In the ongoing patent wars in the tech industry, Apple has scored an interesting win: Google and Motorola Mobility have been ordered by a U.S. Circuit Court judge to hand over information regarding the development of the Android operating system to Apple, as part of the latter’s patent lawsuit against Motorola Mobility, according to Bloomberg. In addition, the judge also ordered Google to give Apple more information about the search giant’s $12.5 billion acquisition of Motorola Mobility. The patent battle waged between Apple and Motorola covers six Apple patents, which the company believes Motorola has violated, along with three Motorola patents that it believes Apple has violated. The same judge is presiding over both cases, which will be argued in two back-to-back trials starting on June 11. Google’s introduction into the matter is of note, Motorola recently argued that Google should not be a party to the lawsuit as it has no “possession, custody or control” over Google.

~ MULTIPLATFORM CONTENT NEWS ~

Google Play is a new cloud-based service launched by Google that reorganizes many of its digital offerings under one umbrella. Defining it as a “digital entertainment destination,” the company says Google Play will allow users to search, enjoy and share music, books, videos and apps on the web, as well as on their Android devices. It’s essentially a cosmetic change: the Android Market, Google Music, Google Videos and the Google eBookstore will become a part of Google Play; Google will update the Android Market app to the Google Play Store app in the coming days, while the other offerings will be rebranded as Google Play Music, Google Play Movies and Google Play Books apps. Coinciding with the launch, Google is running a seven-day promotion, offering a different Android app, album, video rental and book at a special price every day.

L.A. based media company and talent management firm Big Frame, in collaboration with an array of YouTube stars, has launched BAMMO on YouTube, a new original programming channel designed for entertainment and special effects enthusiasts. The original slate of programming includes Lockout, a game show in which famous YouTube personalities discuss the “viral value” of YouTube videos; Sync, a sci-fi thriller web series that will be complemented by a behind-the-scenes/making-of program that will run parallel to it; Sandbox, an interactive weekly series that challenges viewers to create their own engaging content; TurboTime, featuring music videos, special guests and anything else from host Mike Diva; and Upgraded, a series focused on covering trends in hip-hop music, lifestyle, fashion and technology.

In advance of Community‘s return to NBC’s Thursday night comedy block next week, NBC and Hulu have teamed up to release three animated shorts featuring characters from the critically acclaimed series. The shorts will be available on Hulu, Hulu Plus and NBC.com. The announcement was made at PaleyFest.

~ INNOVATORS & START-UPS ~

SessionM, a mobile advertising company led by former Apple exec Lars Albright, has come out of stealth mode to launch a new mobile ad platform that tackles the issue of audience engagement by using game mechanics. In essence, within apps that have integrated the SessionM platform, consumers will be able to earn points and level up by achieving in-app “engagement milestones,” such as visiting regularly, exploring content, performing specific activities and being social. Consumers who interact with video or rich media ads will also be able to earn points. These points can be redeemed in a mobile storefront for real-life rewards, such as eGift cards, exclusive deals and discounts on mobile purchases. Points can also be used to participate in special sweepstakes or be donated to charities. SessionM has already signed up numerous app publishers, including The Weather Channel, Demand Media and Fox Sports, as well as advertisers such as Honda and Volvo. Albright, the former co-founder of Quattro Wireless, helped launch Apple’s iAd unit during his time with the company.

Global media company Remark Media has closed $4.25 million in equity financing, led by A.W.M. Special Situations Funds, along with a number of other accredited vendors. “The completion of this financing allows Remark Media to continue scaling the company’s innovative social media-focused web publishing platform into additional verticals,” said Carrie Ferman, CEO. The announcement of financing follows last month’s rebranding of the company from HSW International to Remark Media, as well as the appointment of a new executive team.

~ DIGITAL ADVERTISING ~

The Zumobi Brand Integration (ZBi) platform, launched this week by mobile media company Zumobi, seeks to “provide more compelling brand experiences and drive meaningful interactions with consumers on mobile and tablet devices.” The platform aims to integrate advertising within the overall content offered in apps on connected devices, thereby making it a more interactive, holistic experience, says the company. Features include: OneTouch Social for quick sharing; Footprint, which allows users to “pin” an ad experience they like to their home screen; Photo user-generated content capabilities, enabling brands to build ad campaigns that include integration with a user’s camera or photo library; Special Branded Content Sections that allow brands to deliver unique content through an app; and measurable results and cross-platform support. ZBi currently supports both iOS and Android devices. Zumobi has already partnered up with notable media brands, including msnbc.com, TODAY and Sporting News, to publish mobile apps, as well as major advertisers, including Best Buy, Disney and Pepsi, who have run campaigns through Zumobi.

Through a new partnership announced between the two companies, Hearst Digital Media will use Sprout’s mobile ad platform to develop HTML5-based rich media mobile ad units for brand advertisers running campaigns on Hearst’s portfolio of digital properties, including Marie Claire, Good Housekeeping, Cosmopolitan and Seventeen. Sprout offers a self-service platform that allows clients to create, manage and optimize display ads on connected devices, including smartphones and tablets, but also gaming platforms and TVs. Sprout is a wholly-owned subsidiary of InMobi.

~ TRENDS, RESEARCH, ETC. ~

In a new report published by Forrester, the firm projects that 112.5 million U.S. adults will own a tablet in 2016, which will come out to 34.3% of all U.S. adults. Forrester sees similar numbers for Europe, forecasting the EU-7 to have 105.7 million tablet users, or 30.4% of consumers aged 16 or older, by 2016. In addition, with an assumed product replacement rate of two years, Forrester predicts consumer will buy a cumulative total of 292.5 million tablets from 2010 to 2016. It is representative of what Forrester sees as a global interest in tablets, with it finding that only 43% of the 55 million iPads Apple sold through the end of its last fiscal quarter were purchased by U.S. consumers. Forrester has also found that tablets are becoming important for workers, with 37% of U.S. tablet owners indicating they take their tablet to work and, through a separate survey, workers in Brazil, Russia, India, China and Mexico are actually leading demand for tablets in the workplace, and are willing to share some of the cost with their employers.

The newly released February MobileSTAT report from Jumptap finds that Android and iOS make up 91% of the mobile operating system market, with Android reaching 58.8% of the market share and iOS reaching 32.2%. BlackBerry, which came in at a very distant third, also saw its market share fall to 6.7%. The report also provides some insight on the growing tablet market. Specifically, citing the recent launch of the Kindle Fire, overall tablet traffic on Jumptap has increased over 50% since December. In the same time period, Jumptap has seen the Fire’s share of tablet traffic go from 4% to 33%. The report gathers data from Jumptap’s mobile ad network that reaches more than 95 million monthly users.

Content discovery platform Outbrain recently surveyed senior-level brand marketers and agency executives about the role of content marketing in connecting brands to their target audiences. The survey found that 100% of brand and agency marketers included content marketing in their overall marketing strategies, with video, at 87% of respondents, winning out as the most common form of content. Social media is the most popular channel for driving consumers to content, with 96% of respondents indicating they have used social media in that capacity, up from 88% in last year’s report. In fact, social media engagement is considered the best indicator of successful content marketing efforts (89% of respondents), followed by views or content downloads (76%). In addition, 80% of respondents indicated that they expect to increase content marketing efforts in 2012.

~ EXEC MOVES ~

Mike Galeski has joined Amplify Social as Director to run the Virtual Fan Network (VFN) Golf division. The San Francisco-based digital technology company’s VFN launched the Golf division this week in order to extend its proprietary platform, which enables professional athletes to boost and monetize their digital presence, to the world of golf. Launch partners include golfers such as Fuzzy Zoeller, Nick Price, Blair O’Neal and Alison Walshe. The VFN, the first product from Amplify Social, already boasts access to over 300 athletes and a monthly reach of over 20 million unique users.

Think Realtime has named Chris Smith, former president of VIBE Lifestyle Network, to the newly created position of Senior Vice President, Sales and Marketing. Think Realtime provides advertisers with a scalable, fully automated solution that optimizes the purchase of RTB-enabled banner inventory. Based out of the company’s headquarters in New Jersey, Smith will focus on driving revenue and building a national sales team. Think Realtime president Ezra K. Doty said that Smith is the first of a number of key senior staff hires and “will immediately establish and build a West Coast office that will include account managers and additional sales staff.”

ComiXology, a digital comics platform, has appointed Marc Goldberg to its management team in the role of Chief Technology Officer. He comes from EPIX, where he also held the title of CTO. Coinciding with the announcement of Goldberg’s appointment, John Roberts, co-founder and now former CTO, will slide on over to ComiXology’s Publisher and Creator Services area.
