Arkansas-based news publisher Helena World Chronicle has initiated a class action lawsuit against Google and parent Alphabet, accusing the company of engaging in anticompetitive practices that are “starving the free press.” In the complaint, the publisher alleges Google’s content aggregation methods impact its ad revenue and web traffic, adding that new AI technologies like Google’s Search Generative Experiences make the problem worse. In addition to damages, Helena World Chronicle is asking for an injunction that would require Google to obtain consent from publishers to use their website data to train its general artificial intelligence products.
In more Google news, the company has responded to complaints about its collection and retention of user location data by making changes to Google Maps. Data from the Timeline feature, which keeps a record of routes users have taken, will soon be stored on users’ devices instead of by Google. Not only will Google be blocked from seeing location histories, but so will law enforcement, which has used warrants to obtain search and location data.
Apple agreed to pay $25 million to settle a class action lawsuit, filed in 2019, that alleged Apple misrepresented the ability to use its Family Sharing feature to share subscriptions to apps. “Millions of consumers have downloaded subscription-based Apps believing that they are available for Family Sharing, only to learn after payment has been made that they are not so available,” said the lawsuit. In the settlement agreement, Apple acknowledged no wrongdoing of any kind, but noted, “continuing to defend this Action would be burdensome and expensive.”
“It’s true. Your devices are listening to you,” said a now-removed page of Cox Media Group Local Solutions’ website, which claimed, “With Active Listening, CMG can now use voice data to target your advertising to the EXACT people you are looking for.” Cox Media Group released a statement Friday saying its businesses “do not listen to any conversation or have access to anything beyond a third-party, aggregated, anonymized and fully encrypted data set that can be used for ad placement.”
Twitch reversed its decision to update its Sexual Content Policy to allow depictions of “fictionalized nudity” if properly labeled. “Upon reflection, we have decided that we went too far with this change,” wrote Twitch CEO Dan Clancy in a blog post two days after the update took effect. “Digital depictions of nudity present a unique challenge – AI can be used to create realistic images, and it can be hard to distinguish between digital art and photography.” Clancy also said that after the update some streamers created content that was in violation of the new policy, and the company has “worked quickly to remove that content and issue channel enforcements.”
IAB Tech Lab announced the launch of the Accountability Platform, a technical audit framework designed to help businesses deliver greater transparency in using personal data for addressability. “Compliance without assessment is a promise unfulfilled. The goal of the Accountability Platform is not only for companies to be able to say they are adhering to the privacy choices of consumers but to be able to prove it through a normalized set of compliance data usable for self-assessment, and third-party assessment,” said Anthony Katsur, CEO, IAB Tech Lab. “Without consistent and widely accepted accountability measures in place concerning the disclosure of consumer privacy preferences in digital advertising, there is a risk that organizations may only fulfill their obligations superficially, leaving room for non-compliance or unethical practices.” Companies that pass and receive data to support personalized advertising can leverage the Accountability Platform to audit that their business partners are honoring consumer-provided consent signals throughout the supply chain. This includes brands and publishers, supply-side and buy-side technology companies, identity resolution technology providers, other third-party data providers, processors, and data collaboration solutions.

“The Night Agent” topped Netflix’s list of most-viewed titles in the first half of 2023, with 812 million hours viewed. In the streamer’s new bi-annual “What We Watched” report, season two of “Ginny & Georgia” came in second with 665 million hours viewed, followed by season one of “The Glory” (623 million), season one of “Wednesday” (508 million) and “Queen Charlotte: A Bridgerton Story” (503 million).
From January through October 2023, MediaRadar reports a nearly $1.07 billion in advertising investment on six top OTT platforms: Discovery+, Hulu, Max, Paramount+, Peacock, and Pluto TV. That’s down 8% year-over-year. “Streaming platforms are confronting steep hurdles around ballooning content expenses, password sharing dilution, and an uncertain economic climate. These factors are fueling downstream subscriber and advertising adversities across the industry,” said Todd Krizelman, CEO of MediaRadar. “However, the streaming ad market also shows promise – these players alone account for over $1 billion in spend.”
All past seasons of ABC’s “Grey’s Anatomy” will be available on Hulu when Hulu on Disney+ launches in March 2024. The past 19 seasons of the medical drama will remain on Netflix as part of a deal between Disney Entertainment and Netflix; Hulu will offer exclusive access to new in-season episodes from the upcoming 20th season. In the short-term content deal, 14 other Disney-owned titles will also be available on Netflix on a non-exclusive basis.
Speaking of, the upcoming Hulu/Disney+ app will surpass Netflix in popularity and volume, according to a report from Ampere Analysis. “The combined Disney+ and Hulu catalogue will provide one of the most well-rounded and popular offerings in a single platform, upping the content stakes at a time when many are pulling back on content investment,” said Ampere analyst Joshua Rustage. “Rivals will have to ensure their offerings remain competitive as the battle for viewing time intensifies, especially as the need to pull in advertising dollars is now also central to the streaming mix.”
