The FCC is planning to spell out a proposal next month that would standardize set-top box technology across the industry to allow third party connected box devices to work as cable and satellite set-tops across the country, reports the Washington Post. The “AllVid” idea, first introduced in the FCC’s broadband plan last spring, could be pushed as a condition to the pending Comcast/NBC Universal merger as a way to open up the market for competing programming and content packages. The FCC has not been slow to notice how confrontational the entertainment giants have become toward competing technology platforms. For instance, News Corp.’s Fox became the 4th and final major network to block access to full episodes from the new Google TV web browser, launched last month in an integrated TV by Sony and a set top by Logitech.


Hulu is on track to double its revenue in 2010 to $240 million, according to comments made by CEO Jason Kilar at GigaOM’s NewTeeVee conference. The service has grown to attract 30 million users as of Oct., racking up 260 million content streams and 800 million ad streams during the month.
Oxygen Media has formed a partnership with entertainment-based retailer StyleQ, Inc. to curate head-to-toe looks for the Bad Girls for the “Bad Girls Club Miami” reunion special, premiering Tuesday, November 16 at 9pm ET/PT. While watching the episode, fans can visit the Bad Girls Club Facebook page to purchase the apparel, footwear, and beauty products they see on-air. The site will also feature how-to video vignettes and behind-the-scenes footage.
Syfy has ordered up 5 new episodes of the steampunk online series Riese: Kingdom Falling, narrated by English-born Sanctuary star Amanda Tapping.


The Wikimedia Foundation-owned online content publishing platform Wikia unveiled a major design overhaul to merge social networking capabilities with its online content publishing tools. New functionality includes integration of social tools to let users share their edits and contributions with friends; the highlighting of top editors so readers can see who created the content and learn more about them; and the surfacing photos and videos more broadly on content pages to include images in search results.
Video entertainment site Dailymotion announced a content deal with licensed anime site Crunchyroll to launch a co-branded anime destination site, featuring ad supported selections from Crunchyroll’s catalogue including hit anime series Naruto Shippuden.
Cloud-based online video delivery solution Clearleap raised an additional $4.5 million in financing from existing investors Noro-Mosely Partners, Trinity Ventures and Silicon Valley Bank. Clearleap, which partners with OTT provides such as Roku to offer video content management and delivery services, claims deployments by more than 35 cable and IPTV systems, including six of the top-10 operators in the U.S. and has raised a total of $16.8 million to date.
Babelgum announced a partnership with animated print and digital cartoon producer RingTales to exclusively premiere new installments of Stephan Pastis’s “Pearls Before Swine” and Isaac Littlejohn Eddy’s original series “Cat, Dog, Stoop” both online and on mobile.


Video ad network YuMe is expanding to the mobile space introducing software development kits for the iPhone, iPad, and iPod touch along with two new mobile ad units. One unit, dubbed Mobile Connect, features a full screen video ad overlaid with ‘Tap To Action’ icons that enable further engagement with the brand. YuMe’s Mobile Billboard unit sports a pre-roll full-screen banner ad that allows the user to play video or connect directly with social networking and ecommerce brand destination sites. YuMe faces an already crowded marketplace in the mobile space, but counts more than 600 brand advertisers it already works with online.
Mobile video ad network Rhythm NewMedia announced the completion of its third-round of financing, raising $10 million from a group led by QuestMark Partners. Existing investors Lightspeed Venture Partners, Morgenthaler Ventures and Rembrandt Venture Partners also participated. Rhythm says it will use the funds to further expand its mobile video ad network as demand for mobile video is growing sharply. Its ad network averaged 425 million monthly impressions in Q3, up 30% from Q2 to Q3.
Mediabrands hyper-local marketing agency Geomentum announced the launch of its Hyper-Local Network along with a new partnership with dynamic video ad provider Mixpo. The companies will introduce a Dynamic Local Video (DLV) platform, which enables national advertisers to microtarget in-banner video campaigns with enhanced geography-based insights to deliver creative that is tailored to local audiences.


Months after European authorities took action on the matter and one month after the FTC closed its own investigation, the FCC confirmed it has launched an investigation to look at whether Google violated communication laws with its Street View program. Google has admitted to “accidently” collecting emails, URLs and passwords and has promised to delete the data “as soon as possible.”
Contendo Inc. responded to lawsuit filed by Akamai and M.I.T. on Wed. saying there was no merit to claim that Contendo violated three Akamai patents, one of which had been licensed by the school.


Pre-roll video ads are still the dominant format online, making up 91% of all video ads during Q2 according to a report from video monetization specialist FreeWheel analyzing nearly 6 billion video views and 3 billion ad views. Mid-rolls comprised 8% of all ads during the quarter-an increase of nearly 700% on the year. Other key findings of the report included:

  • Professional video content delivered through the wired and mobile web is being increasingly monetized and consumed like television
  • Ads that appear within content (mid-rolls) are the fastest growing ad format in the market, displaying an impressive completion rate of 90%
  • Consumers are becoming more accustomed to viewing ads before and during content, reflected in the increasing video ad completion rates
  • professional video content advertising has high completion rates relative to user generated content



Montreal-based iPhone app developer Budge Studios and Nickelodeon have formed a partnership to begin creating paid children’s storybook applications for the iPhone and iPad. Some of Nick’s most popular shows, including Dora the Explorer and SpongeBob SquarePants will be adopted into apps featuring interactive games, songs, ect. The first title of the collaboration will be the holiday-themed “Dora’s Christmas Carol Adventure,” featuring interactive stories and Spanish language instruction for preschoolers, scheduled to launch for the both the iPhone/iPod Touch and the iPad on Dec. 1.

From time to time I get questions about what is fair game when it comes to downloading and reusing video from the internet. Unfortunately, there’s a lot of misinformation out there and a spirit of outright thievery pervades in many circles. Check out this Code of Best Practices describing legal fair usage of online video for a primer of the basic principles, from the Center for Social Media site of American University in D.C. Commenting/critiquing; using copyrighted material for an example; accidental capture; or capturing to preserve a moment or spark a discussion are some of the examples of when it’s O.K to appropriate copyrighted work. But don’t make the mistake of aggressively fitting your usage into one of these tenants. Intellectual Property attorney (and author of books on John Carpenter and Sergio Leone) Robert C. Cumbow from the Seattle law firm Graham & Dunn highlighted these four factors to consider when evaluating what to consider fair use:    

  • What is the nature of the use? Commercial use weighs against fair use; nonprofit education use weighs in favor; uses that transform the nature and/or purpose of the original work are more likely to be fair, while uses that exactly duplicate the original are less likely to be fair
  • What is the nature of the original work? If the work is primarily factual, a use of it will weigh in favor of fair use; if the work is highly imaginative or fictitious, use of it is less likely to be fair
  • How much of the original work is used? Generally, if it’s a small amount of a much larger work, that favors fair use. If it’s a larger amount or all of the work, that weighs against fair use. But sometimes even a small amount can be too much if it is the most important part of the work
  • How does the use affect the market for the original? If the use constitutes a substitute for the original (“I don’t need to buy the original because this person’s work gives me all I need”), that weighs strongly against fair use. On the other hand, if the use is unlikely to harm the market for the original – or might even stimulate sales of the original – that favors fair use.
