Cynopsis: DIGITAL


Good morning, it’s Friday, September 26, 2008, and this is your first early morning digital briefing.

The US music industry has finally reached a deal regarding mechanical royalties for songs played by online music services for streaming and limited music downloads. The agreement, which now has to be approved by US Copyright Royalty Judges, proposes that interactive webcasters and online subscriptions services pay a straightforward royalty rate of 10.5% of revenue. National Music Publishers Association President David Israelite referred to the deal as an “historic agreement,” ensuring that songwriters and publishers can now “thrive” in the digital age. However the agreement leaves performance royalties that must be paid to music labels in place, (which increase from $.0014 per song, per listener this year to $.0019 per song, per listener in 2010.) These rates are expected to cripple independent radio stations and web 2.0 services like Pandora, which has already warned that it may have to pack it in if the fee structure isn’t amended. 


Following the rollout of its new and improved video player, introduced an array of digital goodies to accompany the network’s premieres this week:

  • Take a voyeuristic virtual tour of Wisteria Lane where you can click on objects to learn more about the characters
  • Watch the new Ugly Betty webisode series Mode After Hours featuring sidelight adventures with Marc and Amanda
  • Participate in a UGC-powered dance contest in which fans can offer input into elements of  select Dancing with the Stars segments
  • Play a vintage 1973 Life on Mars computer game or take part in an interactive poll
  • Test your knowledge of your favorite characters in various quizzes and games

FX‘s Always Sunny in Philadelphia launched a fun new mashup trailer tool to promote the new season, powered by GorillaSpot. Always Sunny is a perfect show for this because its outtakes hold up well on their own. The cast is also pitching in to use web 2.0 tools to keep in touch with fans, answering fan mail with vlog posts and posting to various off-color 18-year-old+ blogs. (Danny DeVito’s “Ask Dirty Frank” advice column is just wrong.)
Multiplatform content initiative NBC Digital Health Network signed a half-a-dozen new distribution partners and completed the launch of its own direct-to-consumer video portal New partners include The American Cancer Society, and Wellsphere.
became the latest film festival to take its films online announcing a partnership with The indie distribution portal, launched by former Warner Bros. executive Vince Di Pierro and partner Joe Cirillo, offers ad supported streaming to visitors as well as low-cost film and music downloads, sharing revenue with the creator.
How exciting is this?  Chuck Bolkcom has been appointed President and Chief Operating Officer of Cynopsis Media LLC, effective October 1!  Yep, that’s us!  In this newly-established position at Cynopsis, Chuck will oversee the company’s strategic development of sales, marketing, product, and operations, reporting to Cynthia Turner, CEO.  Cool, huh!  Chuck makes the move to Cynopsis from Vuze Inc., a broadband video content delivery network, where he was VP/Advertising Sales.  Prior to Vuze, Chuck was at Reed Business Information as Group Publisher of the Reed Television Group, during which he led a major turn-around of both Broadcasting & Cable and Multichannel News magazines.  At PricewaterhouseCoopers, he was a Director in the PwC Entertainment, Media and Communications advisory practice. VC money doesn’t seem to be drying up just yet. Social news site Digg secured $28.7 million in series C funding led by new investor Highland Capital Partners, bringing its total raised to $40 million in 4 years. The company plans to double its staff to 150, move to a larger headquarters and work on expanding to international territories. Digg claims about 30 million unique users a month – double its base from a year ago – and says its advertising revenue has tripled during the same period.
Responding to the big deal struck between the Digital Media Association and various music industry groups, San Diego-based RoyaltyShare says it is moving forward to create a platform to streamline the tracking and payment of digital music royalty payments by digital music publishers to rights owners. The service, which has received funding from William Morris Agency, Trident Capital and Bertelsmann Digital Media Investments, is scheduled to launch during Q4.
Former @Home executive Sean Doherty re-launched, an online video aggregation service allowing users to search and subscribe to serialized online videos or podcasts via video-focused RSS feeds. The site, which requires registration, indexes over 11,000 video feeds from TV networks, record companies, cable networks and thousands of other large and small publishers, making it easy to keep up with your favorite web shows by creating a personalized channel which automatically compiles regular feeds.


EchoStar subsidiary Sling Media released its latest Slingbox, the revolutionary machine that hooks up to any cable or satellite set-top box and place shifts your recordings to any PC, anywhere in the world. The new PRO-HD model, utilizing the company’s Slingbox 2.0 software, ingests HD streams and transmits them to a laptop or desktop computer running Windows XP or Vista with full DVR capability. (Macs will play them as well, but not in HD yet.) The company has also made several improvements to its technology including optimizes the video stream to the speed at which you’re connecting to the internet. The PRO-HD is now available in preorder from various outlets for $300 and is due out in stores next month.


Providing a face to his online Free the Airwaves campaign, Google co-founder Larry Page showed up in Washington this week to urge the FCC to provide tech companies with access to unused broadcast spectrum before the presidential election in November. The so called “white space” debate has technology firms, which want to use the spectrum to power internet services on wireless devices, pitted against broadcasters, which claim such usage interferes with digital TV broadcasts. FCC commissioners are awaiting the results of field tests conducted this summer before they rule on the issue.


Times are tough all over. The Blu-ray format is actually losing market share according to Nielsen VideoScan’s latest numbers, dropping 8 percentage points for the week ending Sept. 14, with old-school DVDs making up the remaining 92%. The trend is more than a little disappointing to electronics manufacturers and the home video industry at large, who expected Blu-ray to take off once HD DVD left the field. The prohibitive cost of Blu-ray players, which still start at $200, and the increasing popularity of digital downloads are thought to be the blame.
Facebook continued to cut into the MySpace’s market share lead in August, but the Fox Interactive Media property continued to enjoy a 67.54% share of visits to social networking sites, according to Hitwise. Visits to Facebook increased by 50% in August year-over-year. MySpace also led in time spent – 30 minutes and 32 sec./user compared to 19:30 for Facebook.

Long accused of neglecting its heritage as a place for bands to network and promote themselves, MySpace has returned to its musical roots in a big way. The MySpace Music portal launched yesterday with a robust catalog of free unlimited ad-supported tracks from Sony BMG, Universal Music, Warner Music and EMI Group. (So far McDonalds, Sony Pictures, State Farm and Toyota are supporting the effort.) The heart of the interface is the playlist generator, which allows you to browse, search for songs, build customized libraries or view the playlists your “friends” have made. Or check out one made by the Jonas Brothers (Bob Marley, Johnny Cash, Elvis Costello-no arguments here.) The free streaming is meant to spur online sales of tracks via integration with Amazon‘s MP3 e-commerce site. Ringtone sales are also available, powered by Jamster. Indie musicians have a place in the portal as well, as their songs, profiles, music video and tour information can all be accessed through the search engine. So far only the U.S.-based MySpace Music is up and running but the company, which is reportedly still seeking an executive to run the music venture, is hard at work to roll it out to international destinations. The design isn’t exactly elegant (it’s MySpace after all,) but all in all MySpace Music is an amazing effort – getting all 4 major labels to provide access to their entire catalogs is a Herculean effort in itself. It will be interesting to see how much of an impact it has on iTunes’ 80% market share of the MP3 business. Our guess is that once folks figure out how easy it is to add Amazon tracks to their iPod the service will slowly but surely take off.
