Good morning, it’s Wednesday, May 7, 2008, and this is your first early morning digital briefing.
Lawmakers and entertainment industry parties remain divided on the issue of net neutrality, based on widely differing testimony given in a House Subcommittee meeting on Tuesday. Hannah Montana producer Steve Peterman endorsed the Internet Freedom Preservation Act sponsored by Rep. Ed Markey on behalf of the WGA West, describing the internet as the “new television.” RIAA CEO Mitch Bainwol came out against it, arguing the marketplace should be given the freedom to regulate itself to protect against piracy. An equal number of Markey’s committee members seemed to line up on each side, indicated a long, drawn out battle over the issue. Meanwhile NCTA President Kyle McSlarrow defended Comcast’s actions to manage P2P traffic, noting the MSO was working toward developing techniques to regulate traffic without singling out individual applications. In other words, they’re trying to slow Bit Torrent users without appearing to be targeting them.
The New York Times, The Onion News Network, My Damn Channel and the producers of Hometown Baghdad were among the big 2008 Webby Award winners. The Times won 8 regular awards while The Onion won a total of 7 Webbys including both judges and people’s voice awards for Best Writing, Comedy: Individual Short or Episode. My Damn Channel won for David Wain’s Wainy Days and the popular mock tutorial You Suck at Photoshop. Comedy Central’s Stephen Colbert received special recognition as Webby Person of the Year for his viral “Greatest Living American” campaign. Webby Artist of the Year went to Black Eyed Peas frontman will.i.am, creator of the Obama video Yes We Can. PostSecret, Apple, National Geographic, PBS and Revision 3 also won multiple awards. MSNBC.com introduced a new online toolbox called NewsWare to serve as a storehouse and incubator for in house and user generated apps and widgets. A selection of customizable news tickers, visualization tools and the Facebook app NewsBlaster are up there now.
Cartoon Network is inviting kids to play along with Ben 10 using a new online tool allowing web savvy kids to construct their own games around the show. Prepackaged Ben 10 games currently dominate the top 10 most popular games at CartoonNetwork.com, according to the network, holding five of the top ten spots.
Entertainment Rights inked deals with YouTube, Joost and Babelgum to provide all three digital platforms with a selection of its kid/family-targeted animated content with the launch of the Retro Heroes channel. Under the deal, YouTube debuts a version of Retro Heroes featuring short-form webisodes from ER’s library, while Joost and Babelgum will also feature selected long-form programming. Entertainment Rights programming includes He-Man, She-Ra, Felix the Cat, Rocky & Bullwinkle, The Archies, Fat Albert and Casper the Friendly Ghost.
Call for Content: A couple of Knoxville, TN brothers-in-law have come up with a collaborative online film project called Rootclip.com, funded by Scripps Entrepreneurial Ventures. Inspired by the choose-your-own adventure books from their youth, the brothers produced a short opening to an open-ended story involving a briefcase and a meeting with a stranger. It’s up to you to advance the story with a one-minute video clip viewers will vote on to determine where the story goes next. The winner gets $500 and an all expenses paid trip to the Traverse City Film Festival to meet documentarian Michael Moore.
There’s nothing that drives gadget adoption like some exclusive content, and now Microsoft’s Zune device has finally got some. After turning its back on iTunes, NBC Universal has agreed to supply the Zune with TV downloads of shows like The Office, Heroes and Battlestar Galactica, delivered at the Microsoft points currency rate of 160 points per episode (roughly the same $1.99 Apple charges-what happened to pricing flexibility?) MTV Networks and Turner shows will help make up the 800 episodes Microsoft says will be available, to go along with the 3.5 million songs, 4,800 music videos and 3,500 audio and video podcasts on the service. Microsoft also retooled its Zune Social website to add more community features – allowing users download each other’s 9 most recently played or 9 most favored tunes. (These features are only available to Zune Pass subscribers, however, who pay $15/month in order to access unlimited tracks from the devices’ library.) All in all it was a big day for the Zune. But gosh it’s got a lot of catching up to do. Apple had about 71% of the MP3 player market at the end of Q1 according to The NPD Group, compared to only 4% for Microsoft.
HP also scored a major content integration deal. Devices running on HP’s MediaSmart platform now have access to YouTube videos via remote control, including MediaSmart TVs, remotely-accessible servers and the soon-to-be-released HP digital media receiver. Other MediaSmart integrations include CinemaNow movies, Snapfish photos and Live365 radio stations.
Sprint and Clearwire are close to announcing a $12 billion joint venture that will bring true WiMax broadband to computers and mobile devices in the coming years, reports the WSJ. More than $3 billion has been raised from other players including Comcast ($1.05 billion), Intel ($1 billion), Time Warner Cable ($550 million) and Google ($500 million). One of the sticking points of the deal was the concern that Sprint would use its position to limit the offering only to Sprint customers. Instead the service will be available to all comers, retaining the Seattle-based Clearwire name and boss, wireless pioneer Craig McCaw.
The iPhone lined up Vodafone as a distribution partner in 10 international markets including Australia, New Zealand, Italy, the Czech Republic and India. The deal may be significant because it seems to indicate Apple is willing to give up offering exclusivity in each market, as Vodafone is a distant third player in Australia with limited coverage and only a 16% market share.
The backlash against Jerry Yang continued after Yahoo publically admitted it would have been willing to sell to Microsoft below $37 a share. Portfolio manager Gordon Crawford, whose Capital Research owns over 6% of Yahoo, expressed out-and-out disgust at Mr. Yang for what he characterized in the WSJ as “overplaying a weak hand.”

LA-based Spot Runner raised another $51 million in funding from The Daily Mail and General Trust, Grupo Televisa and others to expand its create-your-own video ad interface to the UK and Latin America.
Yahoo expects to sell out 50% of its video ad inventory during its “upfront” meetings with advertisers this year, according to Silicon Alley Insider including inventory on partner sites such as Comcast, Forbes, MobiTV and MLB.com. That’s up from 30% presales achieved last year.
Accenture’s annual Global Media Content Survey indicated media executives are determined to focus on new platforms to drive growth in advertising, film, music, publishing, radio, the internet, videogames and television. When asked to identify the largest drivers of revenue growth over the next five years, two-thirds (66%) of respondents cited new platforms or new ways of delivering content. And nearly two-thirds (63%) of respondents said they will pursue a “multi-screen” distribution strategy, which includes television, online and mobile delivery.
- A leading 38% cited short-form video as the genre with the most potential, followed by online portal/publishing second (23%) and video games (18%).
- Social media and user-generated content are high-growth opportunities. Two-thirds of respondents also identified social media and user-generated content as a high-growth opportunities.
- When asked to identify what they believe will be the number one business model in five years, nearly two-thirds (62%) of respondents selected advertising-supported business models, compared with 25% who cited subscription-based services and 11% who cited pay-per-play services.
IMG Digital Media, a division of sports and entertainment company IMG, named Clive Baker as Chief Technical Officer and Angela Kyle as Commercial Director. Both will be based in London.

If you’re turning to the web to follow last night’s election results, check out some of the political bloggers using VodPod to aggregate videos from the campaign trail. Talking Points Memo is a good one, featuring many of the pointed ads that have been unleashed in the past view days. VodPod is all about building communities of followers around topics of interest, using video to spark discussions. It’s got a pretty decent search engine as well, which scrubs Vodpod, YouTube, DailyMotion, MySpace and Comedy Central for results.
