Good Morning.  It’s Tuesday, March 18, 2008, and this is your first early morning briefing.

Yesterday the U.S. Supreme Court agreed to hear the appeal submitted by FOX and other networks against the FCC regarding the “fleeting broadcast profanity” case. The networks involved contend the policy meted out by the FCC was “insufficiently justified, arbitrary and capricious.” It is likely the Supreme Court will review the case this fall, which puts any further profanity enforcement by the FCC in limbo until then.

Reacting to the Supreme Court’s action, FOX released the following statement:

“Fox is pleased that the Supreme Court has decided to hear this case involving fleeting expletives in live TV shows, as this will give us an opportunity to demonstrate once again the arbitrary nature of the FCC’s decision in this and similar cases. It will also give us the opportunity to argue that the FCC’s expanded enforcement of the indecency law is unconstitutional in today’s diverse media marketplace, where parents have access to a variety of tools to monitor their children’s television viewing.”

CBS will follow this winter’s Big Brother 9 edition with another one this summer, which thus far has averaged a 2.1 A18-49 rating. The summer editions tend to rank higher: Summer of 2005 Big Brother averaged a 2.9 A18-49 rating, while the summer 2006 and 2007 airings averaged a 2.8 A18-49 each. CBS has not released a premiere date for the upcoming summer installment.

FX has picked up the cable rights to five Marvel Studio films: Paramount’s Iron Man and Universal’s The Incredible Hulk, plus three other superhero movies, titles TBA, reports Variety.  A four year broadcast deal will be made with the same titles, and both titles will have their pay TV airings – Iron Man on Showtime and Incredible Hulk on HBO.  The estimated cost of the five picture deal is in the $100-$110 million neighborhood.

NBC Universal Domestic Television Distribution sold the series House and Monk to local broadcast stations covering 99% of the U.S. for weekend syndication runs beginning this fall. House, which currently airs on FOX, was sold in these top five markets: WNYW/NY, KTTV/LA, WFLD/Chicago and KPIX/San Francisco.  Monk, which is currently on USA Network, has been sold to WNBC/NY, KNBC/LA, WFLD/Chicago, WPHL/Philadelphia, WSBK/Boston, KNTV/San Francisco and WFAA/Dallas, plus others. House is produced by Universal Media Studios in association with Heel and Toe Films, Shore Z Production and Bad Hat Harry Productions. Monk is from Universal Media Studios in association with Mandeville Films and ABC Television Studios.

Over the next three months, Food Network will add three new shows, all on Sundays, to its weekend “In the Kitchen” lineup:

  • Cooking For Real – premieres April 6 at 1030a; Sunny Anderson offers easy-to-prepare recipes for classic comfort food dishes.
  • Chic & Easy – debuts May 18 at 1030a; Mary Nolan gives viewers easy, yet elegant recipes and entertaining ideas that are affordable and impressive.
  • Secrets of a Restaurant Chef – opens June 29 at 1030a; top restaurant chef, Anne Burrell takes the mystery out of the professional kitchen and offers practical techniques for the at-home kitchen.

As an alternative to college basketball’s Final Four, Discovery Health presents Baby Madness: Multiples. Forty sets of twins and triplets are featured while they play, laugh and cry during the three-hour special hosted by comedian Andrew Kenney on April 5 at 3p with repeats until midnight. 

The Academy returns for a second season on the Fox Reality Channel on May 24 at 9p. The Academy: LASD Class #368 will document the exhausting training process recruits endure to become a Los Angeles County Deputy Sheriff. The series is produced by Scott Sternberg Productions.

Azteca America launched a new weekly primetime series Ladrones (Thieves) this Monday at 8p. The one-hour series recounts famous heists and the criminal masterminds behind them from bank robberies, to art museums to jail breaks.

TV Land revealed four new original pilot projects that continue the network’s goal of targeting viewers in their 40’s:

  • First Love, Second Chance – hour-long show allows lost sweethearts the chance to rekindle their love years later. Produced by Granada America Entertainment.
  • Now or Never – empty nesters will have the opportunity to pursue their dream career in this 60m program. Produced by RDF USA.
  • Make My Day – half-hour project where an unsuspecting participant is filmed as they experience a series of strange coincidences and surprises. Produced for the network by Embassy Row.
  • What’s In The Box? – 30m game show with contestants competing in a fast-paced series of 20 questions to guess what’s in the box for a cash jackpot. Produced by Bunim-Murray Productions.

TV Land also announced the premiere dates for several previously-announced original series:

  • The Big 4-0 – opens April 16 at 10p; a look at how viewers celebrate this milestone birthday. From 3 Ball Productions.
  • She’s Got The Look – starts June 4 at 10p; TV Land and Wilhelmina team to find models age 35 and older. From Allison Grodner Production.
  • Family Foreman – debuts July 16 at 10p; six-episode series takes a look at George Foreman’s home life. Produced by New Line Television.

A new series for The CW Wrecking Ball from Fox TV Studios is about a well to do young lawyer who teams up with a newly graduated law school student and they create a firm to help those who have no where else to go for legal assistance.

Granada America and A. Smith & Co. have come up with another British chef at the helm of a cooking reality series – The Chopping Block has been ordered by NBC and features chef Marco Pierre White. The show feature eight couples/chefs all competing to win their own restaurant.

Casting Call: Mind Your Business, a tentatively-titled new series produced by GRB Entertainment, wants to give struggling businesses located in the Greater Los Angeles area makeovers. The idea is to give CBS stations additional targeted web locales to sell to, according to Jonathan Lees, President and GM of CBS Television Stations Digital Media Group, while providing additional outlets for locally-produced video content. The widget program, powered by Syndigo, has already launched in Boston, Dallas, San Francisco, Chicago and Denver and The CBS Local Ad Network is having no trouble recruiting publishers to play along. CYNOPSIS KIDS – TODAY’S TOP STORY Radio Disney inked a deal with Arbitron, the media/marketing research company, under which Arbitron will provide measurement and research of kids/tweens/family radio listening patterns on a nationwide scale.  This marks the first time that Arbitron will measure the radio listening behavior of kids and tweens.  Available to 97% of the US, Radio Disney includes 50+ terrestrial radio stations, and can be heard via www.radiodisney.com, XM and Sirius satellite radio, iTunes Radio Tuner, XM/DirecTV and mobile phones. CYNOPSIS INTERNATIONAL – TODAY’S TOP STORYTelemundo and Mexico’s Grupo Televisa, S.A.B signed a distribution deal covering Telemundo content in Mexico across broadcast TV, Pay TV and emerging digital platforms.  As of April, Televisa’s Channel 9 will start to air over 1,000 hours of Telemundo programming annually.  Later in the year, Televisa will launch and distribute a new Mexican PayTV channel with Telemundo-branded entertainment and news content on its DBS platform Sky and cable system Cablevision, reaching over 2 million households at launch. Once again this week, ABC came in first each hour: at 7p AFV did a 2.3/7; during 8p ABC experienced its highest ratings of the night for Extreme Makeover: Home Edition at 4.1/11; then at 10p Oprah’s Big Give posted a 3.6/9; and Here Come the Newlyweds capped the night with a 2.9/8.

~ EXECUTIVE MOVES ~

Fuse named Brad Samuels as EVP/Content Distribution to lead the network’s newly formed Content Distribution Department. Brad will report to Eric Sherman, President. Joining Brad on the team will be Guy Cacciarelli as VP/Content Distribution Western Region and Peter Tulloch as VP/Content Distribution Eastern Region, with both reporting to Brad. The Content Distribution team will spearhead affiliate relations, identify and distribute content across all platforms in addition to increasing international distribution and business development opportunities for the network. The team will also handle affiliate sales and marketing efforts for MSG and MSG Plus.

Randall McCurdy will be the new VP/Affiliate Sales for Starz Entertainment, LLC. He is charged with developing strategies, systems and programs on behalf of Starz Entertainment, its products and services. Based at the company’s Englewood, CO office, Randall will report to Christine Carrier, SVP/Affiliate Sales.

Discovery Commerce added Dan Hamby to the new position as VP/Home Video. Dan is responsible for developing and implementing strategies to increase Discovery’s home video business through Discoverystore.com, Discovery Channel Catalog and direct response television as well as through third-party licensing partnerships in retail and direct response channels. He will report to Kelly Day, COO, Discovery Commerce.

Univision Online, Inc., the interactive subsidiary of Univision Communications Inc. appointed Christian Martinez as VP/Ad Sales, Southeastern Region, starting immediately. Based in Miami, Christian will report to Byron Elton, SVP/Advertising Sales, Univision Online.

Former VP/Treasurer of The New York Times Company, George Barrios joins World Wrestling Entertainment Inc. as CFO starting March 24. In this new position, George succeeds Frank Serpe, who is retiring after 21 years as CFO with WWE.

Hand Made Movies hired Christopher Gaida as Associate Producer of the feature The Wiglet to manage development operations on the West Coast.
