Good morning, it’s Tuesday, June 5, 2007 and this is your first early morning briefing.

In a 2-to-1 vote, the 2nd Circuit Court of Appeals in New York rejected the FCC’s ruling that Fox’s airing of “fleeting expletives” uttered by Nicole Richie and Cher during the 2002 and 2003 Billboard Music Awards, equated to indecency. The judges also questioned if the new FCC policy, which was imposed after Bono’s word choice during NBC’s broadcast of the Golden Globe Awards in 2003, was legally sustainable. The FCC is currently reviewing the appellate court’s decision. A second case challenging the FCC indecency ruling involves fines forced on CBS from the Janet Jackson Super Bowl wardrobe malfunction incident.

As introduced at its recent upfront presentation, Telemundo is moving forward to reformat its primetime advertising breaks. The network will launch Power Pod this fall to advertisers, which will make the first commercial break in each show equal to 1 minute in length. Power Pod will also be available on Telemundo’s cable network mun2.
 
Style Network will premiere season two of its hair-cutting reality series Split Ends June 23 at 6p. The one-hour show, produced by 44 Blue Productions, will have more upscale hair designers trade places with down-home beauticians in the new season.
 
Starz Entertainment will soon have its new high-definition premium movie channels available on DIRECTV starting this September. The three new channels, Starz Comedy HD, Starz Edge HD and Starz Kids & Family HD will be added to the existing Starz HD channel, which will be available to DIRECTV customers via East and West Coast feeds.
 
Note to Self: Okay, this is pretty neat – I know that sounds like Jan Brady, but really, this is cool. Discovery Times Channel will air a program called Conspiracy Test: The RFK Assassination which will introduce a new audio recording supporting a second gunman theory, and an updated review of ballistics and eyewitness statements.  All of this adds up to potentially a new theory behind the murder of Senator Robert Kennedy. Doesn’t that sound cool? The show airs tomorrow night at 9p. I’ll be there.
 

~ PRODUCTION & DEVELOPMENT ~

~ EXECUTIVE MOVES ~

The Nielsen Company has promoted three senior level executives within its Consumer Product Leadership division:

  • Mitch Barns is now Global President/Homescan, Spectra and Loyalty services. Mitch will oversee the global expansion of Spectra which begins this year in Australia and Mexico followed by Europe in 2008. Based in Schaumburg, IL, he will report to Joe Willke, President/Global Consumer Product Leadership.
  • Dennis Moore will move into the position of Global President/Nielsen Analytic Consulting, succeeding Mitch Barns in this position. Based in Chicago, Dennis will also report to Willke.
  • Tim Willke has been upgraded to Global President/BASES, where he will report to Mitch Barns. Based in Parsippany, NJ, Tim has been with BASES since 1986 joining as an analyst.

Eric Kabakoff has been hired as Research Director for WABC-TV. Previously, Eric has been a Research Manager then Associate Director of Research for ABC National Television Sales.
 
Michael Watson has been appointed as Sales Director, Southeast for The Weather Channel Interactive. In his new role, Michael will supervise sales activity for weather.com and Desktop Weather in an area that covers North Carolina to Florida to Texas, as well as the Caribbean.
 
It is official as Katherine Pope has been named President of NBC Universal Television Studio. Katherine will supervise the studio’s production of such series as House, The Office, Heroes and the cable programs Battlestar Galactica and Monk. Most recently, Katherine was EVP/NBC Entertainment where she provided oversight to the new NBC programs which will debut this fall – Life, Journeyman, Bionic Woman and Chuck.

Also at NBC, Teri Weinberg has joined the NBC Entertainment as EVP, filling the spot vacated by Pope.  She will oversee all aspects of NBC Entertainment’s scripted programming, reporting to Ben Silverman and Marc Graboff. Teri comes from Reveille where she was EVP/Scripted Programming.
 
Access 360 Media has tapped Tony Paruszewski as VP/Network Sales where he will manage advertising sales in the West and Southwest regions.
 
Amy Girdwood has been elevated to EVP/Human Resources with Discovery Communications. She will head the human resources management team that supports the company’s global workforce that exists in more than 170 countries on five continents. Amy will report to Adria Alpert-Romm, SEVP/Human Resources. 
 
Ron Carlivati has been upped to Headwriter on ABC’s daytime drama One Life to Life, effective immediately. He succeeds former Headwriter Dena Higley with whom he worked as Co-Headwriter. Ron has been a staff writer on One Life to Live for 11 years.
 
People en Espanol has made Betsy Henao its new Southeast Advertising Manager. Based in Miami, Betsy starts in her new position this week.

FRIDAY – A18-49 AnalysisFOX laughed all the way to first place Friday night with 1.9/7 A18-49, according to fast affiliate ratings from Nielsen Media Research. FOX with TV’s Funniest Moments and UNIV with La Fea Mas Bella tied for #1 at 8p with 1.5/6 apiece. FOX was then the solo leader at 9p with the second half of TV’s Funniest Moments at 2.3/8. ABC won during 10p by delivering a 2.0/6 for 20/20.
