Google won its knock-down drag out legal battle with Viacom on Wednesday after 3 years in court as a federal judge dismissed the case, ruling that YouTube’s actions indeed fall under the Digital Millennium Copyright Act signed into law in 1998. Judge Louis Stanton wrote that, although YouTube practically “welcomed” users to upload copyright-infringing material, it also swiftly removed the offending clips when notified by Viacom – noting that 100,000 Viacom videos were removed in a single day after the company sent a mass takedown notice to the video sharing site in Feb. 2007. Viacom, which was seeking $1 billion in damages, vowed to appeal the ruling, describing it as “fundamentally flawed.”
Not exactly faster than a speeding bullet when it comes to migrating to digital platforms, D.C. Comics has struck a partnership with digital comics distributor ComiXology and Warner Bros. Digital Distribution to leap into the space with PlayStation Networks editions for the PSP and a new iPhone/iPad app featuring content from all of DC’s brands including DCU, Wildstorm and Vertigo. The app and PSP storefront allows you to purchase dozens of individual titles, priced between .99 and $2.99/issue, including Action Comics, Green Lantern and Batman. DC and ComiXology will also launch an online storefront at dccomics.com later this year.
Hulu is negotiating with CBS Corp., Viacom and Time Warner to add the companies’ TV shows to its platform as it prepares to roll out a paid subscription service, per Bloomberg, sourcing “people with direct knowledge of the discussions.” Hulu is offering a share of the subscription revenue to include both broadcast and cable shows in the mix. CBS is the only top 4 broadcast network that has not bought into the service.
Starz‘ new Starz in Black HD and Starz Cinema HD channels have signed their first carriage deals, landing on DirecTV as part of the Starz Super Pack.
A new video sharing website and iPhone app called VidMe launched in beta this week founded by former Hollywood agent Greg Siegel (Endeavor) with the tagline, “Live Life, Share Private.” The site is a simple registration-required conduit allowing you to send videos to friends using a virtual vault; the videos cannot be shared, forwarded or downloaded without the creator’s express permission. For instance, cutting and pasting the link at which it resides will not work unless the recipient has been invited. The iPhone app allows you to upload videos or watch videos you’re invited to view from the Safari web browser. For now the site is free but credits will be required for future sharing, available in blocks at “reasonable prices, according to Mr. Siegel, who sees demand for private video sharing growing as the Facebook generation transitions into the job market and finds they have more to lose. “I feel like the awakening (to the importance of protecting yourself online) is already underway,” he said.

Break Media, one of the many ad networks that has focused on the guy demo, has added 23 new categories, many of which focus on the softer side of the web including Shopping, Parenting, Casual Gaming, College, Auto and Travel. A sampling of new partner sites include live video portal Justin.tv, science and health site RedOrbit and family/tween gaming portal Spil Games. The new sites will expand Break’s reach to nearly 110 million uniques, according to ComScore’s May 2010 metrics.
Microsoft and Chevy announced a new ad campaign centered around an advergame that allows users to test drive the electric Volt utilizing Microsoft’s upcoming Kinect motion controller for the Xbox 360. The campaign was put together by Starcom via Microsoft Advertising and will involve social networking, mobile and Microsoft Surface integrations.
Leo Burnett‘s office in Sydney Australia won a Grand Prix Media award at the Cannes Lions International Advertising Festival for Best Use of Social Media Marketing in its Canon EOS campaign. Online users were encouraged to upload pictures via social networking services to form online “photo chains” on Canon’s Aussie site, resulting in over 20,000 submissions to date.
The San Francisco Board of Supervisors voted 10-1 in favor of a new ordinance to require cell phone retailers to disclose how much radiation their phones emit during use. The law, which requires companies to post “specific absorption rates” (SAR), goes into effect next February for lager chains and will be the country’s first such law on the books.
Interest in interactive TV apps is at an all-time high as TV viewers hearken to have the same kind of experiences in front of their televisions as they’re accustomed to having online, according to a new 500 person survey conducted by Penn Schoen Berland on behalf of iTV vendor FourthWall Media. Two-thirds (66%) of TV watchers, including 72% of females and 74% of girls 13 to 20, agree they would change the way they watch TV programming if they had access to iTV applications. Another 34% said they would watch more television than they currently do if they had access to iTV apps. Apps that deliver immersive experiences or convenient shortcuts proved to be the most in demand:
TV watchers were most interested in a weather application (52% very interested), followed by an application providing local news and information (47% very interested) and caller ID (44% very interested)
- 61% of viewers said they preferred to submit votes to shows like American Idol via their remote control
- 73% say they would be interested in an application that allows them to request additional information about a company or product after watching a commercial
- Of the 82% of TV viewers who say they surf the internet on their computers while watching TV, 31% say they would spend less time doing so if they had these apps on TV
Seventy-nine percent of regular social networkers say they would be likely to watch a TV show based on a recommendation from a friend via a social networking site, according to a new CTAM survey. Another 33% of the 1,500 regular social networking respondents said they were made aware of a new television show because of something they saw on a social networking site.
ComScore is changing the way it tabulates video views and video consumption, separating out ads from content for the first time beginning this June, reports Beet.tv. The separation will be achieved through tagging directly from clients and by maintaining an ongoing database to index videos against. The new data pool should help ComScore drill down more deeply into engagement and usage metrics, according to Tania Yuki, Senior Product Director at ComScore.
The much-anticipated free Google Voice web based communications platform officially launched in the U.S., allowing users to consolidate multiple phone numbers into a single online account that will transcribe voice mails. Other features include call blocking, conference calling, personalized greetings, etc.
Qualcomm’s FLO TV service has integrated with another device via the AT&T Mobile TV service – the LG Vu Plus, a messaging phone featuring a full QWERTY keyboard and sliding touchscreen display. FLO says it is seeing record viewership around ESPN’s coverage of the World Cup; the recent South Africa/Mexico match was the most watched sporting event ever on the service, with 80% of Flo TV subscribers tuning into the match.
Art-themed channel Ovation and L.A.-based publisher ForYourArt have launched a new IPhone/iPad app to showcase a concept from contemporary artist John Baldessari. Available for free on in-still-life.com, users are invited to arrange the 38 objects in Abraham van Beyeren’s Banquet Still Life (1667) to create their own montage and share their still life on a dedicated Flickr site, Facebook and various other social networks.
ContextWeb Founder Jeremy Sterns was named Chief Technical Officer of video ad platform AdGenesis and sister company Beezag while Tremor Media Founder Andrew Reis has joined the company’s Executive Council.
Online display ad firm Rocket Fuel Inc. hired former Havas Digital executive Jarvis Mak as VP/Analytics. Stanford computer science professor Yoav Shoham has also joined the company’s Advisory Board.
America’s Got Talent judge Howie Mandel was tapped to deliver the keynote at NATPE’s fourth annual LATV Fest on Tuesday, July 13.
Is it a video portal or a search engine? Microsoft‘s “decision engine” Bing rolled out a new Entertainment section late Tuesday allowing users to watch click-to-play TV show episodes, view movies, listen to music and play casual games directly from the search page. The new feature is part of an update designed to improve engagement on the site, including the introduction of new tabs at the top of Bing pages built to drive “best and relevant” search results to users. For instance, a visit to the information-packed Bing News section reveals tabs for World News, Business News, Entertainment News, Sci/Tech, ect. at the top. Bing is also chasing the socially obsessed crowd, tracking top social topics and shared links and displaying visual search galleries of the top Twitter users. But it’s really been Entertainment content that has helped Bing carve out a valuable niche in the search market, with entertainment related searches accounting for 10% of Bing’s overall queries, according to Satya Nadella, SVP of Microsoft’s Online Services Division. There was talk at E3 this year of Microsoft migrating the Bing experience over the Xbox 360 platform later this year, a move that would help improve Bing’s street cred immensely.
