The Comcast/NBCU merger may not be a done deal just yet. Federal Judge Richard Leon warned that he’s “not sure” he’s going to sign a court review of the Justice Dept. settlement completed in Jan., according to a WSJ report. The federal D.C. Judge criticized the merger’s arbitration terms made available to online content companies who feel as though they are being discriminated against by the ISP on Wednesday, complaining that arbitration decisions were not appealable. Instead, he suggested that the courts would do a better job of protecting consumer interests, in the form of annual judicial reviews to insure that a judgment is upheld. Some consumer groups have come out if favor of arbitration, saying that Comcast can outspend most independent producers who feel their content is not getting a fair shake.
 

~ MULTIPLATFORM CONTENT NEWS ~

 
Fox Networks’ and Big Ten Conference’s joint venture BTN is bringing live games to the internet with the launch of authenticated streaming service BTN2Go, scheduled to kick off in time for College Football season. The service, available to Time Warner Cable, DirecTV and Dish BTN subscribers, will be a live simulcast of the network, which will feature more than 40 Big Ten football games and over 100 College Basketball matchups. The streaming service will be accessible online and via upcoming video apps for the iPhone and iPad.
 
After signing a similar output deal with Netflix, NBC Universal has signed a pact with Amazon to license several Universal film library titles to its Amazon Prime subscription service. Movies included in the deal include “Eternal Sunshine of the Spotless Mind,” “Elizabeth,” and “Gosford Park.” Amazon’s library has now grown to over 9,000 film and TV titles.
 
AMC Digital Studios
, debuting on Aug. 22 on AMCTV.com and Hulu, will be the network’s new online destination to showcase new web series from young up-and-coming creators. “The Trivial Pursuits of Arthur Banks,” co-written and directed by Peter Glanz, will be the portal’s first project. Adam Goldberg stars as a successful theater director who stages a play designed to mirror his dysfunctional love life. Character actor Jeffrey Tambor co-stars as his therapist.
 

~ INNOVATORS & START-UPS ~

 
Soon-to-list daily deals site Groupon has acquired e-commerce technology site Zappedy for $10.3 million in stock, according to an SEC filing.
 
During the Moto X events today at the Staples Center in LA, a group of 160 people seated in Section 112, Rows 6-12 will make up a virtual message board known as “Human Twitter.” Fans and @xgames followers will be able to tweet their messages with the hashtag #HumanTwitter for a chance to be featured on the message board during each Moto X run to spell out the tweet – one letter at a time. The tweets from Human Twitter will be featured on the Jumbotron and during the ESPN broadcast, with the user’s handle attached.

Twitter
is trying once again to increase its ad revenue by making “Promoted Tweets” more prominent on the service. Beginning immediately, tweets paid for by corporate sponsors including Groupon, HBO, Jet Blue and Microsoft Xbox will be placed at the top or near the top of users’ Twitter screens so they have a better chance at noticing them. Users can retweet, link to or dismiss the notices with a single click.
 

~ TECHNOLOGY DEALS, MERGERS AND SKIRMISHES ~

 
Sony reported a quarterly loss of ¥15.5 billion ($199 million) as sales dropped 5% to 1.49 trillion yen ($19 billion). Operations were adversely affected by the March 11 earthquake and tsunami, as well as by the string of cyber attacks that penetrated more than 100 million online accounts.
 

~ TRENDS, RESEARCH, ETC.  ~

 
Over 70% of online Americans now use video-sharing sites such as YouTube and Vimeo, according to a new Pew Research Center study conducted in May, up from 66% a year earlier and 48% in 2007. The use of video-sharing sites on any given day has also jumped five percentage points, from 23% of online Americans in May 2010 to 28% in May 2011. Despite slower connection speeds, rural internet users are now just as likely as users in urban and suburban areas to have used these sites. Online African-Americans and Hispanics over-index in visits to video sites. Also, the proliferation of smartphones has had a marked impact on the usage of these sites:

  • Some 34% of the cell phone owners in the country have shot video with their phone; 26% have watched video on their phone; and 22% have posted videos or photos online.
  • Men owning cell phones are more likely than women to watch video on their handsets, but both sexes are equally likely to record and post videos
  • Blacks and Hispanics are more likely to view, record and post a video using their cell phone than whites.

 
Google’s Android mobile OS continued top the U.S. smartphone market in June (39% market share), but the iPhone was the best selling handset, according to new data from Nielsen. Apple’s iOS enjoyed 28% of the market while Research In Motion’s Blackberry phones fell by 1% from May to capture a 20% share of the market. Microsoft’s Windows Phone 7 OS had just 9% of the market in June, while HP webOS and Nokia’s Symbian accounted for 2%.

Nintendo
is cutting the price of its newly-released 3DS handheld on Aug.12 by a third to $170 after cutting its profit forecast for the quarter. It’s rare that an electronics item undergoes such a drastic price cut after just 4 months. The company is trying to make it up to folks who paid full price by giving away 20 free game downloads. You must connect to the 3DS eShop by Aug. 11 to register for the giveaway.
 
Developer 505 Games announced a fall 2011 release for “MMA: Supremacy” for the next generation Sony PS Vita console – the first official indication that the handheld system will debut this year.

Former Lifetime SVP Jeffrey Schneider has been tapped by NBC Universal to take up the newly created post of EVP/Business Affairs, Entertainment & Digital Networks and Integrated Media (E&DN/IM), (take a breath.) Jeff will oversee talent and production negotiations, program acquisitions and new business deals for the entire E&DN/IM portfolio, which includes Telemundo, Bravo Media, mun2, Oxygen Media, Style and the digital businesses iVillage, DailyCandy, Swirl, and Fandango. He will report to Salil Mehta, COO and CFO of the division.
 
Bill Kolb will assume the role of CEO of digital ad agency MRM from Marc Landsberg, who joined McCann Worldgroup last year with a dual executive role – CEO of MRM and President of Corporate Business Development for McCann Worldgroup. Marc will now focus full-time on leading McCann Worldgroup’s corporate strategic development and acquisition initiatives.

What would Shark Week be without a pair of Shark Week apps from Discovery’s digital team, launched this year to complement the video-laden Shark Week website? (There’s even a live Shark Cam powered by UStream.) The free Shark Week Live is the company’s first co-viewing app for the iPad and iPhone/iPod Touch, synched to Discovery’s telecasts next week to allow viewers to post comments on Facebook and Twitter in real time. The Ultimate Sharks app, selling for $5, brings a wealth of additional content about kids’ favorite fish, including insights into the science of shark behavior and graphical accounts of real life shark attacks. The app features interactive maps, 250+ photos, profiles of the 10 deadliest sharks and over three hours of videos from the Shark Week library.
