Good morning.  It’s Wednesday, October 5, 2005, and this is your first early morning briefing. 

Welcome back to the NHL Hockey Season!  After a year on ice … or rather off …. games resume today.  On the schedule today are games on Outdoor Life Network (Rangers vs. Flyers at 7p), Canada’s TSN (Senators vs. Maple Leafs at 8p, Flames v. Wild also at 8p), and on RDS/Canada (Canadiens vs. Bruins at 7p). Oh, you can also watch on your PC. Comcast is providing live streaming hockey games starting today to its broadband customers.  Comcast customers can watch up to two games a day for a season total of 300 games, through and including the Stanley Cup Playoff season.  Comcast will also provide games to its cable services customers on-demand 48 hours after the initial broadcast.  Bear in mind – local blackout restrictions also apply to the internet.

As expected, NBC has given My Name is Earl (20th) a full season pickup, with an order for nine more episodes, given the series its full complement of 22 episodes for the season.

* MORE GOOD STUFF *Viacom has rescinded its petition to the FCC to review the DTV kids rules and instead has appealed to the federal courts to toss out the rules or dismiss them as too vague, unconstitutional, and challenging the FCC’s authority to make such rules.  The kid rules are for both broadcast and cable and include limits on advertising to kids, limits on the types of promotions on-air, online, cross promotion.  On the flip side, The United Church of Christ Office of Communications has also withdrawn its FCC review request and headed to the courts believing that the rules aren’t strict enough.  The rules in question are those set in fall 2004 by the FCC.

WWE Raw moved to USA Network as of Monday night and for its debut performance drew in 5.6 million viewers for its three hour premiere.  WWE Raw kicked off at 7:55p, and from 9-11p averaged 6.0 million viewers, marking the largest audience for this show in over three years.

On Monday night Spike TV hosted 2.0 total million viewers for its weekly series The Ultimate Fighter 2 and its Ultimate Fight Night Live Special event.   The special aired from 9:05-11p, and delivered a 2.1 M18-49 rating with 1.1 million viewers.  The Ultimate Fighter 2 aired from 11-12m and delivered 2.1 M18-49 rating, also with 1.1 million viewers.

You can always depend on George Clooney to do LIVE television — the episode of ER, the black and white movie Fail Safe, and now a remake of the 1976 film Network for CBS. The original starred Faye Dunaway, William Holden and Peter Finch with his famous Howard Beale line, “I’m mad as hell and I’m not going to take this anymore!”  No air date has been set as yet, and no word yet if Clooney will play Howard Beale, or the William Holden role, if either.  Which ever, you gotta love a guy willing to jump headlong into danger zone of live dramatic TV.

BBC America will launch a new-to-the-US series on October 23 called Mile High.  This primetime soap focuses on the face-paced and sometimes risque world of a group of flight attendants.  The program originally aired in the UK on Sky 1 before flying across the pond.

Over the past month, TV One pulled in an additional 1 million subscribers.  As of the end of September, the African American-focused network reached close to 23 million homes. New system launches brought in the extra subscribers in Tampa (Bright House Networks), Miami, Vero Beach, FL and Ft. Wayne, IN (Comcast), Kansas City, Raleigh/Durham and Wilmington, NC (Time Warner Cable), Humboldt, CA and Russellville, AR (Cox Communications), California City, CA (Charter) and Minot, ND (Mid-Continent).

Warner Bros. International Television Division (WBITD) has signed an agreement with Canada’s Rogers Cable.   The cable operator will add WBITD’s movies to its VOD service on its Rogers Digital Cable platform.  Some of the films covered under the deal are Alexander, Constantine, Million Dollar Baby and Miss Congeniality 2: Armed and Fabulous.

 * NEW ORDERS / CASTING / DEVELOPMENT / PRODUCTION *HBO has a development deal in place with rap artist Wyclef Jean of the group Fugees, to star in a series based on his life.  According to Hollywood Reporter, the project will be written by Wyclef, together with Seth Rosenfeld and Danny Hoch.  Wyclef will also produce the original music for the project via is Platinum Sound studio.

WB has ordered 8 episodes of a new project from Ashton Kutchner and Jason Goldberg (together they produced Beauty & the Geek for WB last summer), called Fountain of Youth, produced by Katalyst and Fox 21, per Variety.  The unscripted series is a sort of Amazing Race style show, with 8 young twenty-somethings, and 8 senior citizens, making a “mad dash” across the United States, though time won’t be the only factor in this weekly elimination series.

Touchstone Television is looking at a comedy project from writer/exec prod Don Reo and George Lopez, about three sisters. Expected to star in the project are the three Vidal sisters, played by Lisa, Christina and Tanya Vidal. Ann Lopez who exec prod the television film Naughty or Nice starring her husband George and two of the Vidal sisters (Lisa and Tanya) for ABC last year, is also on board as exec prod of this project.

* EXECUTIVE MOVES *Kevin Kay has been appointed to GM/EVP/Sales Spike TV.  The announcement was made by Doug Herzog, President, Spike TV, to whom he will report.  Kevin stays in New York, and will oversee all East Coast operations of Spike TV including the production of specials and sports programming, marketing, press, research, on-air promotions, online and production departments.

Sarah Barnett joins Sundance Channel as SVP/Branding, On-Air and Creative Services.  The announcement was made by Laura Michalchyshyn, EVP/Programming & Marketing, to whom she will report.  Sarah comes to Sundance Channel from BBC America.  She will be based in New York.

* RATINGS *Monday — A18-49 Analysis: ABC was in front on Monday night with Wife Swap and Monday Night Football averaging a 5.0/13 A18-49 in final numbers from Nielsen Media Research.  CBS was #2 with a 4.8/12, followed by NBC 4.2/10, Fox 3.3/8, WB and UPN 1.4/4.  At 8p CBS’s sitcom combo won the hour with King of Queens’ 3.5/10 and How I Met Your Mother 3.9/10.   NBC’s 8 share for Surface tied with Wife Swap on ABC.  The football game averaged a 6.0/16 from 9-11:56pm in the A18-49 demo. Elsewhere, Two & a Half Men, Las Vegas and Prison Break all tied with an 11 share at 9p.  At 10p CSI Miami beat out Medium, 6.4/15 vs. 4.6/11.
