Good morning, it’s Thursday, May 27, 2010, and this is your first early morning digital briefing.

Comcast CFO Michael Angelakis expressed “disappointment” over the FCC’s plans to increase controls over the broadband market and threatened to curb investment in the sector if the new rules came to pass, according to reports. He also said that the company was on track to close its acquisition of NBC by year-end, as Comcast is looking forward to leveraging NBC’s assets to pursue new cross-platform advertising and distribution strategies. The FCC sent out a detailed list of questions last week probing current programming agreements and asking the companies how they will decide what content get distributed to what platforms, per the LA Times.
 

~ MULTIPLATFORM CONTENT NEWS ~

 
Comcast unveiled a new social networking site for TV viewers at the TechCrunch:Disrupt conference this week dubbed Tunerfish (not to be confused with REO Speedwagon album), scheduled to launch in beta with iPhone and iPad apps in the coming weeks. Calling it a “social discovery engine for TV,” the service was built by Comcast’s Plaxo division (acquired in 2008) and will allow user share with friends what they are watching both on TV and online including the sharing of actual viewing streams. It will also establish a points system to reward viewers for watching content.
 
Action sports network Fuel TV has launched an HD channel available in the Apple iTunes store specifically formatted for the iPad. The app makes a portion of the network’s content available for free, refreshed weekly, and offers access to premier podcasts tied to shows modified for the iPad’s 1,024 X 768 pixel screen. The shows currently require a Wi-Fi connection, but a subsequent release will enable 3G viewing.
 
Oxygen Media is teaming with social gathering start-up Meetup to organize 50 “Dance Off A Million” events around its dance-themed weight loss series Dance You’re A** Off. Viewers will be able to go to Oxygen.com to view or create a viewing party in their area. The partnership will kick off with the New York leg of the recently announced “Dance You’re A** Off” tour.
 
YouTube’s major label-backed Vevo music portal announced it will webcast the FIFA World Cup “Kick Off Celebration Concert” live on June 10 from Soweto/Johannesburg, South Africa. Featured acts include Alicia Keys, Black Eyed Peas, Shakira and The Parlotones.
 

~ INNOVATORS & START-UPS ~

 
Social gaming company Zynga struck a deal with Yahoo to distribute its games throughout multiple Yahoo properties, including Yahoo’s home page, Yahoo Games, Yahoo Messenger and Yahoo Mail. The deal comes just after Zynga kissed and made up with Facebook, renegotiating a new revenue split for virtual gifts bought through games like Farmville. The company says more than 35 million people play Zynga’s games each day.
 
Augmented Reality gaming company Ogmento has closed on $3.5 million in Series A equity financing to expand development of its AR game platform and operations in New York and Los Angeles. The round was led by Chart Venture Partners with participation from CNF Investments and private investors. Ogmento has developed games for Penguin Publishing, SAP, Orange Telecom, Smith and Nephew, and PBS.
 

~ DIGITAL ADVERTISING ~

 
As the mobile industry waits to see what interest the expensive iAd platform garners (Apple reportedly plans to charge $1 million for in-app iAd packages and as much as $10 million for launch campaigns,) third party companies continue to innovate. Video ad network iVdopia has introduced a new “Viper” ad format for the iPhone that enables users to swipe away an image to reveal interactive options regarding the product advertised. It’s currently being used within Rewind’s Movie Challenge and SGN’s iBowl apps to promote the Disney release “Prince of Persia.” iVdopia says 15% of users who view the app have interacted with it and 71% have watched the ad to the end.
 
RSG Media Systems has signed a multi-year deal with Discovery Communications to utilize the company’s Zoox digital ad sales software services. The software is designed to help maximize digital advertising inventory by automating sales planning, proposal building and tracking and organizing deals.
 

~ TECHNOLOGY DEALS, MERGERS AND SKIRMISHES ~

 
The Dept. of Justice is looking into hardball tactics deployed by Apple against competitor Amazon in its digital music business, per the NYTimes. Citing sources close to the investigation, the report says that Apple threatened to withdraw marketing support of new releases on the iTunes store from companies who participated in Amazon’s “MP3 Daily Deal” promotion. The idea was to give Amazon an exclusive 24-hour window to select new releases before being made available to other online outlets.
 
The FCC released a Notice of Inquiry (NOI) as part of the 2010 quadrennial review of its media ownership rule. The NOI specifically asks for input on a number of issues, including:

  • Whether the current rules continue to foster competition, localism, and diversity
  • How to define, measure, and promote competition, localism, and diversity and how ownership structure affects these goals, and
  • How to weigh these public interest goals if they conflict with each other

 
Apple officially surpassed Microsoft as the most highly valued Tech firm on Wall Street on Wed. with mkt. cap of $227 billion, per the WSJ.
 
Netflix has signed deal to utilize Microsoft‘s PlayReady DRM for all its upcoming Netflix-ready devices. Netflix has already been using PlayReady for its PC and Mac streaming applications.
 
The NAB Show is joining with Hemisphere Expo Services, Inc to launch its “Telepresence World” technology at the NAB Show next April. The technology constructs an immersive environment and an interactive experience that makes it seem like viewers are in the same room with executives in remote locations.
 

~ TRENDS, RESEARCH, ETC.  ~

 
Shipments of 3DTVs and Mobile Internet Devices/Tablets are set to balloon by 142% and 231%, respectively between 2010 and 2011, reports In-Stat in a new CE device report. Other projected trends include:

  • The US installed base for smartphones to reach 198 million by 2013
  • Mobile PCs will continue to lead the computing category in units shipped through 2013
  • maturing segments such as portable media players (PMPs) and desktop PCs will show declining growth rates through 2013

 

~ GADGETS & APPS ~

 
The Wired iPad app Conde Nast demonstrated in March has arrived on the iTunes store, featuring custom-made interactive content including video, slide shows, music and maps. Editorial features of the inaugural digital edition include an interactive history of the Mars landings and an audio-powered look inside Trent Reznor’s recording studio. The app sells for $4.99 and is Conde Nast’s 3rd digital edition, following iPhone/iPad releases for GQ and Vanity Fair.
 
Hillcrest Labs, maker of the innovative Loop pointer wireless remote, released a new version of its Mozilla-based Kylo web browser for the TV that includes, among other features, a plug-in for use in Windows Media Center and the ability to configure Kylo’s settings in order to access web pages designed for other hardware platforms. The new release, once again, allows users to connect to Hulu programming through a browser (after Hulu blocked the initial release of Kylo.) Hillcrest is currently running a special on the Loop pointer used to navigate Kylo, halving the price to $49 through June 11.
 
Actor Genie is a new iPhone app from casting director Hedi Levitt designed to be a directory for actors to point them to who’s casting what in New York and LA. There’s also an industry news section, a casting, talent, management directory and useful tips on how to make it in the biz. It sells for $9.99.
 

~ EXECUTIVE MOVES ~

 
Ryan Osborn has been promoted to Director of Social Media for NBC News. He is charged with overseeing and executing all social media initiatives for the news division to increase awareness of show programming, interactivity with viewers, and outreach to target audience groups.
 
FishBowl Worldwide Media announced the appointment of former William Morris Agency Head of Television Business Affairs Susan Brooks as General Counsel and EVP/Business Affairs.
 
Simulmedia
has named Courtenay Harry to the newly-created position of VP/Product Marketing Sales. She will be based in the company’s Manhattan headquarters and report to Jeff Storan, VP/Product Management.
 
Former WPP and Gartner digital marketing executive Jason Brandt has been named by New York-based digital marketing firm Zemoga as Head of Client Strategy and Development.
 
Multiplatform media firm Cross MediaWorks has tapped Jim Shaffer as Special Advisor and he will serve on the company’s advisory board.


~ WEBSITE OF THE DAY ~

 
Making good on his promise, Facebook CEO Mark Zuckerberg unveiled new privacy settings that will come into effect in the coming weeks designed to make it easier to prevent wholesale sharing of users’ private information on the wildly popular social network. (This blog post lays out the changes in detail.) He announced 3 principle changes: Facebook will basically streamline its privacy settings control panel to allow you to more easily choose who can access your content and settings. The amount of basic info available to everyone has also been pared back and the ability to block info from third party apps will be clearly labeled, including offering the option to disable “instant personalization” completely. This new Privacy Page goes into more detail, suggesting, of course, that you choose to share everything with everyone. Now the question remains whether or not the new changes will appease concerned lawmakers who have questioned how Facebook handles users private data and prevent users from fleeing the service en masse. Zuckerberg said yesterday that almost 500 million users have signed on to use Facebook to date, but defections among influential users have been picking up steam.
