Determined to get back into the handset market one way or another, Microsoft leveled a high-powered lawsuit against Motorola over its use of Google’s Android mobile operating system. Microsoft named several alleged patent infringements including ActiveSync, calendar/contact management, storage memory management and app notifications regarding signal strength and battery power. Although Google was not named in the suit, the move is being seen as a direct attack against the open source platform. Microsoft, which missed with its social networking-focused Kin handset, is preparing to launch a new line of smartphones this month to get it back into the game. Microsoft’s share of the smartphone market has dropped from 13% in 2008 to less than 7% this year, according to researcher IDC.

~ MULTIPLATFORM CONTENT NEWS ~

Break Media has created a football-themed custom channel with NFL.com featuring video highlights, news, analysis and fantasy info. Break has similar minisites featuring NBA and NHL content.
 

~ INNOVATORS & START-UPS ~

Another subscription-based online broadcast and cable service called FilmOn.com began testing an HD service last week, offering feeds of CBS, ABC, NBC, Fox, Ion Food Netork, Russia Today, BBC News, RAI Sports, Dubai Sports and TVE Spain. The service works through a downloadable client app and costs $9.95/mo. or $$99/year; interactive features include a digital EPG and DVR as well as a video social networking platform dubbed BattleCam.com which awards points to users who broadcast their own shows. The company, founded by internet and shipping tycoon Alki David, says it is in negotiations with major cable providers and plans to provide complete syndicated cable television services throughout the U.S. in 2011.

Online video entertainment platform blip.tv has launched a new iPhone and iPad-friendly HTML5 video player that mirrors the functionality of its Flash player and serves ads in the fast-growing format.

Popstation .com is a new ad-supported online competition platform based in Stamford, CT encouraging hopeful artists to upload videos of their own music and allowing music fans to vote on what they like best. (The company is currently offering all recordings for free, but reserves the right to charge in the future.) Each day one winner is awarded $500 and gets to see their single digitally distributed on multiple platforms including iTunes and internet radio.
 

~ TECHNOLOGY DEALS, MERGERS AND SKIRMISHES ~

Knicks, Rangers, Devils, Islanders and Sabres games are at stake for Dish Network subscribers. The satellite company pulled the plug on MSG and MSG Plus on Friday, Oct. 1 after its current carriage agreement with Madison Square Garden Networks expired. Dish has also dropped several Fox Cable Networks including Fox’s 19 regional sports networks, FX, and Nat Geo Channel. Dish is claiming that MSG is seeking a “double digit” increase to carry sister music video network Fuse, per the AP. Dish also said it will make the NFL Network, NBA TV, ESPN Classic and other pay channels available at no extra charge to subscribers affected by the blackout.
 

~ TRENDS, RESEARCH, ETC. ~

Thanks to the highest frequency rates in the industry, NBC, ABC and FOX’s Hulu again racked up more video ad views than any other publisher or video ad network with more than 300 million more ads served than its closest competitor in Aug., according to ComScore. Video ads reached 45% of the total U.S. population overall with an average frequency of 28 ads/viewer during the month. The top video ad networks in terms of potential reach were: Break Media at 46.4%, BrightRoll at 45.0% and ScanScout at 44.5%.

~ EXECUTIVE MOVES ~

Mark Greenspan has been promoted from VP/Digital Media and Executive Director of nextMEDIA, to COO of Achilles Media. Ferne Cohen has also been upped to Executive Director, Banff World Television Festival and VP/Entertainment, Achilles Media.

New York-based online video publisher HealthiNation hired Doug McFarland to serve in the newly created role of Chief Digital Officer. Doug will oversee digital strategy and operations, reporting to Raj Amin, CEO and founder.

Former Cosmo Managing Editor Amy Boshnack has joined blog network CafeMom as Editorial Director for mom-themed offshoot blog The Stir.

New York-based online ad analytics firm LogicLab has promoted Joseph Reid to Senior Director of Media Sales.
 

~ WEBSITE OF THE DAY ~

There may soon be a technological answer to predictable plots in movies, video games and TV shows. Privately held UK-based NeuroSky (not a company from a William Gibson novel) has developed a new $99 headset (due out Nov. 11) that utilizes algorithms to monitor concentration and relaxation in the brain. The technology, which was adopted by toymakers Mattel and Uncle Milton last year to power a couple of “mind-reading” games, is now being used as the centerpiece of an entertainment platform called Myndplay that will allow audiences to interact with the storyline of a video or movie file. By “relaxing” or focusing your thoughts (Myndplay CEO Tre Azam says the technique is easy to pick up,) people watching in a movie theater or in their living room will be able to affect the outcome of a plot, deciding who lives or dies or what guy the leading lady gets. Producers still have to shoot alternative scenes, but the company is convinced the platform will have huge upside for an industry that really makes its money when audiences have the incentive to watch something more than once or buy the Blu-ray of a movie they’ve already seen. “The system is designed to monitor feedback from the audience and record passive and active emotion, generating deeper levels of engagement,” says Mr. Azam. “We’re out to create a whole new level of entertainment in which your choice tells you more about yourself.” Of course plots of movies could be just the beginning  interactive sports, adventure and role-playing games could also benefit immensely. The company says it is working closely with studios in the UK to introduce Myndplay-based products as early as next year and that Japanese developer Square Enix (Final Fantasy) has already created a proof-of-concept first person shooting game called Judecca that requires players to focus their brains in order to see the demons in the game.
