Good morning, it’s Thursday, May 6, 2010, and this is your first early morning digital briefing.
Despite reports to the contrary earlier this week, word is that FCC Chairman Julius Genachowski has decided to regulate internet access after all, as part of a sweeping Broadband plan to ensure net neutrality among all users. The FCC is expected to announce on Wed. that it will propose reclassifying ISPs, which currently fall under the weakly regulated Title I of the Communications Act. The change of heart comes in response to a letter attained by advocacy group Public Knowledge, sent to the Commission from Rep. Henry Waxman, Chairman of the House Commerce Committee and Jay Rockefeller, Chairman of the Senate Commerce Committee, urging Genachowski to consider “all viable options” to achieve his objectives. The FCC was sent scrambling last month after a U.S. Appeals Court ruled that the Commission lacked the authority to tell Comcast how it could operate it network.
During a FYQ3 earnings call, News Corp. chairman Rupert Murdoch discussed plans to announce a new subscription model in the coming weeks, placing news and other digital content behind a paywall. The plan involves forming a consortium of content providers that will agree to charge for news distributed online and to connected mobile devices, reports the LATimes. News Corp. will build the platform and publishers will distribute stories and videos on it and share in the revenue generated, depending on what they contribute. News Corp.’s Wall Street Journal is charging $4/week for the use of its iPad app and has attracted 64,000 paying subscribers to date.
YES Network, FSN Northwest and DirecTV will broadcast the first-ever Major League Baseball in 3D on Saturday, July 10 and Sunday, July 11 when the New York Yankees visit the Seattle Mariners at Safeco Field. DirecTV will download a free software update to HD subscribers’ set-tops enabling them to access 3D programming, including the upcoming ESPN 3D channel and a 3D DirectTV Cinema channel. DirecTV and Panasonic will be presenting sponsors of the two 3D telecasts.
Qualcomm’s wholly-owned mobile TV subsidiary FLO TV is getting into the PPV business offering access to live UFC events. FLO TV will cover its first UFC bought this Saturday, May 8th at 10pm ET, featuring the rematch of UFC light heavyweight champion Lyoto “The Dragon” Machida and challenger Mauricio “Shogun” Rua. FLO TV subscribers must pay an additional $44.99 for the fight.
Univision.com introduced Salud as a Spanish language health and wellness destination for both online and mobile.
NBC’s TODAYshow.com launched a new video podcast, “TODAY in 2 Minutes,” encapsulating news headlines, weather and features from TODAY. Natalie Morales will anchor the program, premiering daily on TODAYshow.com and MSN.com at 6:30 a.m. ET each weekday morning.
As part of a push to expand to mobile devices, Chicago-based local couponing service Groupon has acquired mobile development start-up Mob.ly, which has launched its own mobile recommendation service and developed mobile apps for Yahoo and OpenTable.
iPad video news app maker Newsy has raised $2 million in second round funding from angel investors. The app features original video reporting that analyzes different slants and nuances being taken by various outlets, enabling users to share the content on social networks or connect to the original source material.
Plano, TX-based iTV company FourthWall Media signed a deal with Yellow Pages and local search service provider Axesa Servicios de Informacion to launch an interactive advertising app. Local ads sold by Axesa will be featured on FourthWall’s “Yellow Pages on TV” application, currently deployed on OneLink’s digital cable system in San Juan, Puerto Rico.
Facebook wants to open up the lines of sharing and communications on the web but this is going a bit far. The social networking giant announced that it has disabled its Facebook Chat service as the company works to fix a bug that exposed some users’ instant messages and friend requests to strangers. TechCrunch was tipped to the security flaw that allows users to access live chats occurring between friends (and friends of friends).
A diverse range of groups came out vociferously against Rep. Rick Boucher and Rep. Cliff Stearn’s new internet privacy bill. Consumer groups such as the Center for Digital Democracy complained the bill does little to protect consumers by not requiring marketers to get consumers consent up front before tracking them. Industry groups such as the IAB complained it was too broad. Pro-business think tanks accused it of fettering competition on the net.
4G WiMax service Clear outlined plans to launch in 15 additional cities across the U.S. this summer including Nashville; Daytona, Orlando and Tampa, FL; Rochester and Syracuse, NY; Merced, Modesto, Stockton, and Visalia, CA; Wilmington, DE; Grand Rapids, MI; Eugene, OR; and Yakima and Tri-Cities, WA.
Microsoft’s Internet Explorer web browser continues to lose market share to Firefox and Google’s new Chrome browser (now advertised on the Google homepage), according to Net Applications, dropping below 60% for the first time.

Skype is planning to launch a new group video calling feature in public beta next week, allowing up to 5 people chat simultaneously in front of their webcams. The feature will appear first for the Skype Windows client and is due to launch for Mac later this year. No word on when it will be available for mobile or iTV platforms. One-on-one video Skype is being integrated directly into web connected televisions from LG and Panasonic, a new application introduced at CES this year.
iN DEMAND has teamed with itaas to develop new promotional apps to run on EBIF and tru2way compatible set-tops. An Interactive Mosaic will market Movies on Demand (MOD); live events including boxing, UFC and WWE; and out-of-market sports packages such as NBA League Pass. A Sports Package Upsell app will deliver promos, schedules, product descriptions, pricing and ordering information. A Send to Cell Phone app will add pop-up notifications during on-air promos, enabling viewers to send PPV event reminders to their cell phones.
AOL has hired former Hearst Digital Services and Development Director Julian Downing as Director of Media for AOL Europe. He will head AOL’s content strategy across the continent, reporting to David Shing, head European Media and Marketing.
TV cost-per-action ad network REVShare has tapped former Time Warner SVP of Global Emerging Markets Brendan Condon as its new CEO.
Ascent Media tapped David Walters as SVP/Global Technical Operations and Infrastructure, and Eric Denna as SVP/Global Process Design. Both will be based at Ascent’s Santa Monica offices and report directly to Douglas Parrish, EVP Operations.
PubMatic made 4 newly created additions to its Strategic Accounts and Business Development operations:
- Joy Cavanagh becomes Director, Demand Partner Solutions, based in New York and reporting to Jeanne Houweling, VP/Demand Partner Solutions

In what can only be described as a validation of Microsoft’s new visual Bing search engine, Google is introducing a major new redesign of its simple Search engine. (Note: the new features launched yesterday for IE, Firefox and of course, Chrome web browsers.) Type in a search term and a new left hand column of options will appear, helping users to drill down into different categories (News, Blogs, Images, Books, etc.) arranged in the order Google thinks is most relevant. You can also sort by time range, geographical area (“nearby”), or mess with the presentation of the results to view them in a “wonder wheel” or a timeline. Then there’s the “Something Different” section, which will complement query-refinement suggestions with recommendations of similar things, such as like and kind musical acts, books, or TV shows. Some will no doubt miss the “Classic” Google but better filtering is a welcome improvement when trying to avoid irrelevant results. Google had been steadily, if slowly, losing search market share to Bing, but that trend seems to have slowed. Hitwise released new data claiming that Google’s share of U.S. searches in April increased 2% to 71% of the market, while Yahoo and Bing saw their shares decline slightly to 15% and 9.4% of the market, respectively.
