Good morning. It’s Monday, July 31, 2006, and this is your first early morning briefing.

20th Century Fox has completed a 9-title film deal with cable network FX for a reported total license fee in the $90 million range, according to Daily Variety. Titles included in the deal are The Devil Wears Prada, X-Men: The Last Stand, John Tucker Must Die, The Omen and Ice Age: The Meltdown.  Each of the titles first go to HBO in 20th’s pay cable deal, and then on to FX in 2009 for a four year deal.  20th still has a broadcast window to sell for one or all of the titles.

* MORE GOOD STUFF *

On Friday, just days before its deadline, CBS paid the $550,000 fine imposed by the FCC for the 2004 Janet Jackson Super Bowl Reveal incident. The network is paying the fine “under protest” so it can proceed with its appeal to overturn the FCC’s decision that the Super Bowl half-time spectacle was legally indecent. The network made its Petition with the U.S. Court of Appeals for the Third Circuit, the same Philadelphia court that remanded the FCC’s ownership rules. When originally imposed, the $27,500 fine on each of the 20 CBS O&O stations airing the incident, was the maximum accorded to a broadcast station for indecency.  CBS has long maintained that Janet Jackson’s “wardrobe malfunction” was not indecent. In May, Leslie Moonves called the penalty “patently ridiculous,” and in the appeal, the network called it “unconstitutional, contrary to the Communications Act and FCC rules, and generally arbitrary, capricious and contrary to law.” The FCC responded by saying, “CBS’ continued insistence that the halftime show was not indecent demonstrates that it is out of touch with the American people. Millions of parents, as well as Congress, understand what CBS does not: Janet Jackson’s ‘wardrobe malfunction’ was indeed indecent.” Indeed. The broadcast watchdog group Parents Television Council, whose email campaign helped prompt the fine, was running a countdown clock on its web page under the heading: “Time Running Out for CBS to Pay Indecency Fines.”

Just as the show is getting ready for its season finale on Wednesday, MTV has ordered a second season of The Hills.  Season #2 is expected to premiere in 2007, tho an episode count has not been published.

Heroes premieres on NBC on September 25, and on iTunes on September 1st, in its entirety and at no charge. Additionally, NBC and premiere sponsor Nissan will distribute Custom Cards to be distributed at AMC, Regal Entertainment and Cinemark movie theatres, and using the Custom Card PIN number, users can download Heroes off iTunes at no charge. The download will also include behind-the-scenes footage, as well as promos of other NBC fall series.

Schurz Communications will pony up $73 million for Media General’s Wichita station KCWH and its three satellite stations. As always, the purchase is  subject to regulatory approval, and is expected to close before year’s end. Other Media General stations on the block include WDEF/Chattanooga, WIAT/Birmingham AL and KIMT/Mason City, Iowa.  Media General is reported in the midst of negotiations on the sale of the other three stations.

* PRODUCTION / DEVELOPMENT / CASTING *

Just two weeks ago came word Nona Gaye had been cast as the new District Attorney on Law & Order: Criminal Intent.  Today we’re hearing she has left the show, and the cause cited was creative differences. She has already been replaced by Theresa Randle who reports to work tomorrow and will shoot the first three episodes.  Thereafter producers may choose to pick up her option and continue with her in the role.

Actors Julia Gonzalo and Chris Lowell had signed on for guest appearances last season on Veronica Mars, and this season will return as regulars in the same roles of Parker and Piz, respectively.  Veronica Mars season premiere on the CW is scheduled for October 3rd.

Spike TV has ordered up a new reality series called Bullrun from Rocket Science Laboratories and Maloof Television, and has scheduled the show to hit the primetime lineup next spring. This project features amateur race car drivers participating in a variety of open road driving challenges, according to Variety.

VOOM HD Networks has ordered two series from Electric Sky for its two hi-def channels. For Gallery HD, Voom has ordered six episodes of Art of the Heist, a documentary series about the world most notorious art thefts.  And for ULTRA HD, a third season of Fashion Avenue which follows supermodel Jodie Kidd as she shops the fashion world’s hottest boutiques over the course of six 30m episodes.  Both hi-def channels are currently available on the DISH Network. 

* EXECUTIVE MOVES *

AMC has named Vlad Wolynetz to the position of VP/Production, Series and Movies, reporting to Rob Sorcher, EVP/Programming, Packaging and Production. Vlad will head the development and production of new originals for the network.

And a quick housekeeping note — Cynopsis will be on vacation (no editions) during the week of August 7th, but no worries – we’ll be back in full force on August 14th.

* RATINGS *

 
Thursday – A18-49 Analysis: CBS had the winning combination Thursday night with a 2.8/9 A18-49, according to fast affiliate ratings from Nielsen Media Research. FOX took second place with 2.5/8, and then came ABC 2.1/7, NBC 2.0/6, UNIV 1.5/5, WB 0.8/3, UPN 0.6/2 and TELE 0.4/1. CBS led the evening at 8p with Big Brother at 2.5/9. FOX took over the reins at 9p with So You Think You Can Dance? at 3.3/10; CBS was second with its CSI repeat at 3.0/9. At 10p, CBS’ Without a Trace encore beat the rest at 2.9/9; ABC’s Primetime came in second at 2.5/8.
