Good morning, it’s Tuesday, May 18, 2010, and this is your first early morning digital briefing.

The Supreme Court declined to hear Cablevision‘s appeal that sought to label the 18-year old Federal must carry law as unconstitutional. The appeal traces back to a 2009 decision in the 2nd Circuit court that supported the FCC’s mandate requiring Cablevision to carry broadcast station WRNN. Cablevision’s position has been that new platforms have created enough options for viewers to the point where must carry regulations are no longer necessary. NAB EVP Dennis Wharton released a statement claiming the decision validates the NAB’s commitment to preserve diverse, niche programming.
 

~ MULTIPLATFORM CONTENT NEWS ~

 
A year and half after launching then pulling back on the first network-operated online branded entertainment unit, NBC plans to finally ramp up productions of the NBC Universal Digital Studio over the next year, reports Adweek. New projects in the works include “Dial Star, sponsored by AT&T, ” and second seasons of the workplace sitcom “CTRL Z” and “In Gayle We Trust,” produced for American Family Insurance. The studio initially launched in partnership with 60Frames Entertainment, the now defunct online production house funded by UTA.
 
Ultimate Fighting Championship has signed a multiyear agreement to stream its fights live to Roku set-top box users, beginning May 29 with a bout between two former UFC champs. A dedicated UFC channel will include the UFC Vault, featuring archived fights, live pre-fight interviews, etc. Each fight will be priced $44.99, the same as on cable PPV.
 
Bravo‘s digital team is launching a pay-to-attend online culinary academy on Wednesday for Top Chef wannabes. Created by Jeff Goldenberg, founder of Post Oak Productions, and Anthony Hoy Fong, culinary director for Food Network’s Tyler Florence, Top Chef University aggregates over 200 video lessons assembled into 12 courses from “Basics and Techniques” to “Entertaining & Advanced” methods. Instructors include some of Top Chef’s fan favorites and finalists. Subscribers pay $24.95 to view one course per month or can gain access to the entire site for an annual $199.95 fee.

Bellevue, WA–based hyperlocal web technology company Datasphere is powering a series of community websites for local station group Local TV in 11 states including KDVR in Denver, KSTU in Salt Lake City and WDAF in Kansas City. Datasphere’s publishing solution offers next generation services contoured for individual markets and neighborhoods including search, coupons, business directory, video gallery and ad targeting.
 
Babelgum collaborated with book publishers Penguin Group and Bloomsbury Publishing to launch their first web series inspired by the bestselling novels by Laurie Viera Rigler: Confessions of a Jane Austen Addict and Rude Awakenings of a Jane Austen Addict. Infamous P2P file sharing site Pirate Bay has shut down for the time being after an injunction granted by a German court on behalf of a group of Hollywood studios threatened to levy stiff fines on broadband provider CB3ROB for routing traffic to the site, per Torrent Freak.
 
Revision3 has thrown its support behind Apple, adding support of the nascent HTML 5 video format preferred by the iPad.
 
Local online coupon site Groupon has acquired German couponing site Citydeal, making it the largest online couponing venture now serving 18 countries in 140 cities. Groupon sends daily emails to users with localized discount offers that become available after a critical mass of subscribers buy the voucher.
 
YouTube‘s Democracy Video Challenge has narrowed the field to 18 global finalists. More than 1,600 people from 111 countries submitted entries.
 

~ DIGITAL ADVERTISING ~

 
The Cinema Advertising Council unveiled the winners of the 2009 CAC Creative Excellence Awards recognizing top local, regional and national in-cinema ads.
 
Sears
is launching a culinary talent search as a UGC charity contest, donation program and branded entertainment play. The Sears Chef Challenge will recruit 24 Chefs from some of the nation’s top culinary schools to compete in regional cook-offs hosted in New York, Chicago, LA and D.C. The contest, which also welcomes amateur chefs, is planning to stream its semifinals and final rounds via UstreamTV. Chef Billy Parisi, founder of FixMyRecipe.com, will oversee the contest.
 

~ TECHNOLOGY DEALS, MERGERS AND SKIRMISHES ~

 
Digital media services company Avail-TVN has been selected by Univision as the network’s VOD services partner for the upcoming FIFA World Cup in South Africa. Avail-TVN will provide an array of Live-to-VOD services including broadcast signal acquisition and file capture, Nielsen C3 watermark verification, encoding across multiple codecs, asset management, and distribution of both SD and HD versions of all 64 matches.
 
Content market organizers DISCOP has launched its own free online video library open to content buyers representing TV stations and other platforms across Central, Eastern Europe, Central Asia, the Middle East and Africa. The “DISCOP Tube” portal, set to launch at DISCOP East, is powered by Mediapeers.
 

~ TRENDS, RESEARCH, ETC.  ~

 
Rentrak has signed a deal with Gannett Broadcasting which will subscribe to its StationView Essentials measurement service to track TV ratings through set-tops used by Dish and AT&T u-Verse TV subscribers. The deal will bring the service, which provides granular reporting such as second-by-second viewing data, into 19 additional markets including Washington D.C. and Atlanta, GA.
 
Twitter’s relationship with the developer community is becoming increasingly strained as the micro-blogging site rolls out its own mobile applications that compete with or replace existing third party apps, according to a new report from Ovum. (Twitter launched its own BlackBerry app and acquired the creators of the popular Tweetie iPhone app in April.) It warns that Twitter needs to be careful not to alienate developers as they drive innovation and traffic to the platform; currently 3rd party applications account for 75% of all tweets.
 
Online ad spending is poised to rebound this year to increase by nearly 11% after dropping by 3.4% last year, according to a new eMarketer forecast. The growth will be fueled by advances in targeted ad solutions and the gradual shift of TV ad budgets to the interactive space. Video ad spending, which is expected to jump by 48% this year, will remain the fastest growing format.

~ GADGETS & APPS ~

 
It was a valiant effort, anyway. Google announced that it is giving up selling the Nexus One direct handset directly to consumers via the web, switching to traditional distribution models through retail and carrier stores. The company hoped to wrestle some control away from the major carriers by selling the non-subsidized Android phone without a contract, but the high price tag ($529) and lack of support from carriers made it a tough sell. (Verizon recently joined Sprint in pulling support for the phone.)
 

~ EXECUTIVE MOVES ~

 
Former AOL executive David Lebow has stepped down as President and CEO of local media interactive services provider Minneapolis, MN-based Internet Broadcasting.
 
Former technology adviser to Bill Gates Alexander Gounares has been named Chief Technology Officer at AOL. He will be based on the company’s Dulles, VA campus. Alex succeeds Ted Cahall, whose departure was announced previously.
 
Mobile gaming company Hands-On Mobile has tapped Judy Wade as President and CEO effective immediately. She joins from Linden Lab, creator of the virtual world Second Life, where she served as VP/Strategy and Emerging Business.
 
Tribune Co. has upped Doug Thomas to EVP/GM for Tribune365, the company’s national sales solutions group. He will be responsible for all of Tribune365’s activities and will focus on sales and revenue development opportunities.
 
Jon Vanhala has been appointed SVP/Digital & New Business Development for Island Def Jam Music Group, a newly created position. He will oversee digital strategy, e-commerce, digital marketing and new business initiatives reporting to Steve Bartels, President & COO.
 


~ WEBSITE OF THE DAY ~

 
YouTube celebrated its 5th anniversary yesterday launching a new user generated channel asking viewers to submit personal stories about how YouTube has changed their lives. You can browse submissions via video wall or global map interface. Guest curators such as upcoming TBS personality Conan O’Brien, who blames YouTube for the economic slowdown in the U.S. and is mad that he’s not getting paid, have provided some of their personal favorites. (Conan’s favorite video depicts a bunch World of Warcraft gamers plotting unsuccessfully to defeat a boss monster, helmed by Leeeeroy Jenkins.)  Check out the retrospective timeline and video highlighting some of YouTube’s milestones, including its acquisition by Google, the launch of licensed music portal Vevo and the introduction of 3D and 1080p HD streaming. The site, which is still responsible for nearly 70% of the videos viewed on the web, announced it has surpassed an average of 2 billion videos viewed per day, just 7 months after surpassing the 1 billion mark. Next up will be the part YouTube plays in the upcoming Google TV set-top, expected to be unveiled at the company’s I/O Developers Conference on Wednesday.
