In a ruling that goes far beyond halftime shows at the Super Bowl, a U.S. Appeals Court struck down the FCC‘s Indecency Rule on Tuesday, calling it “unconstitutionally vague” and claiming that it creates a “chilling effect that goes far beyond the fleeting expletives at issue here,” (namely the remark Bono made during the live broadcast of the 2003 Golden Globe Awards.) The ruling, which follows a Supreme Court ruling in April 2009 that said the FCC followed proper procedures, vacates a 2004 decision by the Bush administration FCC under Kevin Martin to step up enforcement of indecency on broadcast airwaves. The matter is expected to return once again to the Supreme Court.
 

~ MULTIPLATFORM CONTENT NEWS ~

 
The FIFA World Cup put up its best usage numbers ever across a number of online outlets:

  • ESPN3.com attracted 7.4 million viewers, who watched more than 15.7 million hours of video during the tournament. ESPN’s FIFA World Cup app was downloaded more than 2.5 million times, per paidcontent.
  • Univision‘s Futbol site generated 34.7 million aggregate visits across online and mobile, streaming over 10 million total hours of live video on UnivisionFutbol.com. Users spent nearly 1:30 minutes per viewing session across more than 265,000 unique players online while Univision’s Futbol App was downloaded over 450k times from the App Store
  • The official FIFA site achieved its best reach in Brazil (7% of the internet audience) and the UK (6.9%), and its worst in the U.S. (2.8%) and Japan (.1%), per Nielsen. Brazil also led in Ave. Time Spent on the site at 27:46, with the U.S. second at 21:41

 

~ INNOVATORS & START-UPS ~

 
Social gaming leader Zynga (“Farmville,” “Mafia Wars”) has received a huge $100 million+ behind-the-scenes investment from Google Ventures, TechCrunch first reported over the weekend. Google is expected to launch its own casual games division, Google Games, later this year and the acquisition indicates the games will have a definite social bent. Meanwhile, Zynga could replace PayPal with Google’s Checkout online wallet system to facilitate micropayments within its games.
 
Peacock Equity, a joint investment fund of GE Capital’s Media, Communications & Entertainment business and NBC Universal, has invested $2 million in equity in voice chat specialists Vivox. The company enables chat apps for social applications including online games and virtual worlds.  Other Vivox backers include Benchmark Capital, Canaan Partners, GrandBanks Capital and IDG Ventures.

After a frightening 2009, worldwide online ad spending is poised to return to double-digit increases this year, growing by 11.9% to 61.8 billion, according to new estimates from e-Marketer. Meanwhile, the internet’s share of total ad spending worldwide will jump from 11.9% in 2009 to 17.2% in 2014. Continued high growth in the online space coupled with a 2009 spending decrease of 10.5% for total media is expected to help online get an ever-larger slice of the ad spending pie.
 
Sony Corp. of America
(SCA) and News Corp. have formed a partnership program to program a mammoth 35′ by 40′ LED display at Broadway and West 43rd in Times Square. FOX Sports’ coverage of the All Star Game last night was the screen’s first big event. Sony will also utilize the screen to display real-time PlayStation 3 match ups.
 

~ TECHNOLOGY DEALS, MERGERS AND SKIRMISHES ~

 
Meredith Corp. completed its acquisition of mobile marketing company The Hyperfactory, after taking a minority stake in the firm last year. The deal allows Meredith to expand its integrated media unit to include mobile platforms. The Hyperfactory has already been used to develop mobile components for Meredith’s Better Homes and Gardens, Parents and Fitness brands.
 
A U.S. District Court judge drastically reduced the damages award leveled at Boston college student Joel Tenenbaum, who was found guilty of illegally sharing 30 copyright-protected songs online a year ago, per CNET. The award was reduced from $675k to $67,500, as the judge claimed that the original fine was too high and “unconstitutional.”
 
Ascent Media has contracted with C-SPAN to refit its control rooms to enable the network to broadcast live in HD from remote locations. This week’s confirmation hearings of Supreme Court justice nominee Elena Kagan will be the first such hearings ever presented in HD, according to Ascent.
 
IAC’s Vimeo video sharing site announced it is now offering Creative Commons licensing options for its members.

Google’s Android platform gained 4 percentage points on the competition during the last 3 months to capture 13% of the smartphone market, according to ComScore‘s most recent MobiLens data. Microsoft suffered the steepest decline, dropping to a 13.2% market share.

Kraft, which won converts with its iFood Assistant iPhone app, has unveiled a new food-themed app for the iPad. Kraft’s Big Fork Little Fork app, available for $1.99, provides recipes, games and interactive activities designed to get kids excited about healthy eating.
 
In an effort to popularize its line of Nook e-readers among students, Barnes & Noble announced that it is giving away its textbook-geared NOOKstudy application for PC and Mac computers for free.

Say it isn’t so. Long-time N.Y. Yankees owner and the man behind the launch of the YES Network, George Steinbrenner, passed away yesterday at the age of 80 after suffering a massive cardiac arrest. Steinbrenner was honored with a special tribute during last night’s All-Star Game, (the first ever televised in 3D.)
 
Activision Blizzard
hired Deutsch LA CEO Eric Hirshberg as the new CEO of Activision Publishing, effective September 7, 2010. Eric takes over for Mike Griffith, who was upped to Vice Chairman of Activision Blizzard. He will report to Thomas Tippl, Chief Operating Officer of Activision Blizzard, in Santa Monica, CA.
 
Gannett Digital has named Craig Etheridge (former VP of Emerging Platform Sales at The Weather Channel) as VP/Mobile Advertising Sales. Craig will be responsible for expansion of Gannett’s mobile advertising portfolio in addition to developing long-term mobile ad sales strategy.
 
Eimer McGovern has been appointed CFO of Dublin, Ireland-based optimization software company Openet.
 
Content platform Daylife named former CEO of Salon Media Group Chris Neimeth as Chief Commercial Officer, a new role in the company. Also, Marc Hedlund was hired as Chief Product Officer replacing Anil Podduturi, who is now VP/Product Strategy at NBC Universal.
 
Sara Camden was tapped for the newly created position of Senior Marketing & Communications Manager for CahCha. She will be based in the company’s Indianapolis headquarters and report to Cat Enagonio, VP/Marketing and Client Care.
 
Video ad network YuMe has opened a new regional sales office in Santa Monica, CA and hired a trio of new ad sales people to staff it. Marc Hale joins as a Senior Account Executive; Blake Hebert comes aboard as Senior Account Executive for Automotive; and Evan Hsieh joins as Account Executive.

MediaLinkup.com is a new insiders social networking/professional advancement site geared toward media industry professionals. Co-founded by sportscaster Dave Cera (who worked for NBC affiliate WMC-TV in Memphis through 2008), the site features a very basic interface, encouraging members to upload photos and videos and enabling employers to search the site for talent via dozens of categories. Niche social networks are nothing new (here’s a rundown of many of them on Wikipedia) but at this point it’s truly an uphill battle to pry people away from their Facebook or Linkedin accounts.
