Good Morning.  It’s Tuesday, September 11, 2007 and this is your first early morning briefing. 

Today’s the day.  The 3rd U.S. Circuit Court of Appeals in Philadelphia will hear the case of television’s most famous Wardrobe Malfunction, and whether or not that incident – accident or planned – should result in a fine of more than half a million on the CBS Network and a $27,500 fine on each of the network’s owned local affiliates.  CBS initially appealed the fines, calling them illogical because the incident was an accident, not a staged stunt.  The FCC contends the network “knew or surely should have known” what was going to happen during their halftime show.

ION Media Networks acquired the rights to air NFL Game of the Week, the long-running, one-hour highlights show of the best game of the week for the 2007 season. A production of NFL Films, the 17-week series will debut on ION Television’s network September 15 at 6p with the Giants-Cowboys game from Kickoff Weekend. Additionally, ION also secured the rights to air a new series from NFL Films called Stories of the NFL which showcases the lives of NFL players off the field. Twenty-one half-hour episodes will begin airing on ION Television next February.

TNA Entertainment and Spike TV extended their current agreement by two more years, keeping Spike TV as the exclusive cable TV home of TNA Wrestling’s weekly series iMPACT!. Starting October 4 at 9p, the series will expand from one to two hours each week.

WE tv created a third programming niche called WE Go Supernatural featuring original and acquired series and specials in the paranormal genre. The series consist of:

  • John Edward Cross Country with 12 new episodes in season two, produced by JECO Productions
  • Rescue Mediums with 37 half-hour episodes about two female ghosthunters, produced by Rescue Mediums Inc. Productions
  • Extreme Ghost Stories with four one-hour episodes depicting reenactments of ghostly happenings, produced by ITV Productions
  • Alien Abductions: True Confessions with six 30m episodes premiering next January focused on stories of women who claim to have been taken aboard alien spacecraft and produced by Indigo Films.

CableU, the online service that provides competitive analysis of cable network performance and trends, has added overviews of 90 cable networks to the site, taking the current total to 120 cable networks. Under the Network Profiles section, which is restricted to subscribers only, the added networks include HBO, ESPN, CNN, The Gospel Music Channel, The Africa Channel among others. CableU is a partnership between CABLEready and Cynopsis.

The Nielsen Company began a new web-based commercial tracking service called KeepingTrac which will allow clients to know if their commercial aired the previous day as planned and give clients the opportunity to modify schedules in real-time. The service also gives clients GRP delivery against the media buy schedule for National Broadcast Networks, National Cable Network and Local Broadcast stations in all 210 DMAs in the U.S. with next-day reporting and a view of the advertising campaign’s performance while still in progress. Furthermore, KeepingTrac also monitors the media buy to see if the correct creative is airing during certain programs and dayparts. Carat is the first client to sign on for this new feature.

Atlanta-based Career Sports & Entertainment, a full-service marketing and representation agency acquired JM Associates, the outdoor television content provider for outlets such as ESPN.

Oscar-winning actress and former wife of President Ronald Reagan, Jane Wyman died yesterday at her Palm Springs, CA home. Several biographers differ on her birth date and childhood details, yet she was at least 90 years old at the time of her death. Wyman signed her first contract with Warner Bros. in 1936 for $65 per week. She met fellow actor Ronald Reagan while on a vaudeville tour in 1939 and he became her third husband in January 1940. She was nominated as best actress in 1946 for her role as Ma Baxter in The Yearling opposite Gregory Peck, and then won the Academy Award for her 1948 portrayal of a deaf mute in Johnny Belinda. In 1955 Wyman moved from film to television as host of Fireside Theatre, an anthology series on NBC, renamed to acknowledge its new host – The Jane Wyman Theatre. Renewing her stardom and fulltime television work in 1981, Jane starred as Angela Channing, the scheming vineyard owner on CBS’ primetime drama Falcon Crest which aired until 1990. Jane is survived by her son Michael, a radio talk show host.

~  PRODUCTION & DEVELOPMENT ~

Bravo approved a new dance reality competition series Step It Up, created by Gunnar Wetterberg and produced by Magical Elves. The series will test dancers as they learn a broad range of dance styles. As the competition heats up, contestants will be eliminated until one is left to get the final call back with a chance to perform and winning a cash prize. TBS has ordered up another season of My Boys and is expected to pick up 8 new episodes.  The series is from Sony Pictures TV.

Universal Media Studios, Reveille and Catapult have been given the go-ahead from NBC to develop a script based on the French-Canadian comedy series Serial Frank. The series, licensed to NBC Universal by Distraction, is a single-camera program about a young man who tries to lead a normal life despite having constant physical interruptions from the multiple personas that he acts out which are unseen to others. Mark O’Keefe will write the script and executive produce along with Catapult’s Marc Abrams and Michael Benson.

A couple of other projects coming to NBC, per Variety:

  • From Wolf Films and Universal Media Studios, an untitled drama is about two brothers working in a lawfirm specializing in medical malpractice, and one of the two is a doctor.
  • And a game show called The Interrogator, based on a Dutch format and from executive producer J. D. Roth, where five players answer questions in an attempt to win cash. There is also the Interrogator, who attempts to distinguish which contestants are lying and which are telling the truth.

A&E has a new cast-contingent project order for a drama called Under, about a young mobster who turns state’s evidence and joins the witness protection program.  In his new job, name and location, he is a uniformed cop in the NYPD.  The project is from Fox Television Studios and Gary Randall and Nancy Miller, per Hollywood Reporter.

Warner Bros. Television Group’s digital production unit, Studio 2.0 has started production on 23 new short-form series projects for broadband and wireless, providing an outlet for established talent on these platforms. The new projects are from a variety of sources such Jim Henson Productions, Telepictures Productions, Warner Bros. Animation, as well as film and television director/producer McG, comedians Joey & David, videogame/film/TV producer Jason Hall and more. Studio 2.0 programming will be distributed across numerous broadband and wireless platforms and sites and possibly in partnership with advertisers.

Casting Call: For the first time, Food Network is hosting open casting calls for the fourth installment of The Next Food Network Star. Through the search, both professional and amateur chefs are encouraged to apply. The first open casting call will be tomorrow in Seattle, followed by New York City September 17; Los Angeles also on September 17; Las Vegas September 25; and Minneapolis October 9. Those attending the open casting calls should bring a completed application, photograph and resume/bio. Rules and details can be found at www.FoodNetwork.com . ~ EXECUTIVE MOVES ~

Sundance Channel employed Jean Claude Cancedda as Creative Director/Print and Broadcast Design to supervise all on and off-air creative design and execution pertaining to the network and brand. He will report to Sarah Barnett, SVP/Branding, On-Air and Creative Services.

Former CBS Director/Entertainment Communications Johanna Fuentes joined Bravo as VP/Bravo Communications. Johanna will lead the network’s strategic communications for docu-drama and competition reality shows. She will also work on media outreach for Bravo’s broadband and wireless efforts.

Acorn Media Group appointed Thomas Sidar as President/Acorn Direct, effective earlier this month. He succeeds Miguel Penella in this position who was upped to CEO this spring.

Jill Martin debuts as Host/Reporter for MSG’s nightly sports and entertainment show MSG, NY tonight. The program contains highlights, interviews and analysis on sports and entertainment events in the New York area.

Chicago-based direct response advertising agency Tower Media hired Dorothy McKillip as Media Supervisor.

Angie Kucharski advanced to VP/Media Strategies with CBS Television Stations. Angie will offer strategic counsel and support to the group’s local management teams and will work in tandem with the stations’ news directors. She will also be a liaison between the station group and the network news division and will work with the Digital Media Group to build and execute digital efforts. Based in New York, Angie will report to Tom Kane, President/CEO, CBS Television Stations.

The Nielsen Company recruited Bruce Dennler as President/Nielsen Entertainment where he will manage all facets of the unit’s operations including measurement of the film, home entertainment, music, interactive, book and live event categories. Based in Los Angeles, Bruce will report to Dave Thomas, President/Media Client Services.

Bi-coastal management consulting and executive search firm for the media and entertainment industries, Sucherman Consulting Group Inc. tapped Ramon Escobar for its senior management team. He will concentrate on developing new clients in the news and entertainment sectors in addition to U.S. Hispanic and Latin American media markets. Most recently, Ramon was SEVP/Entertainment at NBC Universal’s Telemundo. 

Outdoor Channel added Randy Brown as SVP/Affiliate Sales and Marketing. Previously, Randy was SVP/Distribution at The Tennis Channel and co-founded the Association of Independent Programming Networks.
