Good morning, it’s Monday, March 26, 2007 and this is your first early morning briefing.
New York-based Cablevision Systems Corp. succumbed to losing its legal fight against many Hollywood studios and television networks on the right to offer a network-based digital video recorder service to its subscribers. Cablevision was banking that its network-based DVR service, Remote Storage DVR or RS-DVR would be a substitute for hundreds of thousands of digital set-boxes in subscribers’ homes. The studio and television networks, represented by Time Warner, News Corp., CBS Corp and Walt Disney Co., filed their lawsuit last May arguing the RS-DVR service would violate U.S. copyright laws. The studios and networks further contended that RS-DVR would allow subscribers to store television programs on Cablevision’s own computer servers, which would lead to retransmission of the programs and then copyright infringement. The U.S. District Court in Manhattan sided with the studios and networks, and the judge also threw out a countersuit by Cablevision. However, Cablevision said in a statement late Thursday that it will consider filing an appeal against the ruling.

Season two of the weekly late-night talker The Henry Rollins Show will return to the Independent Film Channel (IFC) on April 13. Guests this season include Marilyn Manson, William Shatner, Ben Stiller and more. The show is produced by Swift River Productions.
Season three of Run’s House on MTV begins April 9 at 10p. Rev. Run and the Simmons family return to face new crisis and growth situations such as the two oldest daughters, Angela and Vanessa living on their own in Manhattan. The first episode of Run’s House airs prior to the debut of Taquita and Kaui at 1030p.
HBO‘s summer Sunday schedule has been firmed up and it all begins on June 10 with the finale of The Sopranos on that Sunday evening at 9p. Immediately following will be the premiere of John in Cincinnati at 10p (the following week this show slides back into the 9p time period). On June 17 following Entourage at 10p, is the launch of Flight of the Conchords at 1030p.
Art Stolnitz, a forty-five year television industry veteran and former EVP/Business Affairs at Warner Bros. Entertainment died from complications due to a stroke on March 21 at Eisenhower Medical Center in Rancho Mirage, CA. He was 79. Funeral service for Art will be held at noon today at Mount Sinai Hollywood Hills in Los Angeles and a reception will follow at Warner Bros. Studios in Burbank. Instead of flowers, donations are encouraged to the Art Stolnitz Law Scholarship Fund, Office of Development, University of Tennessee, 600 Andy Holt Tower, Knoxville, TN 37997.

TV Land introduces a slate of new original series and acquired series for the new season all targeting the Baby Boom generation:
New original series and pilots in development:
- High School Reunion – premieres August 8 – several classmates from a 1986 high school class – the jock and the cheerleader to the nerd and the bully and more – will reunite during a two-week break in Hawaii to relive old memories and spark old rivalries.
- Back to the Grind – premieres October 10 – new half-hour series has actors recreating a real-life version of their roles from classic television shows. Actors such as Loni Anderson of WKRP in Cincinnati and Harry Anderson of Night Court will participate.
- Penny and Cindy – premiere date TBA (pilot in development) – Penny Marshall and Cindy Williams of the iconic Laverne & Shirley sitcom will star in this new scripted buddy comedy.
- 35 and Beyond Super Model Search – premiere date TBA (series in development) – aspiring models age 35 and older will battle in this elimination-type competition show to win a modeling contract from New York’s Wilhelmina Models Inc.
- Celebrity Love Cruise – premiere date TBA (series in development) – celebrities look for love on the open seas aboard a cruise ship.
- Family Foreman – premiere date TBA (pilot in development) – viewers will get a unique up-close look at George Foreman’s home and professional life.
- The Big 4-0 – premiere date TBA (pilot in development) – real people prepare for life in their 40s.

- Starting April 6, TV Land will program movies each Friday night at 10p targeting Baby Boomers with such titles as The Blues Brothers Movie, Caddyshack, Beetlejuice, Working Girl and more.
Bravo will move ahead with a new game show pilot called Paycheck, based on a new format developed in the U.K. by IDTV. The premise involves contestants guessing the salaries of other players based on pop culture questions, personal observations and information revealed by the players themselves. The ultimate winner who matches the correct salary of six opponents receives up to $25,000. Picture This Television will produce the pilot for Bravo. ABC‘s comedy pilot The Thick of It from BBC Worldwide Prods and Sony Pictures TV, has named John Michael Higgins for the lead role as the Congressman in whose office and with whose office staff the major of the story takes place. ABC News has appointed David Muir as Anchor for the World News Saturday broadcast in addition to Co-Anchor of Primetime. David will also continue in his role as news correspondent based in New York for ABC News broadcasts and other platforms including World News with Charles Gibson, Good Morning America and Nightline. He started with ABC News in August 2003 as anchor of World News Now and World News This Morning and has reported on many major news stories.
Susan Winston has been named Executive Producer of the new syndicated series Jury Duty from Radar Entertainment. The series has been cleared in 70% of the country including NY (WPIX), LA (KCAL) and Chicago (WCIU).
Andrew Stewart has been made VP/GM of KWBA/Tucson, The CW affiliate owned by Cascade Broadcasting. In his new role, Andrew will work to increase growth in sales, programming, business and marketing for the station.

During 8p, FOX won with Are You Smarter Than a 5TH Grader? at 3.6/11 which edged out CBS’ NCAA Basketball Championship coverage at 3.5/11.
