Whistleblowers filed a complaint with the SEC accusing OpenAI of systemic violations of regulations prohibiting restrictive non-disclosure agreements. According to a letter to the SEC, “The agreements prohibited and discouraged both employees and investors from communicating with the SEC concerning securities violations, forced employees to waive their rights to whistleblower incentives and compensation, and required employees to notify the company of communication with government regulators.”

Meta is ending the suspension of presidential candidate Donald Trump’s Facebook and Instagram accounts, an action put in place after Trump praised people who attacked the Capitol on January 6, 2021. Now, “The candidates for President of the United States will soon be formally nominated,” said Meta in a blog post. “In assessing our responsibility to allow political expression, we believe that the American people should be able to hear from the nominees for President on the same basis.” That said, “In the event that Mr. Trump posts further violating content, the content will be removed and he will be suspended for between one month and two years, depending on the severity of the violation,” added the post.

Hackers stole six months of call and text message data of nearly all of AT&T’s cellular network customers. In an SEC filing, the company said that between approximately May 1 and October 31, 2022, and on January 2, 2023, hackers “unlawfully accessed and copied AT&T call logs” that were saved on a third-party cloud platform. While the content of the calls and messages was not compromised and customers’ personal information was not accessed, the records did include phone numbers. AT&T said it appears at least one person has been apprehended.

Stagwell’s The Harris Poll has acquired BERA, the predictive brand technology platform. The acquisition will integrate BERA’s AI-powered brand insights and analytics platform into its Harris Quest suite, part of the Stagwell Marketing Cloud. “Integrating BERA’s predictive capabilities into our platform will enable us to deliver even faster, more accurate insights that are critical for effective decision-making in today’s dynamic market environment,” said Will Johnson, co-CEO of Harris Quest. “In addition to our existing real-time analytics, we can now offer customized metrics across virtually any industry and stronger predictive intelligence.”

Samsung unveiled new product generations Galaxy Z Fold6, Galaxy Z Flip6, Galaxy Watch7, Galaxy Buds3 Pro, Galaxy Buds3 at Galaxy Unpacked in Paris last week, as well as two new products: Galaxy Watch Ultra and Galaxy Ring. Also introduced during Samsung’s keynote event was an Olympic Edition of its Galaxy Z Fllip6, a custom-built smartphone that will be provided to all competitors at the 2024 Games that includes built-in services and apps optimized for the athletes with interpreter and translation features.

The “DPAA 2024 Omnichannel Decision-Makers Study,” conducted by Advertiser Perceptions and sponsored by Kochava, found that eight in 10 respondents will recommend digital-out-of-home to be part of their media plans over the next 12 months, with 96% of marketers and agencies planning to increase or maintain spending in the next 12 months. The study also found that:
– 58% of respondents see DOOH as an important part of omnichannel video campaigns.
– 41% consider DOOH to be an extension of TV/video planning.
– 49% of integrated video teams include DOOH alongside TV, mobile and online, up from 36% in 2021.
– 76% of advertisers believe DOOH has become less siloed, and an integrated part of cross-channel strategies (up from 66% in 2021).

GroupM has created a partnership with UK supermarket chain Tesco’s retail media business to focus on innovation and data-led solutions in the retail media space. GroupM will have access to data owned by the grocery giant that will help develop insights and strategic planning capabilities in retail media. Tesco Media and Insight, powered by data science subsidiary Dunnhumby, will have access to GroupM clients to showcase its on-site, off-site and connected store offerings. “This is a major landmark for us in developing a large-scale strategic partnership with one of the world’s leading networks, representing so many exciting brands,” said Tesco Media Client Development Director Nick Ashley. “Through the arrangements, GroupM will benefit in numerous key areas in retail media across data, insights, and strategic planning, which will enable its clients to truly harness the power of retail media – in all its forms – for measurable commercial advantage.”

Ad spend on TikTok is still growing, but at a slower pace ahead of a possible ban in the US. According to MediaRadar, ad spend on the platform grew 19% year-over-year in March, was up 11% in April and slipped to a 6% rise in May.

SOCIAL MEDIA

With new social media regulations in effect in the EU, X’s blue checkmarks are deceptive and violate European laws, according to the preliminary findings of the European Commission. “Since anyone can subscribe to obtain such a ‘verified status’ it negatively affects users’ ability to make free and informed decisions about the authenticity of the accounts and the content they interact with,” said the commission, which also accused X of shortcomings in its ad data base and blocking data access to researchers. X owner Elon Musk fired back with his own accusation. “The European Commission offered X an illegal secret deal: if we quietly censored speech without telling anyone, they would not fine us,” he posted. “The other platforms accepted that deal. X did not.” X can respond to the accusations and comply with regulations, or face a penalty of up to 6% of its annual global revenue.

The Federal Trade Commission barred anonymous online messaging app NGL (“not gonna lie”) from serving users under the age of 18, saying the service had violated child privacy and consumer protection laws and harmed children and teenagers. NGL agreed to a $4.5 million settlement, and was hit with an additional $500,000 penalty from the LA District Attorney for exposing users to cyberbullying.

TikTok is prohibiting advertisers from using personalized targeting and campaign selections to reach US users aged 13-17. Advertisers’ only options for reaching teens are “a few broad targeting options, such as location, language, and device-related information,” said TikTok in a blog post. The ByteDance-owned company also introduced “Disconnect Advertisers,” a feature enabling users to stop future off-platform data shared by specific advertisers from being used to serve them personalized ads.

STREAMING

Sixty-two percent of black households place high importance on the availability of content geared toward them when selecting streaming platforms, according to a new report from Horowitz Research. “FOCUS Black Volume I: Subscriptions 2024” noted that while 67% of Black TV content viewers subscribe to at least one SVOD service like Netflix or Prime Video, 42% have access to at least one Black-targeted offering, such as BET+, Zeus, Black World Cinema, or ALLBLK. Free ad-supported TV services are gaining traction as well — 75% of Black audiences watch content on FAST channels, compared to 67% of total market consumers, a five-fold increase from 2019. Virtual MVPD services like YouTube TV, Sling, and Hulu with Live TV are also gaining popularity among Black households, with 32% of Black content viewers subscribing to at least one vMVPD service.

According to a new study by LG Ad Solutions, CTV and streaming will be must-have environments for political marketers in the upcoming election regardless of party affiliation. The study – “The Big Shift – Political Edition” – showed that among those who had a preference, 57% of Republicans, 63% of Democrats, and 70% of Independents stated they prefer watching streaming TV compared to cable, satellite, and broadcast. That’s good news, given that forecasts by AdImpact project the CTV ad spend to increase by 24% to $1.34 billion compared to the 2022 midterms, outpacing major digital platforms Google and Facebook ($1.2 billion), and doubling projected spending on Network Cable, Satellite, and Radio combined ($671 million). Viewers across political parties are watching less linear TV, according to the study, and FAST environments are gaining adoption, with 69% of Democrats, 72% of Republicans and 66% of Independents preferring it to ad-free subscription TV. About 68% of Democrats, 56% of Independents, and 61% of Republicans are cycling through streaming apps, meaning they have added an app and then canceled or paused an app after watching specific content.
