Good Morning.  It’s Tuesday, March 25, 2008, and this is your first early morning briefing.

FOX refused to pay the FCC’s proposed $91,000 fine leveled against 13 FOX owned and affiliated stations that aired an episode of Married by America in 2003 which contained pixilated nudity. The FCC issued the forfeiture order on February 22, giving FOX 30 days to pay. FOX instead filed a petition for reconsideration saying the commission’s ruling was “arbitrary and capricious, inconsistent with precedent and patently unconstitutional.”

~ MORE GOOD STUFF ~

FOX announced it will pick up Prison Break, produced by 20th Century Fox Television and Adelson-Parouse Productions, for a fourth season.   that’s the good news.  Now for the bad news – Fox has cut The Return of Jezebel James from the lineup after most recently delivering a 1.1 A18-49 rating, and will insert encore airings of Bones in the Friday 8pm time period.

Coming to CBS this April 8 at 10p is the premiere of the seven-week talent show Secret Talents of the Stars. The celebrities will rehearse and perform their hidden skills along with professionals with three judges offering critiques but the viewers will ultimately decide who stays and who leaves each week. Some of the participating celebrities include Clint Black performing stand-up comedy; George Takei performing country music; Sasha Cohen doing a contortionist act along with a Chinese acrobat troupe; and Danny Bonaduce taking a spin on a unicycle with other cyclists. Secret Talents of the Stars is produced by Magic Molehill Productions, Inc. in collaboration with Robyn Nash Productions and Don Weiner Productions.

HGTV renews four series: Rip & Renew airs Saturdays at 930a and Save My Bath airs Mondays at 830p and both are produced by Nancy Glass Productions. Color Correction, produced by Pie Town Productions, airs Thursdays at 930p and Find Your Style which airs Saturdays at 1030p is produced by Edelman Productions.

The Weather Channel ordered fourteen new episodes of When Weather Changed History produced by Towers Productions, Inc. The one-hour program airs Sundays at 9p and again at 11p.

Headline News will debut a new 30m comedy news show Not Just Another Cable News Show airing at 7p on Saturdays and Sundays beginning April 5, says Variety. The show, which will be repeated at 9p and midnight, will jab at celebrities, politics and dumb crooks.

Yesterday afternoon, Retirement Living TV debuted What’s Next? a new lifestyle reality makeover show that addresses the transition from work life to retirement. The 2pm show with host Sherry Parrish travels the country in an RV talking to people struggling with retirement. Future topics of the show will cover downsizing, divorce, social isolation, living alone to multi-generational households.

Yesterday the Justice Department okayed the merger of XM Satellite Radio and Sirius Satellite Radio stating it would not “substantially lessen competition” and further indicated satellite should not be considered its own exclusive domain but part of a bigger audio market. The next step is to get FCC approval, despite ongoing opposition to this merger from broadcasters and the National Association of Broadcasters. Both Sirius and XM received stockholder agreement of the deal last November.

CBS ordered a comedy pilot Oldyweds written by Shana Goldberg-Meehan and Ed Yeager from Warner Bros. TV about a thirtysomething couple who find out marriage is hard. CBS has another untitled 30m project from ABC Studios and written by Ed Yeager about a middle-class dad struggling after a divorce.

A handful of casting notes:

  • Michael Cassidy will appear in The CW drama How to Teach Filthy Rich Girls playing the boyfriend of the woman hired to teach two rich Palm Beach girls. The series is from Warner Bros. and Alloy.
  • CBS cast Amy Smart to be the lead in the drama pilot Meant to Be’s from CBS Paramount and creator Glenn Gordon Caron. Meant to Be’s is about a New York gallery owner, Janine (Smart) who elopes then dies on the way to her honeymoon. She must help people on earth head in the right direction before she can go to heaven.
  • Also for CBS, Fred Savage landed the lead on the comedy pilot Single White Millionaire about a rich guy ready to get married from Warner Bros.
  • FOX cast Will Sasso and Federico Dordei for the comedy pilot Spaced from Warner Bros. about two strangers who act like they are married to rent an apartment then become close with the odd people in the building. Sasso is the guy’s best friend and Dordei plays a neighbor in the building.

CYNOPSIS DIGITAL – TODAY’S TOP STORY:
After losing out in the FCC’s spectrum auction just days ago, Google is already pressing the FCC to utilize TV “white space” to provide cheap nationwide wi-fi internet access. In a letter filed with the FCC on Friday, Google’s Washington telcom and media counsel Richard Whitt reiterated that a vast majority of viable spectrum goes unused or is underutilized. Broadcasters have long complained that white space services would interfere with TV broadcasts and next year’s transition from analog to digital, but Google promises it could work through any problems. Whitt mentions adopting technologies such as “spectrum sensing” to prevent signals from interfering with one another.   Full edition: CYN DIGITAL. CYNOPSIS KIDS – TODAY’S TOP STORY: Lionsgate and Hit Entertainment have entered into a home entertainment distribution rights deal under which Lionsgate takes the exclusive marketing, sales and distribution rights to Hit’s full slate of kid’s programming in the US and Canada.  Lionsgate also signs for the digital distribution rights to the Hit content.  Lionsgate is slated to begin distributing Hit’s content beginning this May 2008.  Prior to this Hit’s kids programming was distributed Fox Home Entertainment.  With the new Hit deal, Lionsgate expects its non-theatrical family DVD market share to increase to 15% from its current 9%.  Lionsgate already releases kid/family entertainment programming including Scholastic’s Clifford the Big Red Dog, American Greetings’ The Care Bears, Cookie Jar Entertainment’s The Doodlebops, MGA’s Bratz, Nelvana’s Miss Spider’s Sunny Patch Friends as well as Speed Racer and the Marvel Animated Features series. CYNOPSIS INTERNATIONAL – TODAY’S TOP STORY  GolTV picked up the exclusive U.S. and Canadian broadcast rights to all of the German National Team 2010 World Cup qualifying matches when they start in September. Sunday – A18-49 Analysis:  ABC hopped into first place Sunday night at 3.1/9 A18-49, according to fast affiliate ratings from Nielsen Media Research. CBS took the first hour at 7p as the NCAA Basketball Runover and the start of 60 Minutes did a 3.5/12. ABC then collected the remaining victories each hour: at 8p Extreme Makeover: Home Edition posted a 3.9/11, followed by Oprah’s Big Give at 9p with a 3.5/9; and then Here Come the Newlyweds delivered a #1 2.9/8 during 10p.

~ EXECUTIVE MOVES ~

Bonnie Hammer signed a multiyear agreement with NBC Universal to become President/Cable Entertainment and Cable Studio in addition to her duties as President of USA Network and SCI FI Channel. Bonnie will provide oversight of NBC Universal Cable Studio which produces USA Network’s Monk and Psych and SCI FI’s Battlestar Galactica series among other programs as well as NBCU’s Emerging Networks. In her new role, Bonnie will identify and develop new scripted content for the company’s cable group and for external cable networks. Bonnie continues to report to Jeff Gaspin, President/COO, Universal Television Group, while Richard Rothstein will now report to her.

CBS Mobile upgraded Jeff Sellinger to EVP/GM where he will manage the division.

SNY, the New York network home to the Mets and Jets, announced eight personalities whose exclusive on-air roles have expanded to appear nightly on various programs: Joe Benigno, Chris Carlin, Scott Ferrall, Jon Heyman, Marc Malusis, Sweeny Murti, Adam Schein and Brandon Tierney.

Lauren de la Fuente joined Reactrix Systems, Inc. as VP/Brand Solutions and Marketing. Most recently, Lauren was VP/Strategic Programming and Marketing Solutions for G4.

Discovery Channel is streamlining its development and production functions and has hired back Gena McCarthy for the role of VP/Development and Current Programming based in Silver Spring. Gena returns after being at WE tv and will head Discovery’s development strategy and supervise first-run productions.

Furthermore, Discovery Channel recruited Beth Dietrich Segarra as VP/Development based in New York and has promoted Liz Branch to VP/Production based in Silver Spring. Elli Hakami, VP/Development will continue to manage West Coast development in the Los Angeles office.

Christine Persichette is a new General Assignment Reporter for WWOR-TV, the MyNetworkTV affiliate based in New Jersey that serves the New York metropolitan area and owned by the Fox Television Stations.

Tribune Company appointed Chandler Bigelow as CFO to supervise all corporate financial activities starting immediately. Chandler, who was previously Tribune’s VP/Treasurer, follows Don Grenesko in this position who is retiring after 17 years.

MediaFLO USA, Inc. tapped Jonathan Barzilay as SVP/Programming to manage programming for FLO TV, purchase new content and develop original programming. He will also handle mobile content and relationships with key content partners. Additionally, Matt Milne was added as SVP/Sales and Marketing where he will lead strategy, branding, sales, marketing and channel development activities.

Steve Saltman advanced to SVP/Worldwide Television with Image Entertainment, Inc. to will lead the company’s new global television sales unit. Steve will manage television distribution and sales of company licensed and distributed content for broadcast television, cable/satellite, pay-per-view and VOD platforms.
