Good morning, it’s Monday, October 27, 2008, and this is your first early morning digital briefing.

A senior lawmaker – Rep. John Dingell, Chairman of the House of Representatives House Energy and Commerce Committee – added to the chorus of “White Space” protests led by broadcasters on Friday. Mr. Dingell sent a list of questions to FCC Chairman Kevin Martin asking the agency to identify devices that are causing interference to broadcasters using the band for unlicensed broadband services. The FCC is due to vote on the proposal to open up the spectrum on Nov. 4, the day America votes for its next president.
 

~ MULTIPLATFORM CONTENT NEWS ~

 
Once a “me too” feature for many newspaper sites, video has become a central offering for print publishers. NYTimes.com launched a spiffy new video portal (nice use of black space) utilizing Brightcove’s 3rd generation publishing platform. It plays HD video in 16×9 format, integrates video across more sections of the site and adds a variety of sharing tools allowing users to embed NYTimes video on their favorite social networking platform including Digg, Facebook, LinkedIn, Mixx and Yahoo! Buzz. The Times produces over 100 original videos per month and has over 3,000 clips in its archive.
 
Lifetime returned with a third season of its well-executed Mommy vlog Mommy Madness, beginning another set of 12 episodes with a special Halloween edition. Comedienne and real life Las Vegas mom Angela Hoover deals with Halloween rush.
 
Warner Bros. International Television Distribution (WBITD) signed a distribution agreement with South Korean IPTV provider GOM TV for the Korean rights to the 40-episode original web series Sorority Forever. The show is created by McG and Big Fantastic.


~ INNOVATORS & START-UPS ~

 
Opera fans who live outside of the city (or who can’t afford tickets) can subscribe to a new online video service at the Metropolitan Opera website, powered by Permission TV and Move Networks. The Met Player offers access to 170 full-length performances including 13 operas shot and recorded in HD. Subscriptions offering unlimited access are available for $14.99/month or $149.99/year.  Through the end of 2008, Met Members at the $125 level and above can purchase an introductory six-month subscription to Met Player for $49.99.
 

~ TECHNOLOGY DEALS, MERGERS AND SKIRMISHES ~

 
If you die in The Matrix do you die in real life? A 43-year piano teacher from Kyushu was jailed last week after illegally hacking into the account of her digital partner in the interactive game Maple Story and destroying the character he had spent a year creating after he had unexpectedly demanded a divorce from the woman’s avatar. If convicted she faces up to 5 years in prison, according to reports.
 
Microblogging service Twitter could be used by terrorists as a communications or operations tool, according to a report by the 304th Military Intelligence Battalion sited by Wired, posted on the website of the Federation of American Scientists (FAS). The report outlined scenarios in which militants could make use of Twitter ­ combined with Google Maps, cell phone pictures/video or other tools, to identify targets or detonate explosives.
 

~ TRENDS, RESEARCH, ETC.  ~

 
Technology firms are often embroiled in litigation (hence the Skirmishes sub head above.) But who knew it was this bad. Law firm Fulbright & Jaworski‘s annual U.S. Litigation Trends survey found that 68% of technology companies faced at least one new lawsuit last year, with 30% facing 6 or more new suits in the past year. And 29% of the technology companies surveyed reported facing at least one $20 million action. Around 14% of the technology firms in the study reported spending at least $5 million on litigation, excluding costs of settlements and judgments, while 47% reported spending over $1 million per year on business disputes.
 
NBC was #1 for the second straight week among Hitwise‘s ad supported broadcast network website rankings. NBC’s Heroes was the top-ranked TV show website while The Office jumped to the #2 spot from #6. Comedy Central’s South Park was the #1 ranked cable TV show website for the second straight week. The election also continues to play a huge role among adult-oriented cable TV sites. The network’s The Daily Show site jumped to the #2 ranking from #4. Meanwhile three Fox News sites made the top 10: Hannity & Homes, Hannity’s America and O’Reilly Factor.

The news blogging community welcomed a new entrant to its ranks this month – TheDailyBeast, edited by former Vanity Fair and The New Yorker editor Tina Brown and backed by Barry Diller’s IAC/Interactive Corp. News aggregation is an extremely crowded category but this one is worth making room for, gaining points for its pointed attitude and fresh presentation. DailyBeast is a perfect mix of highbrow news coverage and satire and lowbrow gossip. It has a wonderfully visual interface that draws the eye toward its features. The Big Fat Story collects stories on a single topic from multiple sources. The Cheat Sheet ranks stories by perceived importance. The Buzz Board allows you to filter stories by columnist and area of interest and set your RSS feeds accordingly. Even the name is clever – The Daily Beast is the name of the newspaper in Scoop, Evelyn Waugh’s hilarious satire of Fleet Street. (Ms. Brown says it’s her favorite novel.)
