Good morning. It’s Thurs day, May 18, 2006 and this is your first early morning Kids! briefing.

This week the Recording Industry Association of America (RIAA) filed a lawsuit against XM Satellite Radio claiming that XM is guilty of “massive wholesale infringement” when XM subscribers record and store songs (as MP3 files) off of the live satellite service onto the Inno, a new satellite device from Pioneer that holds upwards of 50 hrs of material/1000 songs.  The RIAA is seeking damages of $150,000 for every song copied by XM subscribers off the satellite service using the Inno.  XM responded to the lawsuit with a statement explaining the devices are legal and allow people to listen and record off of the radio the way they have been legally doing for years, and saying, “The music labels are trying to stifle innovation, limit consumer choice and roll back consumers’ rights to record content for their personal use, ” and that the lawsuit, “… is a negotiating tactic on the part of the labels to gain an advantage in our private business discussions” said XM in a statement.  XM, which does pay a performance license to the music industry, has been supporting the Inno through marketing efforts as an iPod alternative using the tag-line, “It’s not the pod, it’s the mothership.”  Pioneer’s slogan for the Inno is, “Hear it, click it, save it.”  Pioneer introduced the Inno ($400) in March, and Samsung plans to introduce a similar device called Helix.  The Consumer Electronics Association (CEA) put its support behind XM Satellite Radio yesterday in a statement, pointing out that the record labels receive royalties on every XM recording device sold, under the Audio Home Recording Act, which the both the CEA and the RIAA had input.

MTV Networks steps into the world of digital music download services this week with the launch of the public beta test of Urge, under a partnership with Microsoft.  Urge is a featured part of the new upgraded version of Microsoft’s Windows Media Player 11.  Initially Urge is offering 2+ million music tracks that are available for download for $.99 each, by album from $9.95 and up, a monthly fee of $9.95 for unlimited downloads or for $14.95 that allows consumers to transfer the downloaded songs to various portable devices, though not Apple’s iPod.  Urge also features streaming videos, which it will offer for sale later on during the year.  Additional Urge features include:

  • Feeds, which allows consumers to sign up for updated playlists of the music (of genres they like) that is delivered directly to their computer or portable music player
  • Informer Music Blogs, pretty much what it sounds like, offers editorial content on all sorts of music from a range of music experts with an accompanying playlist
  • Other programmed playlists include Must-Haves specific to styles, moods, decades, cities and so on, This Week In…, Celebrity Playlists from bands and so on
  • Auto Mixes, these are automatically generated playlists built around specific artists or styles of music selected by the user, and refreshed every time the user accesses Urge.

MORE KIDS STUFF

A new special episode of the preschool series The Backyardigans will premiere on Nick Jr., June 19, 11:30a, and later that day on Noggin at 4:30p.  Titled Tea Party the episode takes viewers through the jungles off Southeast Asia.  A music video from The Tea Party will be featured in advance of the episode’s debut.  Beginning Monday, June 5 the video will be available via Video-On-Demand on Comcast, Charter, Cablevision, Verizon FiOS and Cox.  A week later on Monday, June 12, the music video will also be available on wireless carriers, in addition to being streamed on Nick Jr. Video, Nick Jr.’s broadband video service.

MARKETING/LICENSING

Diamond Select Toys & Collectibles has entered into a partnership with Art Asylum and Universal Studios Consumer Products Group to manufacture products based on the Sci Fi Channel’s original series Battlestar Galactica.  Under the deal Art Asylum will handle development of the resin collectibles and Minimate block figures for both the classic Battlestar Galactica show and the current series, while Diamond Select & Collectibles will handle the marketing and sales of the new line.  The first series of Minimates is expected to ship later this year.  A new season of Battlestar Galactica, produced by NBC Universal, is slated for fall 2006.

WizKids Inc. has entered into a license deal for its HorrorClix game with Fox Licensing and Merchandising for two Alien vs. Predator Collectors Sets.  The first set includes seven Aliens and will be available beginning December 2006, first to “Buy it by the Brick” customers at hobby-game stores.  The Predator set will debut in early 2007.  Each set will include a special map detailing locations from the movie, including shifting walls in an ancient pyramid.  WizKids’ first HorrorClix sets will be released in stores August 30.

Warner Bros. Consumer Products has inked a new licensing deal for DC Comics with Naki World, a manufacturer/marketer of third party videogame accessories, to produce videogame accessories based on based on the upcoming Warner Bros. movie Superman Returns and the core Superman brand from DC Comics’ comic books.  The accessories will be available for all current and next generation videogame consoles and handhelds.  Superman Returns opens nationwide Friday, June 30, 2006.

Autodesk, Inc.’s LocationLogic applications will be employed by Disney Mobile to support its Family Locator function on Disney Mobile’s new wireless phone service.  Through the LocationLogic technology parents will be able to locate their kid’s handsets using GPS technology.  Family Locator is part of Disney Mobile’s Family Center, which also includes the ability for parents to set spending allowances and track usage for voice minutes, text and picture messaging as well as downloadable content; determine the house of the day and days of the week kids can use their phones; restrict and allow specific phone numbers; and prioritize messages from family members.  Disney Mobile is set to launch next month.

STONE SOUP

NBC Universal Cable (NBCUC) will offer Brokeback Mountain to VOD and PPV on May 18. Tying in with the film’s premiere, NBCUC will donate $10,000 to Cable Positive, the industry’s non-profit organization dedicated to raising AIDS and HIV awareness. Proceeds include $1 donation to Cable Positive for every Brokeback Mountain e-card sent via www.universalvod.net. In addition to the national donation, NBCUC will contribute an additional $5,000 to each participating local Cable Positive chapter. The promotion will be supported by cross-channel, radio, online and email.

EXECUTIVE MOVES

Starting on Monday, May 22, Mark Bohn joins Cynopsis as VP/Director of Sales overseeing Cynopsis and Cynopsis: Kids.  Mark’s sales career includes positions with Viacom, Fox Cable Networks and A&E. He helped launch a successful technology based marketing start-up and ran ad sales for an internet company.  Give a holler to the office (203-926-9878) – he’ll be there Monday and Tuesday.  Thereafter, he’s based in New Jersey and we’ll make sure you have all his contact information.

SloaneVision Unlimited, Inc., has upped Glenn R. Hendricks, to VP/Business Development and he also adds the title of VP/Licensing & Merchandising to title.  Hendricks was the first SloaneVision employee when the company was founded in 1996.  He left SloaneVision to run the licensing department at Sunbow/Sony Wonder and later returned to Sloane.

Glen Charles has joined Educational Adventures as a member of its Board of Directors.  Charles was the co-creator and co-executive producer of Cheers, and served as the head writer and/or producer on TV series including Taxi, The Bob Newhart Show, The Mary Tyler Moore Show and M*A*S*H.  Other board members include Howard Kazanjian, and executive producer and/or producer of Star Wars, Return of the Jedi, Empire Strikes and Raiders of the Lost Ark.  Educational Adventures is a multi-media edutainment company that develops/produces/markets kid targeted properties including Danger Rangers, which includes a TV series and accompanying DVD and books.
