Here we go: Yahoo! has filed a patent infringement lawsuit against Facebook. The matter is over 10 patents, including ones covering, among other things, internet advertising. The lawsuit was filed in a San Jose, California federal court. In a statement, Yahoo! said, “The matter with Facebook remains unresolved and we are compelled to seek redress in court,” adding that it is confident it will “prevail,” according to AllThingsD. In response, Facebook released a statement saying that it was disappointed that Yahoo!, a longtime business partner, was resorting to litigation to resolve this matter. And that, “once again, [Facebook] learned of Yahoo!’s decision simultaneously with the media.” Facebook is currently in its quiet period in the lead-up to its upcoming IPO.
Hulu has announced a first look international distribution deal with FremantleMedia Enterprises (FME) for any Hulu original TV series, and will kick off with A Day In The Life, a documentary series from Morgan Spurlock. The deal will cover all platforms, from digital to traditional media. The companies say it is the first instance of a distributor inking such a deal with an online video service. The documentary series from Spurlock, which premiered its second season on Hulu yesterday, provides a 24-hour snapshot of some of the world’s most fascinating individuals, such as billionaire Richard Branson, The Roots’ drummer Questlove and comedian Marc Maron.
Yahoo! and Vuguru are teaming up to develop and produce multiple original scripted series that will be distributed exclusively in the U.S. through Yahoo! Screen. The announcement was made by Yahoo! Head of Video Erin McPherson and Vuguru CEO Larry Tanz during a panel at SXSW Interactive. Vuguru is the latest content creator to partner up with Yahoo!, following in the recent footsteps of RedHour, Funny or Die, Broadway Video, as well as individual filmmakers like Tom Hanks, Robert Redford and Bill Maher.
Ovation, the network dedicated to art, artists and all forms of artistic expression and storytelling, has launched on AT&T’s U-Verse TV. The network has grown nearly 20% over the past year and is now in over 50 million homes, says Brad Samuels, EVP/Content Distribution at Ovation.
Popular sports blogging network SB Nation has launched a new YouTube channel as part of the video site’s ongoing original programming initiative. Available immediately, programming coinciding with the launch includes Full Nelson, a feature series from Amy K. Nelson that covers interesting sports stories on any given day; Bomani & Jones from sportswriter Bomani Jones; Shutdown Fullback, a series hosted by Spencer Hall and Jason Kirk covering the world of college football; SB Nation, the flagship series from bloggers Dan Rubenstein and Matt Ufford and sports media personality Erin Sharoni; Team Reports, a quick video digest which will provide insights on your favorite team from fan bloggers; and The Petey and LoMo Show, a series starring MLB athletes Bryan Petersen and Logan Morrison as they navigate the minutiae of spring training.
TRESemme Style Setters is a new digital web series from the styling brand, Alloy Digital and Mindshare Entertainment set to premiere on TRESemme’s YouTube channel this week. Featuring Twilight star Nikki Reed, the series will take viewers backstage at Mercedes-Benz Fashion Week, covering the creative process behind creating the looks that will be unveiled on the runway. The series is part of an eight-month long digital campaign that will include 32 original episodes running straight through to the Spring 2013 Fashion Show. Accompanying the video series will be a collection of “how-to” videos from TRESemme stylists, who will outline how to create the popular looks from the event at home. Aside from being broadcast on the YouTube channel, the series will also be distributed and promoted across relevant sites on Alloy’s multiplatform digital entertainment network.
Disney Channel, in partnership with Disney Interactive Media Group, is rolling out a redesigned online offering (can be viewed in beta here) that will prominently feature a new homepage newsfeed, which will be updated daily with new video content, games, photos, polls and more. All of the content will be easily shareable through email, and in the coming weeks, via text message, embed code and URL. The new website will be available across mobile devices. A new tween lifestyle section is also set to rollout in the coming weeks.
HGTV has launched a website, HGTVGardens.com, to serve as a new online destination and resource for users interested in gardening and landscaping. The company says it was in response to those two terms being among the top searches on HGTV.com. The new site will provide users with exclusive content from gardening experts such as Patti Moreno, Megan Francis and Gayla Trail, as well as daily blog posts and project ideas.
Walmart has purchased the Social Calendar, a popular Facebook app from Newput Corporation that currently boasts over 15 million installed users and over 380,000 monthly active users. The app is notable for allowing users to receive special reminders (for birthdays, holidays and other occasions) via email and text message. It also lets users post personalized greetings and cards on their friends’ Facebook walls. In announcing the acquisition on its website, the Social Calendar team said that while the service will not be interrupted for users, it will fall under Walmart’s privacy policy beginning on April 9. And of note, the post also provides a link to users who want to unsubscribe if they “do not wish to receive marketing communications from Walmart.”

Smartphone owners prefer retailers’ mobile websites over their mobile apps, finds new data from Nielsen. However, consumers who do use mobile apps are more likely to spend time on them. Taking a look at the data based on gender, men are more likely to try retailers’ mobile apps. In addition, mobile websites from Target and Walmart skew female, while Best Buy’s mobile website is the domain for men. Amazon and eBay appeal equally to both genders. Overall, during the 2011 holiday season, the top retail apps and websites combined to reach nearly 60% of all smartphone owners. To Nielsen’s President/Strategic Initiatives, John Burbank, this means mobile shopping has reached scale, and will only continue to grow as smartphone penetration rises. Nielsen also notes that the 2011 holiday season brought increased traffic to the top five retailers’ mobile websites, though that did not translate to increased usage after the holidays had passed.
comScore has released its February 2012 U.S. search rankings, and once again Google is still tops with a 66.4% market share, a 0.2% jump from January of this year. Google was followed by Microsoft (15.3%, +0.1%), Yahoo! (13.8%, -0.3%), Ask Network (3%, same) and AOL (1.5%, -0.1%). According to the report, 17.6 billion explicit core searches were conducted in February, with the same five search engines ranked in the same order. In terms of Google versus Bing, 68.6% of searches were powered by Google, and 26.2% powered by Bing.
According to new data released by Kantar Media, ad expenditures for measured digital media declined in the fourth quarter. Paid search budgets were 6.4% lower versus a year ago with continuing reductions from financial, insurance and local service advertisers. Investments in display ads fell 5.9% in Q4, which the report attributes to smaller budgets from auto manufacturers, telecom providers and travel companies. For the entire year, Kantar Media finds paid search fell 2.8%, while display increased 5.5%. In addition, the report found that the top 10 internet advertisers invested over $2.36 billion dollars in paid search and display ad campaigns, up 10% from the previous year and accounting for 10.9% of all internet ad dollars. The top five internet advertisers according to Kantar Media were: IAC/InterActiveCorp; Experian Group LTD; General Motors; AT&T and Progressive.
49% of U.S. marketers surveyed by digital ad agency ValueClick Media indicated that they planned to increase video ad spending in 2012, and 65% reported that their 2012 mobile budgets had already increased, per eMarketer. The survey also found that 66% of U.S. marketers planned to spend anywhere between 1% and 24% of their digital ad budgets on mobile, up from 50% last year. In a similar vein, 52% of U.S. marketers said the same about video, up from 27% in 2011. Other interesting data from the survey includes:
- 94% of respondents planned to spend money on standard mobile banner ads.
- 53% and 49% also planned to purchase mobile rich media and mobile video ads, respectively.
- Looking at how marketers plan to measure mobile campaigns: ValueClick found that 63% of U.S. marketers used click-through rates to measure mobile performance.
Watch With eBay, a feature within eBay’s iPad app that allows users to shop for products related to a TV show they’re watching at that time, will become its own standalone free iPad app, according to TechCrunch. The app lets users enter their zip code, cable provider, channel and TV program they’re watching, and also offers a channel guide, in order to help users search for relevant products and merchandise available on eBay. Other features include the ability to filter out keywords to refine the search process. Another is “eBay Celebrity,” which pulls up featured celebrities’ product recommendations, and presents the option of donating to their chosen charity. TechCrunch reports that some celebrities will also interact with users by way of original content, videos and message boards.
Online video network Blip has named Kelly Day as its new Chief Executive Officer. In her new role, Day will be responsible for leading the next phase of growth for the company’s digital advertising and distribution platforms. She will report directly to Blip’s Board of Directors, and will have a seat on the Board as well. “[Day’s] experience and expertise in building audiences and establishing deep distribution partnerships aligns perfectly with Blip’s strategic vision of providing producers the opportunity to distribute and monetize their content as broadly as possible,”said Jeffrey Glass, Managing Director, Bain Capital Ventures, and Blip Board Member. Previously, Day was EVP and General Manager/Digital Media and Commerce at Discovery Communications.
