Good morning, it’s Thursday, October 2, 2008, and this is your first early morning digital briefing.

Fair use of online content can go too far, apparently. NBC asked YouTube to pull a mashup ad yesterday from the Obama campaign, according to reports, that combines NBC and MSNBC news footage to imagine a future where John McCain wins the election in November. NBC also asked the campaign to quit using the ad, which has been posted on VoteForChange.com and has been racking up thousands of views on political sites such as DailyKos as an embed.
 

~ MULTIPLATFORM CONTENT NEWS ~

 
Web-based subscription DVD rental service Netflix is adding a huge selection of Starz movies, TV shows and concerts to its library of content for instant viewing on Netflix.com, beginning with 1,000 titles now available. The agreement will allow current Netflix subscribers to access some 2,500 titles from the Starz Play broadband subscription service (formerly known as Vongo) for no extra charge. The deal provides a significant boost to the Netflix streaming option, which until now offered about 12,000 movies and TV episodes but has relied on mostly indie titles among its feature film selections.
 
PBS is distributing its election special The Choice 2008 for free across multiple platforms the day after it airs on the Network on Oct. 14. It will be up on iTunes, available in segments on YouTube’s PBS channel or viewable on the Frontline page of PBS.org as well as local affiliate station sites. Meanwhile PBS’ Boston affiliate WGBH has agreed to allow Comcast to carry today’s VP debate (and each subsequent presidential debate) On Demand for New England customers. Finally a new tie-up between BBC World News and PBS will bring co-branded digital offerings to local PBS affiliate sites including video and audio news summaries.
 
AOL‘s Money & Finance portal has signed a deal with Bloomberg Television to host news videos from the network, with plans to feature 20 new segments a day. AOL’s Platform-A will broker campaigns for the deal that reach across both sites. Bloomberg Television also launched a new affiliate web site allowing affiliates to learn more about the network, access program schedules, download marketing materials and sample original VOD content. The site also displays marketing programs to help drive viewership and build operators’ free on demand platforms.
 
Logo announced that its gay news portal 365Gay.com is launching the most comprehensive online collection of LGBT history related video to commemorate LGBT History month.
 

~ INNOVATORS & START-UPS ~

 
Social networking app creator Slide (SuperPoke) struck distribution partnerships with Warner Bros., CBS, E! and other programmers to supply ad supported clips directly to Facebook or MySpace profile pages, per WSJ. Facebook users will be able to watch and share clips from TV shows such as Beverly Hills 90210 or view recommended content based on how viral the video has become.
 
Keeping up with the new media-savvy Joneses, National Public Radio launched its own social network dubbed the NPR Community. It provides a forum for both users and NPR editors to expand upon stories they are working on, allowing members to view popular stories and comment on posts. Create a public profile to help attract similar-thinking friends by featuring your favorite NPR shows, music, movies or books.

~ GADGETS & APPS ~

 
News is in the eye of the beholder. CBS is catching flak over inappropriate content users are uploading via its new citizen journalist iPhone app CBSeyemoblie, reports AdAge. The COO of BrandContent, the ad agency which powers advertising on the service, discovered multiple photos and videos of various unsavory acts. CBS promises to redouble its effort to police the uploads.
 
MSNBC.com launched a new application for Windows Media Center users (which comes bundled with Vista Home Premium or Ultimate) designed to provide an immersive news experience. It aggregates video and graphic coverage of the latest Election news, top stories, and U.S. weather by zip code. It also enables users to build customized video playlists, browse by genre or search for video by keyword.
 

~ TECHNOLOGY DEALS, MERGERS AND SKIRMISHES ~

 
Apple
dropped the non-disclosure agreement (NDA) previously required for developers publishing applications to the App Store, admitting it had “created too much of burden on developers, authors and others interested in helping further the iPhone’s success.” The company is also threatening to shut down the iTunes store lock stock and barrel if the Copyright Royalty Board follows through with jacking up per track royalty fees Apple must pay, reports Fortune. The Board is expected to rule today on a request by the National Music Publishers’ Association to increase royalty rates paid to its members on songs purchased from online outlets from 9 cents to 15 cents a track – a 66% hike.
 
In more iPhone news, Adobe is ready to finally release a version of Flash for the iPhone if it passes the App Store screening process, according to AppleInsider.
 
Digital Cinema Implementation Partners’ (DCIP) agreement with Twentieth Century Fox, Walt Disney Motion Pictures, Paramount Pictures, Universal Studios and Lionsgate Films is a done deal. The studios will fund the deployment of digital projection systems to nearly 20,000 movie theatre screens across North America, including the AMC, Cinemark and Regal theatre chains.
 

~ DIGITAL ADVERTISING ~

 
Delve Networks announced an online video advertising pact with Tremor Media, allowing the video delivery platform to improve its monetization component. Tremor’s Acudeo video monetization platform allows publishers to schedule and dynamically deliver in-stream video and overlay ads from multiple ad sources through a central console, simplifying the process and maximizing ad delivery opportunities and revenue.
 
Online custom ad creator Spot Runner is working with PR Newswire’s MultiView broadband unit to provide an all-in-one solution for planning, producing and distributing videos via multimedia news releases (MNR) and direct online video postings.
 
Gas station at-the-pump network Fuelcast and retail-based out of home network Bhootan are merging to form Outcast. The company will now reach over 25 million consumers in 900+ locations providing programming and targeted advertising to nearly 6,000 digital LCD screens. John McLean, CEO of Fuelcast, will become Chairman of Outcast.  Matthew Stoudt, co-founder and CEO of Bhootan, will become CEO and Nathan Gill, co-founder and President of Bhootan will serve as Chief Media Officer. 
 

~ TRENDS, RESEARCH, ETC.  ~

 
NBC.com
claims September was a record-breaking month for the site with nearly 25 million uniques, shattering the previous record of 17.4 million according to Omniture data. The site also posted a record 28.8 million short-form video streams, besting the previous high of 22.4 million.
 
Disney.com and DisneyChannel.com scored record online traffic following Disney Channel’s “The Suite Life on Deck” weekend premiere event, which used on air promotions to drive viewers to the sites. Viewers tuned into part one on Sept. 26 at 8p on Disney Channel and were then directed to go to Disney.com to watch part two, available exclusively online prior to its on-air debut the following night. During the period nearly 800,000 The Suite Life on Deck videos were streamed at Disney.com, which drew a record 4.2 million daily unique visitors on Sept. 27.
 

~ EXECUTIVE MOVES ~

 
Seattle-based Evri hired Rudy Gadre as VP/Business Operations following his two-year stint as Facebook’s General Counsel. In this newly created position, Rudy will oversee legal and intellectual property, human resources, and financial planning. He reports to CEO Neil Roseman.
 
Music themed social media site Buzznet hired former New York Times music reporter Jeff Leeds as its new Editor-in-Chief. He reports to GM Scott Boyd. In addition, former Alternative Press magazine Managing Editor Leslie Simon has joined the company as Senior Editor. Both will be based in the company’s Hollywood, CA headquarters.
 
Online news site and magazine Newsmax Media has hired Chris Gonsalves as Managing and Corporate Assignment Editor. He was previously Editor in Chief of eWeek’s Channel Insider and an Executive Editor for Ziff Davis Media. Chris will be based in West Palm Beach.
 
UK-based VOD specialist Vode has recruited Hughie Kelly as Business Development Executive, who recently brokered a distribution deal with All3Media International for the company. Hughie was formerly in Sales and Marketing for Network Ireland Television.
 


~ WEBSITE OF THE DAY ~

 
A common complaint leveled against politicians is that you can trust them about as far as you can throw them. A new site called RealScoop deploys a new voice analysis technology (currently being used by law enforcement officials in the UK) to help catch politicians and celebrities when they’re lying. The site developed a tool it calls the “Believability Meter” that analyzes over 100 vocal elements and performs over 1,000 calculations/second to determine when the subject is stretching the truth. The site relies on user-posted videos from the worlds of Entertainment, News, Sports and Politics to fill out content on the site. Tonight staffers are trying something new – posting segments of the Palin vs. Biden debate as close to real time as they can manage to help viewers decide who is really winning or losing.
 
Clarification: Debatinator is the name of NYTimes.com’s side-by-side template matching transcripts with video from the debates, a separate feature from the live stream of the debate.
