Good Morning. It’s Thursday, June 8, 2006, and this is your first early morning briefing.
They say the best defense is a good offense, and that is the legal maneuver Cablevision has adopted with its ready-to-launch DVR service. By now you’ve heard Cablevision’s plan to offer subscribers the ability to record programs for later viewing, but rather than have the hard drive in their homes, Cablevision will house the hard drive at the head end, recording and playing back on demand. Many major networks find this set-up copyright infringing and have filed suit to stop the service before it begins. Cablevision has now filed a counter-suit against those same networks and studios including ABC, CBS, NBC, Paramount Pictures, 20th Century Fox Film and Disney Enterprises, asking the court to determine the Cablevision DVR service will not be “subject … to direct liability for infringing” copyrights.

NBC: Windfall at 10p
Changes at MSNBC – President Rick Kaplan has resigned, and overseeing for the time being will be NBC News Prez Steve Capus. Kaplan’s contract was scheduled to expire in eight months. While MSNBC is up in A25-54 year to year in primetime, projects with Tucker Carlson and Rita Crosby, as well as Connected Coast to Coast with Ron Reagan and Monica Crowley failed during Kaplan’s than 2-year tenure.
And changes afoot at CNN Headline News – the weekend primetime programming lineup will now look a lot more like its weeknight lineup. Prime News with Erica Hall will air on Sat/Sun at 6p and will include news highlights from the previous week. At 7p and 9p, reruns of Glenn Beck; reruns of Nancy Grace at 8p and 10p; and highlights from Showbiz Tonight at 11p.
It just got much more expensive to do anything “indecent” on television. Congress voted to go ahead with increasing tenfold the indecency fine from $32,500 to $325,000 per incident. What does the President think about signing such a bill into law? “I believe that government has a responsibility to help strengthen families,” said President Bush. “This legislation will make television and radio more family-friendly by allowing the FCC to impose stiffer fines on broadcasters who air obscene or indecent programming.”
WE: Women’s Entertainment has slate of new original series and one returning series debuting this month. Two shows have already started – Supersize Surgery (debuted June 6) acquired from iD Distribution, where cameras follow a group of overweight people for whom surgery is the last resort; and I Do . . . Let’s Eat from Beyond Entertainment which premiered June 7, about culturally diverse wedding receptions with an inside look at the spreads and the chefs. Returning this summer is Bridezillas on June 11 from September Films. And the new acquisition produced by USA Today is called USA Today/WE Weight-Loss Challenge, premiering June 12, focuses on six individuals as they sacrifice to achieve their weight-loss goals. Their progress will be followed on WE and USAToday.com and in USA Today.
TLC has commissioned a U.S. version of BBC Three‘s House of Tiny Tearaways to be renamed as House of Tiny Terrors. The series, scheduled to air later in 2006, will feature the BBC’s clinical psychologist Dr. Tanya Byron as she works with three American families brought to England to be observed and coached with six intensive days of parenting training and soul-searching. In case you were worried for them … don’t … they will have American staples such as a coffee maker and groceries flown in. MTV’s Karen “Duff” Duffy will host the show according to the U.K.’s Digital Spy.
E! Entertainment is reportedly looking for that just-right series to delve the network into a whole new area – the scripted series, per Hollywood Reporter. The network is looking for a comedy tho open to dramas as well, the network hopes to have its first scripted comedy series on the air some time next year. Ted Harbert, Pres/CEO of E! is looking to introduce one or two new series each year. E! has also named Alex Maggioni as SVP/Original Programming and Series Development.
Twentieth Century Fox Television Distribution has upped Brendan Zauner to VP/Sales – Asia. Brendan remains based in the company’s Sydney office and continues to report to Richard Samuels, SVP/Managing Director for Asia. Brendan’s new duties will include overseeing the company’s sales efforts into South East Asia and the Indian sub-continent. While continuing to work with Fox’s properties in traditional media, he will now explore new media opportunities, among other responsibilities.
Scott Grogin has upped to SVP/Corporate Communications for Fox Broadcasting, reporting to Joe Earley, EVP/Publicity, Corporate Comm. and Creative Services. Scott will continue to be the primary contact between the trade, financial and business press and the network. He will also be working with Fox Networks Group President/CEO Tony Vinciquerra and Fox Network President Ed Wilson on interdivisional and affiliate relations initiatives in addition to acting as the communications liaison with other divisions including Fox Networks Group, Fox Mobile Entertainment and Fox Interactive Marketing
Louise Benham has been promoted to Managing Editor for LIVINGtv, LIVINGtv2 and ftn, effective immediately. Louise will report to Claudia Rosencrantz, Director/Programming, and the acquisitions and scheduling teams will report to her.
Len Falter has been appointed VP/GM for Comcast in the central California area, where he is responsible for the company’s operations in Fresno, Visalia, Hanford, Merced, Los Baños and other neighboring communities.
Laura Kirin has been hired as Account Executive for DIC Entertainment. Based in Chicago, she will report to Karl Kuechenmeister, SVP/Advertising Sales and Marketing. Laura will manage clients and agencies in the Midwest and Southwest regions and the broadcast and new media effort for the upcoming children’s programming block CBS’s Saturday Morning Secret Slumber Party.
MarVista Entertainment has named Zac Reeder to the new position of Head of Acquisitions. Reporting to Michael D. Jacobs, President/Production and Distribution, Zac will supervise the acquisition of independently produced films and television shows for the company’s domestic entertainment label and for the worldwide distribution division. He will also represent the company at events such as BANFF, New York’s IFP, Sundance Film Festival among others.

On the heels of the May sweeps numbers for syndication, it should be noted that King World Productions has achieved something for the history books: they are the first syndicator to distribute the top 5 rated programs according to HH ranking, during a single sweeps period. Those programs include Wheel of Fortune, Oprah Winfrey Show, Jeopardy, Dr. Phil and Everybody Loves Raymond.
Tuesday – A18-49 Analysis: FOX captured the lead Tuesday night with a 3.0/9 A18-49, according to fast affiliate ratings from Nielsen Media Research. NBC was next with 2.8/9, followed by CBS 2.1/6, ABC 1.6/5, UNIV 1.3/4, UPN 0.8/2, WB 0.7/2 and TELE 0.5/1. At 8p, the repeat of House on FOX took the first slot at 2.6/9; encores of CBS’ NCIS and NBC’s Last Comic Standing tied for second at 2.1/7 apiece. The new version of NBC’s Last Comic Standing overcame the rest to win at 9p with 4.0/11. Then in the 10p hour, CBS’ 48 Hours Mystery at 2.5/7 narrowly beat NBC’s rerun of Law & Order: SVU at 2.4/7.
