The U.S. Court of Appeals for the District of Columbia sided with Comcast and reversed an FCC ruling that called for the MSO to stop blocking users who use peer-to-peer downloading services. The decision claims that the FCC lacks the authority to govern how ISPs manage their broadband networks, dealing a serious blow to commission’s plans to implement Net Neutrality policies. Comcast has defended its traffic throttling practices by claiming that it was only trying to insure quality service for a majority of its users. The FCC released a statement noting that the ruling did not preclude it from pursuing “other methods” for achieving Net Neutrality.

~ MULTIPLATFORM CONTENT NEWS ~

 
AOL says it is considering a move to shutter Bebo, the London-based social networking site it acquired two years ago for $850 million. Jon Brod, EVP of AOL Ventures, described it as a “business that has been declining” that AOL couldn’t afford to further support in a letter sent to employees. Bebo was the top social network in the UK when AOL purchased it but it never earned much ad revenue and the site has failed to capture much market share in the U.S. Bebo attracted some 5 million U.S. uniques in Feb., according to ComScore, down 12% from a year earlier.
 
New York Times Co.’s Boston.com is picking up syndicated broadband sports content from CineSport including sports video highlights, news and custom features.
 

~ INNOVATORS & START-UPS ~

 
Google once again addressed privacy concerns of its Buzz social networking service by introducing a double check control panel enabling users to change personal settings. Google launched the service on Feb. 9 to all Gmail users to public outcry, automatically having users follow the email contacts they correspond with the most. This YouTube video is designed to quell fears of parents, outlining new safety tips for teens.
 
Meanwhile, Facebook announced that it has concluded its feedback-gathering process seeking comment on the latest set of changes governing the sharing of personal information with outside publishers. The company says it will begin testing automatic personal content sharing with a selection of “pre-approved” partner sites and that participating partners will offer users the chance to opt out from their website and delete their personal data if they do.
 

~ DIGITAL ADVERTISING ~

 
Online video ad optimization company TidalTV unveiled a partnership with LiveRail‘s real-time inventory bidding tool to help increase online video buying efficiency for both advertisers and publishers. The tie-up combines TidalTV’s real-time ad targeting and optimization with LiveRail’s real-time online video inventory bidding capabilities.
 
Hispanic network Univision is launching an ambitious multiplatform campaign on Thursday to encourage U.S. Hispanics to participate in the U.S. Census. The campaign will include PSAs, banner ads and video spots on Univision, TeleFutura, Galavisión, Univision Móvil, Univision.com, Univision Radio and related social media platforms.
 

~ TECHNOLOGY DEALS, MERGERS AND SKIRMISHES ~

 
The FTC is moving closer to a decision whether or not to approve Google‘s $750 million acquisition of mobile smartphone ad provider AdMob, per the WSJ.
 
Much-maligned AT&T announced plans to invest $1 billion to upgrade its business network, services and products to better serve large companies globally and smaller businesses in the U.S. The money will go toward rolling or upgrading high-speed networks in several states and territories and improving mobility applications, cloud computing and hosting services for business clients.
 
Local media website management platform Inergize Digital is introducing a new Application Programming Interface (API) platform this morning for its Web CMS solution. The API will allow local station site clients to add and subtract third party content integrated within its News Manager application.
 

~ TRENDS, RESEARCH, ETC.  ~

 
Smartphone adoption is leading to more usage of advanced data services in the U.S. but text messaging is still the most popular non-voice service. Sixty-four percent of U.S. mobile subscribers used text messaging on their mobile device on average from Dec. ’09 through Feb. ’10 according to ComScore, up nearly 2 points versus three months prior. Browsers were used by 29.4% of U.S. mobile subscribers (up 2.4 percentage points), while subscribers who used downloaded applications made up 27.5% (up 1.8 percentage points). Access to social networking sites or blogs also continued to grow, increasing 2.9 percentage points to 18.0% of mobile subscribers.

Online music service Pandora has launched a free ad supported streaming app for the iPad, enabling listeners to create customized stations, rate songs and save bookmarks.
 
After months of beta testing, EA Sports teed up the online, browser-based version of its Tiger Woods PGA Tour game. There’s a free version available for two courses and a subscription-based game ($10/mo., $60/year) offering access to several classic courses, more of which will be added regularly.
 
Greatest Tank Battles, a popular war-themed show on History, is now a new free CGI iPhone/iPad Touch game from Breakthrough New Media. Embark on 10 campaigns and 30 different missions utilizing one of 20 different historically accurate tanks.

Bob Sullivan has been named VP/Content for The E.W. Scripps Company‘s television division, a newly created position. Bob will be responsible for building successful content models for multiple distribution platforms, reporting to Brian Lawlor, SVP of the Scripps television division.
 
Jay Adelson
announced he is stepping down as CEO of Digg in order to pursue other business ideas, leaving founder Kevin Rose in charge as interm Chairman and CEO. Jay will stay on to serve as advisor for the social news site.
 
Former AOL VP Matt Prohaska has been tapped to serve as the first CEO of New York-based online video ad start-up Smartclip.
 
Pravin Chandiramani has been upped from to VP/Business Development & Strategy and Jeff Storan has been promoted to VP/Product Management at New York-based media marketing company Simulmedia.
 
Maurizio Cimelli has been appointed SVP, Europe, Middle East of Ascent Media Group, effective immediately. He will be based at the Ascent 142 digital media shop in London.

Sometimes in the world of Twitter and fast spreading rumors, discretion is the better part of valor and transparency almost always rules the day. San Francisco-based, crowd-sourced online recommendation service Yelp announced two major changes to its review system designed to address accusations that it extorts money from business owners for positive reviews. Yelp will now allow users to view reviews that have been taken offline by its automatic filter. To find screened reviews, click on the small “filtered” link at the bottom of a place’s page. (However, don’t expect to find any explanation for why the reviews have been banished.) The company is also doing away with the option of having a positive review of a local establishment appear at the top of the page for an extra fee. Finally, the company has created a Small Business Advisory Council to hear beefs from small business owners. These measures will surely help cut down on the lawsuits, but it’s hard to believe that spurned local proprietors will stop spreading vitriol when they get flamed on the site. Everyone loves User Generated Content until it represents a company in a negative light.
