Good morning. It’s Tuesday, April 17, 2012, and this is your first early morning digital briefing. If you would like to read this or any other Cynopsis editions online, click here.
Google has announced a new deal that will bring over 600 titles from MGM to rent through YouTube and/or Google Play. MGM joins five of the six major studios (most recently Paramount), as well as over 10 independent movie studios (Lionsgate, Magnolia, Star, Weinstein, etc.), currently offering movie rentals through the video site and Google Play. The movies (such as Rocky, The Terminator, Robocop and Rain Man) will be available to all users in the U.S. and Canada. Google/YouTube says a handful of titles are available today, with more to be added in the coming weeks.
DirecTV and Starz Entertainment‘s distribution agreement renewal has added authenticated rights for future online access to movies and Starz original programming on DirecTV Everywhere. Specifically, it grants DirecTV the rights to offer the Starz Online and Encore Online services on DirecTV Everywhere, which is currently in beta, for authenticated Starz Super Pack subscribers. The agreement also enables DirecTV to launch Movieplex, Indieplex and Retroplex, as well as the related Movieplex On Demand and Movieplex Online service on DirecTV Everywhere. Financial terms of this deal were not disclosed.
CBS will be joining several other broadcasters in two mobile broadcast TV initiatives, both of which are designed to bring live broadcast TV to mobile devices. CBS’ affiliates in Dallas, Miami and Los Angeles will participate in the Dyle mobile TV service, which is operated by Mobile Content Venture (MCV), a joint venture between 12 major broadcast groups including Fox, ION Television, NBC, Cox Media Group, E.W. Scripps Co., Gannett, Hearst Television, Meredith and more. KSTW (The CW 11, Seattle) will join the Mobile500 Alliance, which currently has 50 members, including Capital Broadcasting, Fisher Communications and Sinclair Broadcasting, which hold licenses to 437 TV stations. The Mobile500 Alliance stations reach 94% of U.S. TV households.
Social TV developer yap.TV has announced the availability of yap.TV Live Pulse, a sync-to-TV solution, as well as the yap.TV CMS, for any show on the yap.TV platform. The yap.TV CMS enables content producers and networks to select any show and introduce Social TV experiences for viewers to access while watching that show live or on DVR. Partners working with the company include USA Network/NBCU and XIX Entertainment. yap.TV says there will be no charge for the service for partners that want to host second-screen experiences within the yap.TV app. The Live Pulse solution works like this: when a show airs on TV, a button “pulses” on the screen in the yap.TV app, alerting users that additional content is available. Partners can sync videos, pictures, interactive ads and more, and can modify show info, graphics, polls and social streams.
The Style Network has announced the formation of Style Media, a new global, multimedia content company that will encompass digital, licensing and merchandising divisions, consumer-facing brand experiences and domestic TV and international networks. Style Digital, which includes myStyle.com and various social media platforms, will feature original content and partnerships with style experts and trendsetters.
RonnieMagro.com, the latest property within the EQAL Media Network, has launched to provide original content for the Jersey Shore star’s fans across Facebook, Twitter, YouTube and other web and social services. Content will focus on various topics such as fitness and wellness, as well as updated information on the reality star’s latest projects.
Mobile social network Path is on the verge of announcing a $40 million round of Series B financing, reports AllThingsD. Led by Redpoint Ventures, the announcement could be made at some point today. It would value the San Francisco-based start-up, which designed its mobile social networking app as a way to keep close with a smaller community of close friends and contact, at $250 million.
DG, an ad management and distribution platform provider, has inked a deal to provide advertisers with the ability to trigger ads on second-screen devices based on live TV content via Civolution’s SyncNow media interaction technology. The ad platform will allow apps running on companion devices, such as smartphones and tablets, to automatically recognize and synchronize with the content that is on the TV screen, after which relevant content and advertisements can be delivered to the viewer. This solution combines DG’s asset tagging and metadata with Civolution’s Automatic Content Recognition (ACR) and mobile video ad serving from MediaMind, which is a division of DG. This offering will be demonstrated at the 2012 NAB Show in Las Vegas at the Civolution booth (#SU7923) or DG Suite N204, North Hall.
Oracle and Google are set to go to trial next week in a dispute over some smartphone technology used in Android that could have large ramifications on how intellectual property rights are viewed within the tech industry. Oracle claims that Google’s Android operating system violates several of the Java patents that it owns after having bought the software from Sun Microsystems in 2010. In response, Google says that it isn’t violating Oracle copyrights, and that there are certain aspects of Java and APIs in general that can’t be copyrighted. According to a legal brief it recently filed, Google asserts, “Oracle accuses Google of infringement for doing what the Oracle API specifications describe. That is a classic attempt to improperly assert copyright over an idea rather than expression.” Among the list of witnesses that will be called up to the stand include Oracle CEO Larry Ellison and Google CEO Larry Page.
Add FOX Television Stations to Worldnow’s growing roster of broadcast partners. Beginning with its WNYW New York station on April 23, FOX Television Stations will incorporate Worldnow platforms, which include CMS, online video and mobile, across all of its stations, according to TVNewsCheck. Worldnow says the addition of FOX means it works with about 40% of the 720 news-producing stations in the U.S., providing online services to 213 stations. Worldnow EVP/Sales and Distribution Craig Smith also told TVNewsCheck that the company’s success is in signing up major broadcast partners has to do with the company’s decision to revamp its technology “from the inside out” four years ago. “It allowed us to innovate more quickly, which is a problem it seems all the CMS companies have,” he said. The rollout will be completed by the end of June 2012. Financial terms of the deal were not disclosed.
Twitter has bought social analytics company Hotspots.io for an undisclosed sum. A blog post on its website says that the team from Hotspots.io will be joining up with Twitter’s revenue engineering team, where their focus will be on developing analytics tools for Twitter’s advertising and publishing partners. No word on whether Hotspots.io will exist or if this is a strict “acqui-hire.”

TBG Digital‘s Facebook Advertising Report shows that the average CPM rates of Facebook ads increased 41% in the Q1 2012 over the first quarter of 2011 in select major markets (U.S., U.K., Canada, France and Germany). CPC prices have risen by 23% in those five territories when compared to Q4 of 2011. Interestingly, CTRs have jumped up 196% since Q4 2011 for Open Graph-based news apps such as The Washington Post‘s Social Reader and Yahoo! News. Entertainment was the top sector in terms of CTRs in Q1 2012. TBG Digital’s survey is audited by Cambridge University. TBG Digital is a global marketing and technology company that specializes in Facebook advertising and social media.
A new report from eMarketer explores the viability of Google+ as an effective (or ineffective) online marketing tool. The (sort of) early indication: it’s not good. “Google+ has seen millions of users sign up for the site since its July 2011 launch,” said Kimberly Maul, eMarketer writer/analyst and author of this new report. “However, engagement and participation aren’t up to speed with other social networks, and that has become a major obstacle for turning Google+ into a relevant social network.” eMarketer cites the latest comScore data, which showed that in January 2012, users in the U.S. only spent 3.3 minutes on Google+, which was actually down from the 5.1 minutes they were averaging on the site through November 2011.
Turner Broadcasting has promoted Andrea Ching to SVP/CNN and Turner Digital Ad Sales Marketing and Promotions. Ching, along with Jeff Collins and Michael Strober, who were promoted to SVP/CNN Ad Sales and SVP/Turner Entertainment Ad Sales, respectively, will take on expanded responsibilities that aim to more closely align advertising opportunities across Turner’s portfolio of TV and digital brands. Ching’s promotion is to a newly created position, where she will oversee specialized promotional and marketing opportunities for advertisers across the CNN networks, while continuing to develop marketing across the Turner Digital portfolio, which includes sites like NCAA.com and CNN.com, as well as a number of mobile properties. Ching will be based in New York and reports to Greg D’Alba, President/CNN News Networks and Turner Digital.
The Digital Place-based Advertising Association (DPAA) has added to new members to its Board of Directors: Michael Maas, CEO of AMI Entertainment and Ahmad Ouri, CEO of Premiere Retail Networks. Mike DiFranza, who is the President of Captivate Network, was re-elected as Chairman of the Board. In related news, the DPAA also announced an amendment to its bylaws to allow suppliers to serve on its Board of Directors alongside network operators. Up to four new seats on the board will be open to suppliers in the industry.

Ventura Water has partnered with Limoneira’s Limco Del Mar, Patagonia and iThentic to announce and launch the inaugural Water: Take 1 Online Short Film Contest. In an effort to raise awareness about water, efficiency and recycling programs, filmmakers can immediately begin to submit short films (under five minutes) that “address the topic of water.” Submissions can be in any genre, whether it is documentary, drama, comedy, animation, sci-fi or experimental. There is no submission fee, and the submission period lasts until September 4, 2012. Ten finalists will be named and a jury-awarded Grand Prize of $1,500 will be presented at an event hosted by The Brooks Institute later this fall. Users visiting the website will also get a chance to vote on the Audience Choice prize, which will award the winner a new Canon EOS 7D Digital SLR camera.
