too long that we’ll be able to make a deal with the NFL," he said at the Bank of America Merrill Lynch 2016 Media, Communications and Entertainment Conference. Moonves acknowledged that NFL programming doesn’t actually make CBS too much money, saying that the network will likely break even on its 5 Thursday Night Football broadcasts this year. Still, Moonves explained that there’s no better way to promote CBS programming to viewers. And there’s no reason to think that wouldn’t also hold true for All Access viewers.

If you’re looking to use YouTube as a jukebox, get ready for some good news. Google’s new Google Chrome Beta for Android (version 54) allows users to play YouTube videos in the background. Previously, opening a new app or webpage would automatically pause a YouTube video, with no means of restarting it without returning to the page. The new Beta will still pause videos automatically, but Android users will have the option to restart them via a media notification. The result: Glorious, glorious audio, even while you’re checking your Newsfeed or firing off a Snap. Speaking of which…

MEASUREMENT

According to a securities filing, the internet and TV measurement company comScore will restate financial results for 2013, 2014, and 2015. It all comes back to the company’s so-called “nonmonetary” transactions; in other words revenue that comes without any real cash attached, but is instead based on fair-value estimates. (comScore’s nonmonetary agreements involve trading data with other companies.) According to an investigation by the Audit Committee of comScore’s Board, nonmonetary revenue shouldn’t have been recognized. comScore said that its 2015 revenue dipped by about $29 million as a result of the revisions, though the company says that there was no major effect on its overall profits. Still, as the Wall Street Journal points out, revenue has been the most important metric for investors and analysts interested in comScore; indeed, comScore hasn’t even reported on its annual profit in recent years.

PLATFORMS + DEVICES

Mode Media is in shutdown mode. The female-oriented internet media company has already laid off most of its staff and ceased operations, as first reported by the Wall Street Journal. The company failed to secure new financing or sell itself. Mode Media’s shutdown represents a precipitous fall from grace; as recently as 2013, the company boasted a $1 billion valuation, and was preparing for an IPO that never materialized. At least one aspect of Mode Media will likely live on: Cyndx LLC, a cloud-based platform geared toward financial institutions, has reached an agreement with Mode Media to take over operations of Ning, Mode’s social networking unit.

AUDIO

And there it is. As it gears up to launch an on-demand music service by the end of 2016, Pandora has locked the final piece of the puzzle into place, inking a deal with Warner Music. The move came the same week that the company completed similar deals with Universal, Sony, and dozens of smaller labels and distributors. While Pandora currently offers a streaming music service – and just last week added new features to it, including offline playback – it has yet to launch an on-demand service that allows users to choose any song. The company’s new licensing deals set the stage for competition with the likes of Spotify and Apple Music.

EXECUTIVE MOVES

20th Century Fox has lost some major execs to Netflix of late; now it wants to make Netflix pay for it. Fox has filed a lawsuit against the streaming giant, arguing that this year’s hires of Tara Flynn and Marcos Waltenberg represented an intentional effort to incentivize the execs to break contracts that ran through 2016. In a statement, Netflix said that it “believe[s] in employee mobility,” and doesn’t think that Fox’s employment contracts are legally “enforceable.” Fox would beg to differ; it’s looking for both monetary damages and an injunction against future poaching. An L.A. court will decide what’s enforceable and what’s not.
