Good Morning.  It’s Wednesday, February 27, 2008, and this is your first early morning briefing.

Liberty Media crossed two major hurdles in its takeover of DirecTV, the satellite provider with 16.8 million subscribers, as the FCC on Monday approved the move and the Justice Department said yesterday it will not block the transaction. Both approvals were needed for the $11 billion deal to close. Terms of the agreement state Liberty Media will receive News Corp.’s 38.4% interest in DirecTV in exchange for Liberty’s equity interest in News Corp. Liberty also picks up $550 million in cash and one regional sports network each in Denver, Pittsburgh and Seattle.

~ MORE GOOD STUFF ~

Yesterday members of the WGA West and WGA East voted to ratify the new three-year contract by 93.6% of the 4,060 votes cast. This ratification process follows the February 13 strike order lift by the WGA which ended the 14-week writers strike. The contract dates from February 13, 2008 through May 1, 2011 and includes terms giving writers rights and protections for content distributed on and created for online purposes and other new media platforms.

New York’s Supreme Court, Appellate Division, First Department yesterday reversed a judgment made in May 2007 which allowed Comcast to position the NFL Network on a sports tier. Last year, Comcast won the right in court to move the NFL Network to a more expensive sports tier if it did not acquire rights to the out-of-market NFL Sunday Ticket pay-per-view package or an eight-game primetime package for Versus. Both primetime packages were given to the NFL Network by the NFL in January 2006. A statement released by an NFL spokesperson said “We are pleased that the lower court decision was reversed. We believe that today’s decision ultimately will lead to the restoration of NFL Network service to the millions of fans who received it before the Network was moved to an expensive sports tier.” Comcast’s current contract with the NFL Network expires April 2009.

ABC’s new 30m comedy series Miss Guided starring Judy Greer and executive produced by Ashton Kutcher and Todd Holland will premiere March 18 at 1030p following a 90-minute installment of Dancing with the Stars. The sitcom about a high school teacher who returns to teach at her alma mater will move to its regular time slot March 20 with two episodes at 8p and 830p. The series is produced by 20th Century Fox Television and ABC Studios.

Beginning this fall, MyNetworkTV will be the new broadcast television home of WWE SmackDown from WWE. The two-hour WWE SmackDown will air on MNT weekly with a cast of WWE Superstars including Edge, Rey Mysterio and Undertaker.

Daily Cafe, the live, two-hour weekday program originating from Washington, D.C., will debut on Retirement Living TV March 3 at noon. New to the show is co-host Fred Grandy, the four-term member of the U.S. House of Representatives from IA and actor known best as Gofer on The Love Boat. He will join co-host Felicia Taylor.

Gospel Music Channel (GMC) will be offered to DirecTV customers nationally starting March 19.

  • The Ben and Dave Show – series premieres March 14; topical talk show dishing on a variety of subjects
  • Cover Guy – network debut on March 21; reality competition show where guys battle for cash prizes, modeling contracts and a chance to appear on the cover of gay men’s magazines
  • S*xplorations – season premiere on March 28; series profiles the world’s most unique and exotic sexual beings
  • Paradise Falls – season debut on April 11; adult soap returns for a third season about ten main characters living in a small coastal town

The Style Network picked up the cable rights to the hidden camera comedy series The Real Wedding Crashers which originally aired on NBC last year. The series begins on Style March 4 at 9p.

Campus drama Greek will return to ABC Family with new episodes starting March 24 at 8p.

Bravo pumps up for a third season of the docu-series Work Out starting April 15 at 11p. The new season follows fitness guru Jackie Warner as she hires four new trainers for her Beverly Hills gym and has a new relationship at home. Later, Work Out moves to its regular time period of 10p Tuesdays on April 22.

ABC ordered eight episodes of a new and as yet untitled reality series, a joined effort from Tyra Banks and Ashton Kutcher for Warner Horizon, Bankable Prods and Katalyst.

CBS ordered The Mentalist, a scripted drama about a mentalist who uses his capabilities to help solve crimes.  The project comes from Warner Bros. TV and writer Bruno Heller.

Variety reports NBC‘s drama series Las Vegas from Universal Media Studios will not go back into post-strike production,

Lifetime’s new dance competition series Your Mama Don’t Dance opens this Friday at 9p and three judges have been selected: actor/dancer Ben Vereen; choreographer/actor Cris Judd; and singer/actress Vitamin C. The series, hosted by Ian Ziering, has young professional dancers pair with a parent to battle for $100,000 in cash and prizes.

ESPN will add former All Pro Wide Receiver Cris Carter as a studio analyst on NFL Live, SportsCenter, ESPNEWS and as a contributor to ESPN Radio in addition to appearances on ESPN’s 2008 NFL Draft coverage. Cris begins his new role April 1.

CYNOPSIS DIGITAL – TODAY’S TOP STORY:     Over 93% of the Writer’s Guild officially voted to ratify the new labor agreement struck 100 days after the strike began, the first to give WGA members a taste of digital revenues. The next battle for the WGA, SAG and the Teamsters Union is over cable and syndication licensing fees. California State Senator Shelia Kuehl (D-Los Angeles) introduced a bill in Sacramento this week, which sets out to end the practice of “underselling” TV series or movies (when networks give sweetheart deals to their affiliated companies.)  Full edition: CYN DIGITAL. CYNOPSIS KIDS – TODAY’S TOP STORYFollowing the launch of its tween/teen focused advertising network about a week ago, GoFish has signed WeeWorld, an avatar-based social network, to its roster of publishers.  WeeWorld boasts that some 21+ million “WeeMee” avatars have been created on its site worldwide.  Meanwhile GoFish says the addition of WeeWorld will increase the domestic reach of its new ad network to 18.2 million unique users.  Full edition: CYN KIDS.

CYNOPSIS INTERNATIONAL – TODAY’S TOP STORYItaly’s Mediaset network inked a major 3-year output and co-production agreement with BBC Worldwide.  As part of the deal, the Italian network will have options for factual programming and docu-dramas as well as a BBC commitment for two full documentary co-productions with the U.K. company or its indie production partners with first option dibs, per C21.  Although there is a minimum guarantee threshold set at 2.4 million pounds for the 3 years, the annual minimums within that term have not been agreed upon. Monday – A18-49 Analysis:  ABC secured a win Monday night at 3.6/9 A18-49, according to final national ratings from Nielsen Media Research. NBC opened the night at 8p winning with Deal or No Deal at 4.3/11. After that, ABC’s movie special A Raisin in the Sun dominated the night, edging CBS out of its usual place: at 9p ABC posted a 3.9/10 and a 3.6/10 during 10p.

~ EXECUTIVE MOVES ~

Todd Ackley joins ION Media Networks, Inc. as VP/National Long Form Sales starting immediately and reporting to Stephen Appel, President/Sales and Marketing. Todd will supervise and manage two of the company’s four national sales teams, while Bernie Cayetano, NSM, who oversees the other two sales teams, will report to Todd.

Dimension Films, part of The Weinstein Company (TWC), named Francois Martin as SVP/Marketing. Francois will spearhead marketing campaigns for Dimension Films that encompass strategic marketing, media planning and promotions as well as online marketing. His duties will continue to include his working closely with Gary Faber, EVP/Marketing for TWC, on media planning and promotions for all TWC titles in addition to media buying for home video distributor Genius Products. Francois will report directly to Bob Weinstein.

Lauren Frasca moved up to VP/Development with independent production company Atlas Media Corp. Lauren, who will continue to be located at the company’s New York headquarters, will report to Kaki Kirby, EVP/Business Development and Special Projects.

Oakland-based children’s product and multi-media company, Haydenburri Lane recruited Jeanne Smith for the new position of VP/Creative where she will use her experience as innovator, creator, developer, director and musician.

GroupM appointed John Montgomery to the new post of COO at GroupM Interaction North America. In his new role, John will oversee strategic and operations activities at each of the North American digital unit’s interactive networks including MAXUS, MediaCom, Mediaedge:cia and Mindshare to create and execute practices company wide. He will jointly report to Marc Goldstein, North American CEO, GroupM and Rob Norman, CEO, GroupM Interaction.

Comcast Network Advertising Sales upgraded Chico White to VP/Traffic for Comcast Entertainment Group which consists of E! Entertainment Television, The Style Network and G4. Chico will supervise all commercial activities for the Comcast Entertainment Group and will form a consolidated Traffic team for E!, Style and G4. Additionally, he will manage the operations issues and will institute new systems to optimize commercial breaks. Chico will continue to report to Sue Dutton, SVP/Sales Administration.

qubo, the TV and online entertainment service for children, added John Ko as Affiliate Marketing Director to increase brand awareness for the network among affiliates and consumers. John will report to Joanna Lisanti, VP/Marketing, qubo. 

MTV Networks Music & Logo Group tapped Christina Glorioso to the new role of VP/Sales and Marketing Partnerships for Program Enterprises. Christina will be charged with maximizing opportunities for various projects developed with the Program Enterprises Group such as virtual worlds, video games, direct-to-video and music consumer products. She will also work with the MTV Networks Advertising Sales and Integrated Marketing teams to create new sponsorships and value-added packages for advertisers. Based in New York, Christina will report to Jeff Yapp, EVP, MTV Networks Music & Logo Group Program Enterprises.
