A brouhaha has erupted between Comcast and Content Delivery Network Level 3, with the CDN accusing Comcast of charging it higher rates to deliver TV shows, movies and games through its network. Waving the flag of net neutrality, Level 3 complained that the MSO was establishing a “toll booth” that would give it an unfair advantage in offering its own TV Everywhere Xfinity TV content. Level 3 recently won the bulk of Netflix‘s streaming video business and expects the volume of that customer’s content to climb precipitously after the introduction of a streaming-only product. FCC Chairman Julius Genachowski said in a press conference that the commission is looking into the matter.
 

~ MULTIPLATFORM CONTENT NEWS ~

 
Sirius XM Satellite Radio renewed its deal with the NFL through the 2016 season, with play-by-play audio coverage offered to “Best of Sirius” subscribers. The company also announced that it has reached the 20 million-subscriber milestone.

 
~ INNOVATORS & START-UPS ~

 
Self described online cable TV system ivi TV, announced that it has expanded its $5/month service to include live television broadcasts from Los Angeles including linear feeds from LA’s ABC, NBC, CBS, FOX, The CW and PBS affiliates. The client-based Ivi TV, which claims the right to carry broadcast signals under a collective statutory copyright license, has also launched in Seattle and New York.

~ DIGITAL ADVERTISING ~

 
Mobile ad serving and analytics platform Mojiva, Inc. unveiled a new platform dubbed “mOcean Mobile,” built to deliver in-app ads for the Intel AppUp center for notebook computers. The initial phase is focused on the 70 million+ Intel Atom processor-based netbooks currently in-market.
 

~ TECHNOLOGY DEALS, MERGERS AND SKIRMISHES ~

                                                  
The EU launched a former probe into Google‘s search practices in Europe after rival search providers complained about unfavorable treatment of their services in Google’s unpaid and sponsored search results. The commission will also explore whether Google blocked advertising partners from posting ads by according preferential placement to the results of its own vertical search services. Google maintains a dominant position throughout the region in terms of its share of the search market, enjoying close to a 90% share, according to ComScore. Consumer groups such as Consumer Watchdog utilized the opportunity to call for an investigation of Google’s search practices in the U.S.
 
Report are swirling that Google has raised its bid to acquire local online couponing site Groupon to the $5-$6 billion range.
 
Three Senate Democrats – Sens. John Kerry (Mass.), Byron Dorgan (N.D.), and Ron Wyden (Ore.) – urged the FCC to create net neutrality rules before the end of the year. FCC Chairman Julius Genachowski is expected to announce as early as Wednesday a net neutrality proposal for a vote in December.
 
The FCC took a series of steps aimed at freeing up broadcast spectrum for the use of data strapped mobile broadband networks. Specifically, a Notice of Proposed Rulemaking proposed that wireless broadband providers have equal access to television broadcast frequencies expected to become available in upcoming spectrum auctions. The Notice also seeks comment on establishing new allocations for both fixed and mobile wireless services in the TV broadcast bands, while enabling TV stations to voluntarily combine their operations and distinct
programming lineups on a single TV channel.
 

~ TRENDS, RESEARCH, ETC.  ~

 
Once viewed as a marketing stunt by online retailers, this year’s Cyber Monday holiday snared more online sales than Black Friday in 2010, according to a report from Coremetrics. Thanks to additional sales of luxury goods, sharing of deals via social sites and the growth of mobile shopping tools, online sales were up 19.4%, with consumers pushing the average order value up from $180.03 to $194.89 for an increase of 8.3%.

continues to expand beyond the borders of the U.S., announced the launch of its comScore Video Metrix measurement service in Brazil, Mexico, Chile, Argentina and Spain.

Sony announced it has sold over 4.1 million “Move” motion controller units worldwide since its Sept. release in North America/Europe and Oct. release in Japan.
 
Concert promoter Live Nation unveiled its Live Nation App for the iPhone and iPod touch, now available on the App Store for the U.S. and Canada, highlighting Live Nation North American concert listings. Users can sign up to receive alerts on app-exclusive pre-sales and last minute tickets for favorite shows, purchase tickets directly through the app, and browse set lists.
 
Mobile game developer SkyZone Entertainment has teamed with FremantleMedia Enterprises (FME) to release a mobile app based on the popular Japanese game show franchise the Hole In The Wall. The $6.99 app is now out for Apple iOS, BREW, J2ME mobile platforms, with an Android version soon to follow.

OWN: Oprah Winfrey Network hired a pair of new ad execs. Darren Olive, former Director of Digital Media ad sales for Discovery, will serve as VP/Digital Media Ad Sales in New York; and Jill Buzas, also formerly from Discovery, takes the post of Director, Ad Sales, Midwest Region, based in Chicago.
 
Digital place-based media services provider Premier Retail Networks, Inc. named Dr. Raymond Pettit as VP/Market Research.

Remember the Seinfeld episode on re-gifting? A new website called The Gifting Effect has created on online home to help folks make use of stuff they receive by making sure it finds a home in need. Supported by sponsorships from brand marketers, the site connects with national and regional charities to facilitate the re-gifting of items from 30 categories, enabling users to browse the site by needs, location and item to find the causes they’d like to connect with. One of the cooler features of the site is the ability to create your own cause, with each applicant reviewed by the site’s Brooklyn-based staff.  
 
Correction: ESPN has added its broadband channel ESPN3.com to Microsoft‘s Xbox 360 service, rather than the linear ESPN.
