Allen Media Group isn’t lovin’ it. AMG divisions Entertainment Studios Networks and Weather Group have filed a lawsuit against McDonald’s, accusing the burger behemoth of failing to honor a commitment to spend 2% of its advertising budget on Black-Owned Media in 2021, escalating to 5 percent by 2024. Per the lawsuit, McDonald’s did not spend anywhere close to 2 percent on Black-Owned Media in 2021, and it is not on pace to meeting its commitment now. “This is a groundbreaking lawsuit based on a California law—Civil Code 1711—that holds corporations to their public promises and thereby redresses corporate fraud. That’s exactly this case,” said Skip Miller, counsel for Allen Media Group. “Per the lawsuit, McDonald’s said one thing and did another.” AMG is seeking damages in excess of $100 million, along with punitive damages and a permanent injunction requiring McDonald’s to honor its commitment and spend at least 5 percent of its ad budget on Black-Owned Media with full transparency going forward.

“McDonald’s has a long history of investment in diverse communities and partners, and we are proud of our record. We will not be coerced by these in terrorem tactics and will defend ourselves vigorously,” responded McDonald’s in a statement. Allen Media Group filed a $10 billion racial discrimination suit against McDonald’s for $10 billion in 2021, in a case working its way through the courts.

Nickelodeon unveiled a brand campaign and new identity that includes a reimagined Splat logo and Nick characters, but with a modern feel. The “Portal to Fun” launch campaign features 5 mixed media brand films that depict the Splat as a gateway to surprising experiences. The campaign will continue throughout the summer, as Nickelodeon brings “Portal to Fun” experiences to schools around the country.

Tucker Carlson, forced out by Fox News, has been exploring his options, reports Axios, including fielding interest from Rumble and Newsmax, and a having a chat with Elon Musk. There’s also talk he could build a direct-to-consumer outlet, along the lines of fellow fired out FNCer Bill O’Reilly’s No Spin News. A sticking point is his contract with FNC, which doesn’t expire until January 2025, after the presidential election. But that might not stop him. Carlson lawyer Bryan Freedman told Axios “The idea that anyone is going to silence Tucker and prevent him from speaking to his audience is beyond preposterous.”

Amazon Studios is launching worldwide distribution division Amazon MGM Studios Distribution. At launch, among the TV series offerings will be “Goliath,” “Hunters,” and “The Marvelous Mrs. Maisel.” Sales begin out of LA Screenings, with presentations on Friday, May19 and Monday, May 22.

Another just-launched distribution company is Amuz Distribution. The brand is focusing on comedy and feel-good scripted and unscripted content.

Fox News Channel has dedicated its London bureau to cameraman Pierre Zakrzewski, who was killed last year after his vehicle was struck by incoming fire while news gathering in a village outside Kyiv, Ukraine. The attack critically injured FNC’s State Department correspondent Benjamin Hall and killed Ukrainian journalist Oleksandra Kuvshynova. “Pierre was renowned throughout the media industry for his passionate storytelling and remarkable skill, and he was an all-around exceptional colleague,” said Fox News Media CEO Suzanne Scott. “While we are still devastated by his loss, we are extremely proud to honor his legacy by dedicating and naming our London bureau after him.”

Eighty-one percent of marketers and agencies now commute to the office, up from 63% a year ago, but still less than average Americans (86%), according to a new Advertiser Perceptions study commissioned by the Cumulus Media | Westwood One Audio Active Group. Additional findings include:
· The average number of marketer/agency office days grew from three to 3.7 over the last year. Versus a year ago, those in the advertising business who work four or more days at the office increased from 41% to 58%.
· Average Americans are clocking more days at the office (5.3) compared to the advertising industry (3.7).
· Of the 19% of brands and agencies who are still working from home, more than half say they are never coming back full time. When agencies and advertisers who still work from home were asked when they will be returning to the office, 55% say they will not be returning to the office and 39% have no idea.
· 60% of marketers and agencies have resumed in-person media vendor meetings. 61% have resumed in-person conferences and events.

Nexstar Media Group has agreed to acquire KUSI-TV in San Diego from McKinnon Broadcasting Company and Channel 51 of San Diego for $35 million. KUSI-TV is an independent television station, broadcasting more than nine hours of local news each weekday and nearly 60 hours of local news every week. Together with Nexstar’s currently owned and operated KSWB-TV (FOX) in San Diego, Nextstar says, the two stations will offer more local news and information programming in the market than all of the other local stations combined.

The Eurovision Song Contest will stream on Peacock for the third year, starting with the semi-finals on May 9 at 3p. The finale airs May 13 at 3p. Olympic skater Johnny Weir will host a special “Watch With Live,” which allows viewers to interact with Weir, during the Grand Final.

To celebrate last night’s 350th episode of “American Dad!,” TBS kicked off #AmericanDrag, a new social impact campaign focusing on the series’ gender-fluid character Roger. TBS has joined forces with drag queens Trixie Mattel and Trinity the Tuck to create a custom video spot available on TBS’ social media platforms. For every quote-tweet of the video using the hashtag #AmericanDrag, TBS will donate $1 to The Trevor Project, a leader in suicide prevention and crisis intervention for LGBTQ young people.

Production has shut down on more series as the writers’ strike heads into week two. “We hate to strike, but if we must, we strike hard,” tweeted Jon Hurwitz, co-creator of Netflx’s “Cobra Kai.” George R.R. Martin, announcing that “A Knight of the Seven Kingdoms: The Hedge Night” has closed for the duration, was also among those supporting the walkout. “No one wanted this — no writer with an ounce of sense, anyway — but the producers and the studios and the networks and the streamers gave us no choice,” he said in a blog post.

“The Kelly Clarkson Show” is moving east. Production for season five of the daytime talker, which had been housed in LA, will film at NYC’s 30 Rockefeller Plaza in front of a live studio audience.

Oxygen has ordered “Texas Justice with Kelly Siegler” (wt) from Wolf Entertainment. The series follows murder investigations and trials in the Lone Star state. Oxygen is also bolstering its true crime slate with (working titles all) “The Pike County Murders” from KT Studios; “Real Murders of Los Angeles” and Sin City Murders” from 44 Blue Productions; and “Fatal Family Feuds” from Woodcut Media.

The CW has acquired Canadian comedy “Son of a Critch,” based on Mark Critch’s memoir about growing up in the ‘80s. Critch created and stars in the show, which counts Andrew Barnsley (“Schitt’s Creek”) among its executive producers. “Andrew and I had a ton of fun and success together on ‘Schitt’s Creek,’ and I can’t wait for everyone to see his newest hilarious and heartwarming series,” said The CW’s President of Entertainment Brad Schwartz. “’Son of a Critch’ is a truly unique family comedy about adolescent adventures and those awkward and relatable growing pains.

Hulu’s “The Bear” is back for season two on Thursday, June 22. Molly Gordon (“Animal Kingdom”) has joined the cast in a recurring role.

Quiz show “Hey Yahoo” premieres Monday, June 12 at 8p on Game Show Network. Tom Cavanagh (“The Flash”) hosts.

Bravo’s “Project Runway: All-Stars” kicks off Thursday, June 15 at 8p with a two-part premiere. Fourteen designers from the past 19 seasons have a shot at redemption in a season with a surprise twist.

A new season of TLC reality show “90 Day Fiance: Before the 90 Days” premieres Sunday, June 4 at 8p. Seven new couples prepare to meet their partner, while one returning favorite reunite to give love another shot.

Cairns Oneil announced the launch of a new ad format leveraging ChatGPT and dynamic creative. Launched within a programmatic campaign for its client, Rakuten Kobo, the dynamic ad unit leverages ChatGPT and Adform’s DCO to generate and optimize headlines using artificial intelligence in banner ads. The dynamic ad unit is built in layers, sending prompts to ChatGPT to automatically create headlines; if an ad isn’t successful after going into market, ChatGPT will discard the headline and generate a new one.

Programmatic media partner MiQ announced a new shopper intelligence solution, Consumer Link. Consumer Link integrates permissioned transaction, media consumption, geo-contextual, and behavioral data into a data spine allowing marketers to create campaigns that are more personalized. “The pressure for CPG marketers to identify and understand their shoppers – both online and in-store, maximize every dollar spent in reaching them, and prove bottom-line impact – has reached critical mass,” said Erin Madorsky, US Chief Strategy Officer for MiQ. “No matter what shopper segment marketers are after, finding them is increasingly dependent on smart, strategic combinations of screens, data, and creative.”

The Media Rating Council has granted MRI-Simmons continuing accreditation, along with a new accreditation for its Insights Platform. The continuing accreditation is for MRI-Simmons Doublebase USA study and its MEMRI application, data use by planners to make allocation decisions for various media. Newly accredited Insights Platform reduces the time planners, advertisers and media sellers spend on data analysis and consumer insights generation.

Teads unveiled insights on attention metrics that tie Conde Nast’s premium environments with significantly higher attention levels. The analysis, in collaboration with Adelaide, looked at 1,000 domains and revealed Condé Nast’s portfolio of brands scored over 50% higher in display and video attention levels relative to Teads’ publisher benchmark. Additionally, Condé Nast’s Vogue held the highest attention score among all publishers in the analysis, approaching Teads’ CTV benchmark which is currently 67% higher than the Teads-Adelaide video benchmark and 103% higher than the display benchmark.
