Good morning.  It’s Wednesday, May 7, 2008, and this is your first early morning briefing. 

Yesterday, the NFL Network filed a discrimination complaint to the FCC against the Comcast Corp. NFL Network alleges Comcast violated federal law pertaining to equal treatment requirements. More specifically, the NFL Network says the Comcast-owned sports networks are more widely distributed on Comcast cable systems than the NFL Network. The NFL Network would like to move off the sports programming tier, which reaches about 1 million subscribers, to the broadest cable tier which reaches approximately 24 million households.

Cablevision Systems Corp. is reporting close to a deal to buy the Sundance Channel in a deal estimated in the $500 million neighborhood.  According to The Wall Street Journal, the full terms of the cash and stock deal are expected to be announced by the parties this morning.  Sundance is owned by NBC Universal, CBS and Robert Redford.

CMT renewed the series Gone Country with John Rich as host for a sophomore season. Gone Country 2 will follow seven new celebrities from various entertainment sectors, giving them each a chance to become a country music star. Production is happening now in Nashville and the new series will debut in August.

Season four of Bravo’s Kathy Griffin: My Life on the D List kicks off on June 12 at 9p and a week later on June 19 moves to its regular time period of 10p. Over nine new episodes, Kathy is involved in different antics from performing a wedding in Queens to opening the Kathy Griffin Leadership Academy in Mexico. Regular cast mates Jessica, Tiffany and Tom as well as her mother, Maggie all return for the new season produced by Picture This Television.

On May 25 from 7-10p, viewers will get a big sneak preview of the new Lifestyle Zone, TV One‘s Saturday morning show. The show, which begins airing on May 31 at 9a, will be all about lifestyle, including celebs, fashion, travel and much more. Returning to the network’s schedule with a new host will be TV One’s 30-minute Makeover Manor, now hosted by Essence Magazine Beauty Director and Cover Editor Mikki Taylor. It debuts on May 25 at 8p with back-to-back episodes. Here’s a glimpse at the network’s special primetime preview lineup on May 25:

  • 7p – Third season debut of church renovation series Divine Restoration
  • 730p – Fourth season premiere of reality series Living It Up with Patti LaBelle

Univision and independent Hispanic agency The Vidal Partnership will present a branded reality soccer competition series called El Juego Supremo (The Ultimate Match). The series will debut this fall on Univision and will follow five topflight soccer players from Mexico and five from the Americas as they recruit and train a team of rookies. Both Sprint and Nissan North America are the exclusive network sponsors.

Sue Johanson will take her final bow this Sunday at 12a as her six season show Talk S&x with Sue Johanson on Oxygen ends. Sue’s advice will still be available on Oxygen.com.

Comedy Central agreed to pay The Weinstein Company $2.7 million for the cable rights to the film Superhero Movie for September 2010, reports Variety. The four year deal also includes pre-buys of two other unreleased titles, Fanboys (Dec 2010) and The Promotion (March 2011). Terms of the agreement allow The Weinstein Company to sell runs of the movies to another cable network during a specific window, in addition to selling the films to PayTV outlets prior to becoming available to Comedy Central.

DirecTV reupped its reality series Supreme Court of Comedy for a second season, per Variety. The series looks at real life small claims cases but with comics portraying attorneys.

David Alan Basche will star with Debra Messing in USA Network’s new series The Starter Wife.

It is likely ABC will pick up the David E. Kelley pilot Life on Mars taking it to series, tho rumors abound whether or not Kelley will chose to be a part. Reportedly, financial considerations are making him think twice. ABC Studios and 20th TV may jointly produce and October Road creators Josh Appelbaum, Andrew Nemec and Scott Rosenberg are also in talks about executive producing. However, the deciding factor of where Life on Mars ends up is Kelley’s decision as he created the U.S. version and owns the rights to it. Life on Mars is based on a British series about a 21st century detective working in the 1970s.

Spike TV has a handful of new one-hour pilot projects in development, according to Variety:

  • River Men – about workers who steer large barges with cargo down the Mississippi River.
  • USA vs. the World – Americans in dangerous occupations go head to head against their foreign counterparts.
  • Tank & Cobra – spotlights two real-life bounty hunters.
  • Human Predators – profiling men who take others lives
  • Total Nonstop Action – about a Nashville-based professional-wrestling organization that emphasizes athleticism in addition to muscle strength.
  • Caught in the Action – a hidden camera show.
  • Surviving Terror – Cade Courtley just signed on as host.
  • Idiot Hall of Fame – a 30m late-night show that showcases video footage of men doing stupid things.

CYNOPSIS DIGITAL – TODAY’S TOP STORY
:   Lawmakers and entertainment industry parties remain divided on the issue of net neutrality, based on widely differing testimony given in a House Subcommittee meeting on Tuesday. Hannah Montana producer Steve Peterman endorsed the Internet Freedom Preservation Act sponsored by Rep. Ed Markey on behalf of the WGA West, describing the internet as the “new television.” RIAA CEO Mitch Bainwol came out against it, arguing the marketplace should be given the freedom to regulate itself to protect against piracy. An equal number of Markey’s committee members seemed to line up on each side, indicated a long, drawn out battle over the issue. Meanwhile NCTA President Kyle McSlarrow defended Comcast’s actions to manage P2P traffic, noting the MSO was working toward developing techniques to regulate traffic without singling out individual applications. CYNOPSIS KIDS – TODAY’S TOP STORY: Recording artists and actors Jonas Brothers will star in a Disney Digital 3D feature film in 2009.  The movie will feature footage of the three siblings from their upcoming Burning Up concert tour.  The Jonas Brothers, who are Hollywood Records artists, were featured in this year’s 3D movie Hannah Montana/Miley Cyrus: Best of Both Worlds Concert Tour, as well as several Disney Channel shows and specials, including the upcoming original movie, Camp Rock (June 20), and the new series J.O.N.A.S (fall 2008). Monday – A18-49 Analysis:  CBS and FOX shared the limelight Monday night at 3.9/10 A18-49, according to final national ratings from Nielsen Media Research. ABC waltzed into the top spot during 8p as Dancing with the Stars posted a 4.1/12. Next at 9p, FOX was the winner with House as the new episode delivered a 5.1/13. Then at 10p, it was CBS’ turn to be #1 as CSI: Miami did a 4.0/11.
