Local TV broadcast streaming provider FilmON received a restraining order from the New York Southern District Court to temporarily shut down its Seattle-based online ivi TV broadcast service that delivers local broadcast feeds to PCs and mobile devices while the court explores the legality of the streaming site. The company, which claims more than 30 million users since launching, received cease-and-desist notices from all of the major broadcast parents as well as from many local Seattle stations. “We do expect to bring the major networks back to our lineup in the near future, all in a legitimate and collaborative business model,” said FilmOn.com Inc. CEO and Chairman, Alki David in a statement. “We have already begun very positive discussions with TV networks affiliates and other content owners to provide our delivery service and measurement analytics to stream their live content online.”

Sony Music Entertainment has launched a new free online shopping club offering limited-time sales of artists’ new releases. In the tradition of Groupon, PopMarket.com offers Daily Deals such as specially priced box sets from Santana, Simon & Garfunkel and The Clash that expire after 24 hours.
 
Apple says that iTunes shoppers have bought more than 450,000 copies of Beatles albums and another two million individual songs during the Fab Four’s first week of digital sales.
 
Turner International India
announced an exclusive partnership with Zapak Digital Entertainment to market and distribute Cartoon Network’s most popular Multiplayer Online Games (MOGs), including the launch of “Ben 10 Omniverse: Rise of the Heroes” and the debut of a new version of “Toon Football” in the territory.

Babelgum is teaming with IKEA, sponsor of Illeana Douglas’ hit video series “Easy to Assemble,” to create Inside Design, a new three part reality series about four New York City area designers competing to create an innovative living room design. The winning designer receives a $5,000 budget to turn the concept into a real living room in a Union Square loft, receives a one year unlimited membership to Brooklyn-based design center 3rd Ward and gets to keep the living room furnishings.
 
Majestic 7 Media Partners
unveiled a new show dubbed “Anomaly,” a 3D TV 1 hr. doc-drama focusing on utilizing technology to explore the paranormal and unexplained. The show will premiere in early 2011 on Next3DTV, an internet-based 3D video-on-demand service.
 
Personalized retargeting start-up myThings has secured $6 million in its third round of funding led by T-Venture, the venture capital company of Deutsche Telekom, with participation from Accel Partners, Carmel Ventures, Dot Corp and GP Bullhound.

Social media software provider Vitrue struck a partnership with the Scripps TV station group to deploy its Vitrue Publisher Social Relationship Management (SRM) suite across its 10 station sites. The software includes tools to increase station’s presence on Facebook and Twitter to engage with audiences and create local market sponsorship opportunities for advertisers.
 

~ TECHNOLOGY DEALS, MERGERS AND SKIRMISHES ~

 
Video metadata solution provider Digitalsmiths has acquired another metadata specialist – Woburn, MA-based Gotuit Media, for an undisclosed amount to create a firm that now holds 35 patents in the field. The deal combines Digitalsmiths’ ability to scale libraries of content (its VideoSense produce indexes video with smart tags that can be easily tracked and categorized) with Gotuit’s broadcast capabilities to serve the media industry across multiple platforms and content types, according to Digitalsmiths CEO Ben Weinberger.
 
The Center for Digital Democracy, U.S. PIRG, Consumer Watchdog, and the World Privacy Forum have filed a detailed proposal calling on the FTC to investigate unfair and deceptive advertising practices that consumers face when they seek health information and services online. The complaint includes calls for data collection and usage curbs, full disclosure of online behavioral targeting techniques and an analysis of health-related social marketing techniques.
 

~ TRENDS, RESEARCH, ETC.  ~

 
Even before the launch of Amazon’s powerful price comparison app, mobile devices have become a larger part of the Black Friday and Cyber Monday shopping experience, according to a new joint “Mobile Shopping Framework” study from Yahoo and Nielsen. Some 9 out of 10 mobile internet users have accessed the mobile web while at a store and 51% of those users indicate that they make a purchase after doing research on their mobile device. Other insights from the study include:

  • 50% of in-store mobile web activity is related to shopping
  • 48% of in-store mobile users take and/or send a picture of a product to a friend
  • On average, 16% of consumers use their mobile phones for shopping research
  • 57% among mobile internet users and 41% among non-mobile Internet users expressed interest in using mobile phones for shopping research in the next 12 months
  • 86% of mobile Internet users (and 92% of 13-24 year olds) are using their mobile devices simultaneously with TV

 
ComScore is projecting a healthy 11% gain in online retail spending for the November – December period this year, projected to reach $32.4 billion. Online sales (excluding auctions and large corporate purchases) have increased 9% y/y from Jan. – Oct., to reach $109.9 billion. Despite the great recession, last year’s e-commerce sales rose at a 4% clip.

Web-based VOD system provider Clearleap has hired former Time Warner Cable engineering executive John Carlucci as its newly appointed CTO. John most recently served as co-founder and CTO of social TV start-up FreedTV Systems.
 
Online ad network RadiumOne has tapped former Blue Lithium CFO Bill Lonergan to serve as Chief Financial Officer. He joins a trio of former Blue Lithium execs at the company.
 
Meredith Corp.’s Local Media Group promoted Tom Cox to VP/Digital Sales and Steve Schwaid to VP/Digital Content. Tom will continue to run Meredith’s marketing programs as part of the integrated digital sales process and Steve will continue his local news supervision in Atlanta.
 
Shine Group has appointed former News International, HIT Entertainment and Chorion executive Lori Heiss to the newly-created position of Global Brand Manager. She will be based in Shine’s London offices, reporting to Shine Group President Alex Mahon from Jan. 4.
