The doors closed on one high-profile legal case while another case thought to be settled was re-opened. HP has agreed to settle its lawsuit leveled at Oracle over the hiring of CEO Mark Hurd. The executive will end up forfeiting options on more than 330k HP shares as part of the settlement. Meanwhile, a federal appeals court has reopened the SEC‘s insider trading case against HDNet founder Mark Cuban, stemming from his sale of shares in the internet search company in 2004 shortly before a new stock offering was made. A lower court had earlier dismissed the case in July 2009, siding with Mr. Cuban’s position that he never agreed to hold on to his shares.


Turner Sports struck a 14-year agreement with the NCAA similar to its pact with the NBA and other leagues to manage and operate the NCAA’s entire digital portfolio. NCAA Digital will encompass a soon-to-be-redesigned as well as mobile and connected apps and destinations dedicated to all 88 NCAA championships. The joint agreement also includes operational oversight of NCAA March Madness on Demand (MMOD) on broadband as well as March Madness mobile assets, sharing sales and promotional responsibilities with CBS.
announced that it is planning to introduce its subscription-based Zune music and video services in Europe and other international territories, in concert with the content sync services featured in the new Windows Phone 7 OS. The monthly Zune music subscription service will be available for 9.99 euros /8.99 pounds per month for unlimited download and streaming access to the Zune music catalog and will be accessible via Windows-based PCs, Windows Phone 7 and Xbox LIVE. Zune Video on Xbox LIVE will enable movie rentals that can be synced to Windows Phone 7 devices.
Babelgum premiered a documentary series and a feature-length film about the gaming phenomenon, available online and via Bablelgum’s mobile apps. Ben Gonyo’s Gamers appears in 18 parts with new episodes appearing on Tuesdays and Thursdays. Monika Halcort’s The Battle for Our Minds is available now.


Twitter fell victim to an attack early yesterday morning that affected millions of users. The official explanation was that it was a security exploit caused by “cross-site scripting” – placing code from a foreign site directly on another. The issue caused messages and third-party sites to pop up on the page when users moused over posted links.
3D virtual world site IMVU announced new partnerships with games developers Viximo, Heyzap and OMGPOP to add casual and social gaming to its next generation social network. Now, in addition to hanging out and chatting in your 3D-rendered skin, users will be able to play casual games, purchase in-game virtual goods and integrate their IMVU avatars and profiles with OMGPOP’s platform.
Call for Votes: Video sharing site Vimeo has announced the finalists for its inaugural Vimeo Awards contest and is asking the viewing community to vote for its favorites in 9 categories, including Narrative, Remix, Original Series and Experimental. A panel of distinguished judges including David Lynch and Roman Coppola helped pick the cream of the crop. Votes will be accepted up to Oct. 9 when the finalists will be announced.


Online advertising start-up Rocket Fuel closed on a $10M Series B round of funding led by Nokia Growth Partners with additional investment from new investor Northgate Capital and existing investors Mohr Davidow Ventures and Labrador Ventures. Rocket Fuel utilizes prediction and automation techniques derived from rocket science (many employees are actually former NASA engineers) to improve ad targeting for ad agencies and exchanges. The round brings the venture’s total raised to $20 million.
Yahoo Sports
announced a new contentious tailgating-themed web series premiering Sept. 28 dubbed Behind Enemy Lines, sponsored by Bud Light. Each week the hosts venture into tailgating parties and sports bars. dressed in the colors of whatever team the home NFL team is playing that week.


The House Energy & Commerce Committee is working on amending the language of a targeted network neutrality bill that would limit the FCC’s authority and avoid contentious issues such as managed services, nondiscrimination and wireless broadband, reports B&C. Meanwhile, the FCC meets on Thursday to vote on the issue of opening up unused broadcast spectrum to enable next-generation mobile services.
Microtech Systems licensed the automatic “Qflix” DVD recording technology from Novato, CA-based Sonic Solutions Inc. to launch its own on-demand DVD manufacturing service. Amazon offers a similar service via CreateSpace.


ComScore announced a new collaboration with Equifax’s IXI Digital division to integrate comScore’s Audience Advantage platform with the AdEffx online campaign evaluation service. IXI enables segmentation of consumers according to an array of financial metrics, including estimated household income, financial assets, discretionary spending and available credit.


BlackBerry maker Research in Motion could be the next competitor in the burgeoning tablet computing space, according to WSJ report. The “BlackPad,” scheduled for release before Christmas, will feature a 7-inch screen and two build-in cameras.
Best Buy’s Napster has finally shown up as mobile app for the iPhone, iPad and iPod Touch. The subscription based app, charging $10/month, offers unlimited streaming of over 10 million licensed tracks and features an “automix” feature similar to Pandora’s artist-based recommendation service.


Matt Gillis joined mobile ad network Millennial Media as the SVP/Business Development. He comes aboard with former engineer Eric Hastings, who was named to the newly created position of SVP/Engineering.
Michael Sepso, co-founder of Major League Gaming and Zack Sherman, former President of Fox’s Zinc Media announced the formation of Legion Enterprises LLC, a new digital network and investment/acquisition fund targeting young male “digital mavericks”. Rebecca Paoletti, former Yahoo head of video for the North America region, also joins as Chief Product Officer.


It’s always nice to see an older world gentleman get dragged into the digital age, even if it is kicking and screaming. Storied director, actor. writer and film historian Peter Bogdanovich has chosen the respected independent film site indieWIRE to begin sharing his ruminations about Hollywood’s Golden Age. Peter is not doing it for the exposure, rather to help educate folks on what came before the current 3D explosion-laden entertainments at the box office. “The state of movie culture ­ indeed, the state of culture in the U.S.A. ­ is at a distressingly low level,” he explains in his welcome post. “At film schools all over the country, most of the students act as though picture history begins somewhere around Raging Bull.” He promises to write about at least a movie a week, beginning with Stage Door, Casablanca and The Heartbreak Kid (the latter starring he ex-girlfriend Cybil Sheperd.) indieWIRE parent company SnagFilms also announced an agreement with Starbucks yesterday to co-curate a monthly selection of feature documentary films to be offered for free on the soon-to launch-Digital Network. Now you’ll have something substantive to watch when sipping lattes in any Starbucks location.
