Good morning. It’s Tuesday, February 28, 2006, and this is your first early morning briefing.
With all the network shows now available for download on various services, you had to see this one coming. The Screen Actors Guild and the Writers Guild of America have both exchanged press statements over their displeasure of ABC’s providing digital downloads of several hit series including Desperate Housewives and Lost on iTunes. ABC plans to offer residual pay to actors based on a home video model that was developed in 1980. The SAG says how these residuals are paid should have been part of a negotiation with the unions according to its collective bargaining agreement, and says the home video model is outdated, and will not fairly compensate performers. The WGA wholeheartedly agrees with SAG, and both unions have said they plan to pursue legal arbitration. A statement from ABC reads in part: “We have great respect for the Guilds and the contribution of their members. The only question here is what the existing Guild agreements provide. We believe that the residual for sales and permanent downloads of programs to the iPod is covered by the home video residual formula. … this is simply a dispute over how to interpret a provision under agreements that provide the means for resolving that dispute.” ABC’s Robert Iger told investors on Monday that ABC has sold over 3 million video downloads via iTunes, generating gross revenue of approx $6 million, since the shows became available for download in mid-October.
Tonight’s Premiere:
CBS: The Amazing Race at 9p* MORE STUFF *Cable operator Comcast and signed a deal with IFC Entertainment whereby Comcast will add to its On Demand service IFC in Theatres, where it will show select independent films on its on-demand service as of the same day the films are released theatrically. The deal calls for approx two dozen films annually. IFC in Theatres kicks off on March 22, and the first films will be American Gun starring the Donald Sutherland and Spike Lee’s CSA: The Confederate States of America.
NBC Universal Television Group has inked a 2-year, development agreement with Galan Entertainment, for the production of telenovelas and other Spanish-language formats in English. Built into the deal is Telemundo licensing its current formats to Galan so they can be developed for English-language, with Body of Desire the first of Telemundo’s shows to head into production this summer. Highest on the pecking order to receive the new novellas from Galan are NBC, USA and Bravo.
For all of you fans of chef Gordon Ramsey, among which I count myself, Fox‘s series Hell’s Kitchen is scheduled to return for a second season on June 12 at 9p. Granada Entertainment’s Hell’s Kitchen takes 12 chef-wannabes and puts them thru their arduous paces, with the last one standing winning an Executive Chef placement at one of the new restaurants in the Red Rock Casino Resort Spa in Las Vegas.
MTV Networks and Sprint is now offering music, comedy and entertainment programming from CMT, MTV, VH1, and Comedy Central On Demand on Sprint TV. Subscribers, who pay a base rate of $5.95 per month per channel on Sprint multimedia-capable handsets, can watch clips from broadcast shows and listen to streaming content from CMT, MTV and VH1 radio stations.
Fox Mobile Entertainment yesterday launched Mobizzo, a new mobile content locale. Fox News Corp’s will offer content from across its entertainment divisions as well as from other media companies on Mobizzo including games, music, and ringtones and wallpaper from Family Guy, American Dad, Napoleon Dynamite and Ice Age: The Meltdown. Service is available either for a monthly subscription ($5.99) or a la carte. As of now the service is available on Cingular and T-Mobile phones, with other US carriers joining soon.
And not to be outdone, CBS announced yesterday its plans to launch a service to deliver breaking news video and text alerts called CBS News TO GO. Also part of the offerings will be alerts from Entertainment Tonight called ET TO GO. Both are scheduled to launch next month. Subscribers will get up to five alerts per month sent to their cell phone, for the fee of 99 cents per moth for CBS News alerts, and $3.99 per month for ET TO GO. Partnering with CBS to provide the alerts is Boston-based m-Qube.
Sundance Channel will show the U.S. television premiere of the hit Brazilian television series City of Men on April 4 at 9p. The story is about two teenage friends attempting to live regular lives in the slums. Sundance Channel has acquired all three seasons for a total of fourteen episodes.
MTV2 will premiere the second seasons of its series The Andy Milonakis Show and Wonder Showzen on March 31, at 9p and 9:30p, during its Sic ‘Em Friday line-up. Following the debut of each new episode of both series, the episodes will be available on MTV2.com and Overdrive and will include additional video content. Additionally, websites for both series are set to rollout March 10 on MTV2.com.
According to a new study by TNS Media & Entertainment conducted in 2005, DVRs and VOD effectively reduce subscriber churn when operators can correctly market and program VOD services, because DVRs can increase the number of channels watched in a household each month by nearly 50%. DVR by itself stimulates the viewing of four additional channels per month, and VOD adds seven channels. The number of channels used by subscribers direct impacts their commitment and loyalty, and while TNS says pay channels benefit most, many basic channels also increased their audience among DVR and VOD users.

- Yesterday’s Box Office incorrectly listed the top grossing movie Tyler Perry’s Medea’s Family Reunion (Lionsgate). The opening weekend box office for this film was $30.0 million.
here! has signed a carriage agreement with cable operator Atlantic Broadband to offer the network starting March 1, as a full linear premium channel serving digital cable customers in Miami Beach and several surrounding communities. For $8.95 a month, viewers will have 24-hour access to here!’s monthly menu of gay-themed original series, specials and movies.
The Gospel Music Channel has gain carriage on Charter Communications. While terms were not disclosed, Gospel will now be available in more than 75 markets and over 1,300 cities.
Jordan Levin, Pete Aronson, Mike Karz, Dave Rath and Kara Welker have partnered to launch Generate, a content development, production and talent management company targeting young adults and family households. The company’s first deal is an exclusive with MTV Networks to create basic cable, broadband and wireless distribution content for all MTV Networks’ properties.
That perennial urban cowboy, Dennis Weaver, always seen in a cowboy hat and boots, died last Friday at the age of 81. Weaver is perhaps best known for his roles as Chester on Gunsmoke, as McCloud, and on Gentle Ben. A few things perhaps not as well known about Weaver – he was a committed environmentalist and lived in a home in New Mexico built almost entirely out of recycled materials. He was a vegetarian, a grandfather, and an Olympic Gold Medalist which he won in 1948 for the 1500 meter run. He also came in 6th in the Decathalon that year. He also he formed a singing group with Amanda Blake and Milburn Stone in 1958, and in 1960 they broke the house record for the Albuquerque Arena during the New Mexico State Fair. Weaver is survived by his wife Gerry, three children and three grandchildren.
* NEW ORDERS / CASTING / DEVELOPMENT / PRODUCTION *CBS‘ drama pilot Sharks from 20th Century Fox TV and Imagine TV, starring James Woods as an attorney for the stars turned prosecutor, has signed Spike Lee to direct. This collection of talent represents Woods first television series as well as Lee’s first direction of a pilot.
Also at CBS – Waterfront starring Joe Pantoliano has added William Baldwin to the cast as a district attorney who clashes with the Providence mayor played by Pantoliano.
Another pilot pickup for The CW – Split Decision from CBS Paramount Network TV and Warner Bros. TV, about a teenagers first day at school, and how her life can turn out different if she first chooses to sit with the popular kids vs. the not-so-popular kids.
Lifetime‘s 13 episode series Emily’s Eyes has cast Abigail Spencer in the drama from NBC Universal TV. The story is about a tough female FBI agent who is looking for those who framed her CIA agent parents for treason.
Studio 60 on Sunset Strip, the pilot project for NBC which is set behind-the scenes at a weekly late-night comedy show (read: SNL) has added Bradley Whitford to the cast which already include Matthew Perry, Amanda Peet, D.L. Hughley, Timothy Busfield and Sarah Paulson. Aaron Sorkin and Tommy Schlamme will oversee the project from Warner Bros. TV.
* EXECUTIVE MOVES *Dotty Ewing joins The HorseTV Channel as the SVP/Marketing. Dotty will be responsible for forming and implementing comprehensive marketing strategies to drive awareness, distribution and sales for The HorseTV Channel.
Danny Fishman becomes President of Broadband Enterprises, a company specializing in broadband video sales, syndication and original production, effective March 13. Danny previously held the title of EVP/Sales at IFILM, and will commute between Los Angeles and New York while leading the company’s national sales force and assisting in guiding the company’s syndication and original production businesses.
Two moves at 4Kids Entertainment, Inc.: Tony Reed is upped to SVP/Marketing and Licensing spearheading the strategic development, licensing and marketing of key brands. Carlin West is upped to SVP/New Concept Acquisition and Development, reporting to Alfred R. Kahn, Chairman/CEO. Carlin will be responsible for the strategic identification and development of new product concepts and non-television properties.
Lloyd Fan has been named as Interim President of Q Television Network. Lloyd and his partners in Best Prop Holding Group will also commit resources to QTN for daily operations, programming, strategic growth and financial stability. Frank Olsen, currently CEO/President of Triangle Multi-Media Limited, Inc., will remain as Chairman/CEO of both Triangle Multi-Media Limited, Inc. and Q Television Network. Best Prop Holding Group owns Pat Prod Productions and Patented Product Industries.
* RATINGS *Sunday – A18-49 Analysis: ABC waltzed into a win on Sunday night with a 7.8/18 A18-49 rating winning every hour of primetime, according to fast affiliate ratings from Nielsen Media Research. NBC with its closing ceremonies of the Winter Olympics was a distant #2 with a 3.5/8. At 7p AFV averaged a 5.3/13, just steps ahead of Fox’s 4.4/11 for Malcolm and King of the Hill. At 8p the first hour of the Dancing with the Stars finale quick-stepped beyond the rest of the field with a 10.3/22, over NBC’s 9 share for the hour. At 9p the final hour of the two-hour finale danced beyond the competition with a 6.8/16 over Fox’s Simpsons and War at Home. And, if I can keep this dancing jargon up for one more line, Grey’s Anatomy sashayed past the rest of the field with a 7.8/18, more than doubling NBC’s final hour of Olympics.
