Good Morning, it’s Monday,  January 8, 2007 and this is your first early morning briefing.
 
The retransmission rights payments disagreement between MediaCom Communications and Sinclair Broadcast Group came to a head late Friday and into Saturday with MediaCom being forced to drop 22 Sinclair stations from its cable system in 12 states as of 12:01a January 6. The total number of MediaCom subscribers who will lose ABC, FOX, The CW, MyNetworkTV affiliates is approx a half million. MediaCom had filed an anti-trust lawsuit against Sinclair with the FCC’s Media Bureau stating Sinclair wasn’t operating in “good faith” negotiations, which the Bureau tossed on Thursday and alternatively encouraged the two companies to engage in binding arbitration. Subsequently, MediaCom had offered Sinclair three different proposals, all of which were rejected.  In a letter to its customers, MediaCom said Sinclair “demanded that MediaCom remove [the local Sinclair] station along with its other stations from our cable systems. We had been working hard to keep this from happening and we regret that they have taken this drastic step.” The letter further urges its customers to not “rush into a long term agreement with another provider while we negotiate.” Sinclair had offered to give MediaCom each cable subscribers a total of $100 those who signed up with DirecTV before February 5. Meanwhile, Mediacom is offering its customers a free set-top antenna and A/B switch to receive the signal over the air.

Elsewhere, Sinclair is in the midst of similar negotiations with Comcast and has said it may pull its 30 stations of that cable system, affecting another 3 million customers. According to Broadcasting & Cable, Sinclair’s carriage deal with Comcast is due expire on February 5 and the broadcaster is demanding payment from Comcast to keep its stations on in 23 markets.  The wrinkle in this scenario is a federal law which blocks a system from pulling an in-market local station from its system during a sweeps period.  So far, Comcast is refusing to pay and Comcast’s EVP David Cohen said in part “We do not believe that our customers should have to pay extra to watch free TV.”

Bravo debuts the second season of The Real Housewives of Orange County on January 16 at 10p. This season the one-hour docu-soap features a new housewife Tammy Knickerbocker and more drama centered on the original housewives and their families. Tied in with the show, BravoTV.com will air nine exclusive webisodes called The Real Kids of Orange County focused on the lives of the children involved. The webisodes will air Tuesday evenings following the broadcast episodes.
 
Lifetime has picked up the cable rights to four feature films from Warner Bros. Domestic Cable Distribution — Rumor Has It, The Lake House, Sisterhood of the Traveling Pants and North Country.  Three of the titles will be shared with other cable outlets — Sisterhood will be shared with ABC Family; Rumor Has It and The Lake House are shared with Oxygen.  North Country will be exclusive to Lifetime. Total combined fees according to Variety is estimated at $16.5 million.

~ BROADBAND AND DIGITAL ~

So let’s say you’re going to be out of town next, say at a business convention for instance, when American Idol has its premiere, and you’re bummin’ because you know there’s no way you’re going to get a chance to see the first couple of episodes filled with undoubtedly the worst auditions imaginable.  Well, bum no more — FremantleMedia will stream the full episodes online at AmericanIdol.com after the broadcast air.  Fox has a revenue share deal with FremantleMedia for the website and is responsible for selling the on-site ad space.  So if you were thinking the episodes would be commercial free … think again.

The Disney-ABC Television Group has now made available episodes of Ugly Betty on the iTunes Store. Fans of the series can download and purchase episodes from the beginning of the season and new ones the day after broadcast for $1.99 each. Expanding on the show, ABC.com is now airing the second telenovelita, Muchas Muchachas on its site. A quick clip is shown each week on Ugly Betty and now viewers will be able to see the first of six chapters of the 2-4 minute short, with new webisodes launching each Thursday.

Verizon Wireless is expected to soon offer full-length ad-supported television programs to its cellular customers using content from such broadcast networks as NBC, CBS, FOX and MTV. The new service, the first to offer full episodes to cellular subscribers in the US, is expected to be up and running by the end of March and will feature programming from eight networks, available on eight channels to which consumers can subscribe.  Among the networks talking with Verizon is ESPN in a proprosal in which its shows would be available via mobile immediately after the broadcast airing. The service is expected to launch in 1st qtr 2007, beginning in the larger markets.  Verizon has teamed with MediaFLO USA, a subsidiary of Qualcomm, which created the technology to transmit high-resolution video through its own dedicated network. The terms of the deal include media companies receiving fees based on customer subscriptions.
 
MediaFLO USA is a busy company as they just signed a multi-year agreement with NBC Universal to officially license its entertainment and news programming on two of its TV-quality mobile dedicated channels. Via MediaFLO’s service, consumers will be able to view such NBC news programs as Today, Nightly News with Brian Williams and Meet the Press in addition to some programming from MSNBC and CNBC, as well as the entertainment shows The Tonight Show with Jay Leno and Late Night with Conan O’Brien on mobile devices through MediaFLO’s partnerships with wireless operators.

Microsoft’s Windows Vista has come to terms with several content suppliers to let people watch their internet programming on their home television sets, including Nickelodeon, Showtime and Starz Entertainment.  Via Windows Vista, Starz’ internet SVOD service Vongo subscribers will be able to download movies onto their PC or laptop using Vongo and then view the titles on any connected TV in the home. Vongo subscribers have unlimited access to more than 1,000 movies and 2,500 total video selections as well as live streaming Starz TV channel, in addition to select PPV titles.

~ PRODUCTION AND DEVELOPMENT ~

AMC will again team with actor Thomas Haden Church and director Walter Hill on two new future development deals. Both worked on the Broken Trail project for AMC and the new projects will also be western-themed. Hill will write, direct and executive produce a one-hour western pilot for the network. Church will write and executive produce a four-hour western miniseries, along with writer David Denny, titled Last Horseman. 

FOX has given the go ahead for three new one-hour pilots:

  • Canterbury’s Law is a drama about a headstrong female defense attorney who will force the law to protect innocent clients. From Sony Pictures Television and Denis Leary’s production company Apostle.
  • Supreme Courtships is a dramedy about six Supreme Court clerks that focuses on their love lives, their professional side and their supervisors. From 20th Century Fox Television and Adelstein Productions.
  • And an untitled nurses project, also a dramedy, about the lives and romantic ties of a team of nurses at a big city hospital. From 20th Century Fox Television.

NBC Universal TV Studio has signed a three year development deal with executive producer Hank Steinberg, to develop new projects for the studio.  Steinberg is currently in the final months of a development deal with Warner Bros. TV where he created Without a Trace, and once that ends in June, he’ll make the move over to NBC Universal. While working with NBCU, Steinberg will continue to exec prod Trace.

~ EXECUTIVE MOVES ~

Viacom has made a couple of key appointments within its management team: Robert M. Bakish has been upped to President, MTV Networks International, reporting to William H. Roedy, Global Chairman, MTV Networks. Robert previously was the EVP/Strategic Planning and Business Development at Viacom and in his new position he will work to improve programming in critical markets such as Great Britain and Germany. Elsewhere, Viacom has made Wade Davis the VP/Strategy Mergers and Acquisitions to supervise mergers, acquisitions, strategic planning and development for the company.

MTV Networks (MTVN) has put in place a new Global Digital Media executive team to drive strategic guidance for the company’s stable of multiplatform brands and to create cross-branding efforts, working closely with digital leaders of the various MTVN’s brands. All persons on the team report to Mika Salmi, President, Global Digital Media for MTVN. From throughout MTVN the Global Digital Media team consists of: Denmark West, EVP/Operations; Nicholas Lehman, EVP/GM, MTVN Games and Interactive Media Group; Kenny Miller, EVP/Creative Director; Nick Rockwell, SVP/CTO, Digital Media Technology; Greg Clayman, SVP/MTVN Mobile Media; and Jason Witt, SVP/Online Distribution and Partnerships.
 
NBC Universal Domestic Television Distribution has appointed Donna Kerin as VP/Advertising and Media Sales, reporting to Barbara “Bo” Argentino, SVP/Advertising and Media Sales. Donna will lead national advertising and media sales for the company’s first-run syndicated programming that includes Access Hollywood, Maury, The Jerry Springer Show and The Chris Matthews Show.
 
David Seeley has joined Crossroads Television and Headlight Design + Visual Effects as Creative Director, where he will add his extensive brand-building experience to the company’s creative services portfolio.
 
Debmar-Mercury has hired Darren Doyle as VP/Sales based in New York to handle the Eastern Region and has added James Kramer as VP/Sales to target the Western Region while headquartered in Los Angeles.

Thursday – A18-49 Analysis:  CBS came out on top Thursday night with 5.2/13 A18-49, according to fast affiliate ratings from Nielsen Media Research. NBC was #2 at 4.1/10, and next came ABC 3.8/10, FOX 1.9/5, UNIV 1.8/4, CW 1.1/3 and TELE 0.4/1. At 8p, NBC won with its comedies My Name Is Earl and The Office averaging a 4.3/11. CBS steam rolled the competition at 9p with its new CSI episode delivering an 8.3/20. Then NBC was first again at 10p with ER at 4.6/12.

Friday – A18-49 Analysis: CBS was the winner Friday night with a 3.1/9 A18-49, according to fast affiliate ratings from Nielsen Media Research. NBC came in second at 2.8/8, and then FOX 2.0/6, ABC 1.7/5, CW 1.5/4, UNIV 1.5/4 and TELE 0.4/1. CBS began the evening in first during 8p with Ghost Whisperer at 3.2/10. At 9p, a clean sweep for CBS was thwarted as the network tied for #1 with NBC with both capturing a 2.9/8 – CBS with Close to Home and NBC with Las Vegas. CBS had the final say at 10p with Numb3rs coming in first at 3.2/9.

: NBC stomped the competition Saturday night with 8.4/23 A18-49, according to fast affiliate ratings from Nielsen Media Research. In a primetime sweep, NBC took the night with its NFL playoffs action between the Dallas Cowboys and the Seattle Seahawks: at 8p NBC won with 8.6/25; at 9p NBC came out best with 8.0/22; and finally at 10p scored the highest ratings of the night with 8.7/24.
