Good Morning. It’s Thursday, June 1, 2006, and this is your first early morning briefing.

CBS tried again, and again the answer was no.  The FCC turned down the network’s challenge of the $550,000 fine resulting from the now infamous wardrobe malfunction during the 2004 Superbowl halftime show.  CBS claimed the broadcast was not indecent based on the current FCC definition, which the network says is too vague.  The FCC’s statement read in part: “The Commission rejects CBS’ argument that the FCC’s indecency framework is unconstitutionally vague and overly broad, both on its face and as applied to the halftime show.”  CBS says it will continue to pursue. Now that the appeals process is over, the next step for CBS will be to file suit in court.

* MORE GOOD STUFF *

Here’s one of those things that makes you think – didn’t they do this already?  Legendary Pictures has optioned the film rights to the original Kung-Fu television series with plans of making it into a feature film. The film would focus on the earliest part of the TV series – that portion based in China and focusing on the training of Kwai Chang Caine (played in the TV show by David Carradine).  Legendary has a first-look deal with Warner Bros., so once the screenplay is completed, that’s where it will be taken first.  Warner Bros. is also the studio who produced the series in the 1970’s. As far as Carradine, he will not be involved.
 
USA Network will launch Character Road Trip in October, one of two short form programs which will debut as an extension for the network’s Characters Welcome brand. Produced by Magical Elves, there will be forty 5-minute episodes each year, with 10 each quarter, airing as a series of interstitials within a primetime show. Character Road Trip will travel across the country to find the most colorful characters wherever they are. And, the second short form series, Character Fantasy, will be paired with the network’s Saturday afternoon programming, allowing people a chance to portray their favorite character.
 
ION Media Networks will launch the first 24-hour digital broadcast network later this year with programming focused exclusively on consumer healthcare and healthy living. I-Health will premiere on the company’s owned and operated TV stations and a full rollout with additional distribution and content partners will happen in 2007. The content will be education based and feature short form news segments and web-based content about chronic illness, family health issues, medical technologies and breakthroughs, exercise and wellness as well as alternative health.

On November 18, Comic Relief will reconvene after an eight year absence, to raise money to help the children of Hurricane Katrina.  According to Hollywood Reporter, all three of the originals will be on board – Billy Crystal, Robin Williams and Whoopi Goldberg, and the special will be aired simultaneously on HBO, TBS and on AOL.

* PRODUCTION / CASTING / DEVELOPMENT *

 
Sanaa Lathan has been signed to join the cast of FX‘s Nip/Tuck as a young wealthy woman married to man considerably older.  Together, they buy the medical practice of McNamara/Troy. No word yet on the casting of her husband.

Casting Call: Oxygen will introduce a new original series The Bad Girls Club this December. The show is a docu-soap that follows a group of “bad girls” who all live together in L.A. and in order to be in the club they must pledge to help each other change their devilish ways. * EXECUTIVE MOVES *

FOX has a number of new promotions starting with Shannon Ryan to VP/Entertainment Publicity, where she will supervise the network’s publicity staff and will manage all aspects of entertainment publicity including the national publicity campaigns for FOX series and specials; Elissa Johansmeier has been upped to VP/Publicity and Corporate Communications, where she continues to manage the East Coast publicity staff, the New York-based entertainment publicity and communications efforts for the network’s national sales team. Both will report to Joe Earley, EVP/Publicity, Corporate Communications and Creative Services. In addition, the following persons in the publicity staff have been promoted: Jason Clark to Executive Director; Todd Adair, Jill Hudson Bell and Kim Fitzgerald Kurland to Director of Publicity; and Alexandra Gillespie, Joshua Governale and Michael Roach to Manager.

LIME has appointed Barbara Steele as Multi-Platform Producer. She will produce and supervise original content across all platforms for the network including TV, broadband, VOD, DVD, satellite radio, podcasts and mobile. Barbara’s duties will also include writing and producing promotional spots and short form content.

Natasha Fishman has been named VP/Retail Development for HIT Entertainment. She will develop and implement the retail development programs and promotions for the company’s roster of brands. Based in New York, Natasha will also manage the relationships with key buyers and marketers at retail and will report to Jamie Cygielman, SVP/Consumer Products.

Alan Klein has been advanced to SVP/Partnerships and Licensing for the Independent Film Channel (IFC). Alan will become the network’s chief of business development, will continue to direct IFC’s partnerships, manage the sales team and secure new revenue opportunities for the network among other duties. He will continue to report to Evan Shapiro, EVP/General Manager.

Martha Stewart Living Omnimedia, Inc. has hired Richard Claflin as VP/Programming and Broadcasting, where he will oversee the development of original programming for the broadcasting division and will provide creative input for current programming. Jill Boulet-Gercourt also joins as VP/Marketing and Broadcasting, where she will manage all marketing, promotion and creative services for the company’s TV business with emphasis centered on the daytime series Martha.

Janet Fitzpatrick is the new Chief Strategic Officer for Initiative Worldwide. Based in New York, Janet will be in charge of the company’s global development of its strategic products including the Futures research team. She will report to Alec Gerster, CEO.

44 Blue Productions has upped Stuart Zwagil to VP/Production. In his expanded role, he will still supervise daily operations including finance, budgeting, cost control and management, in addition to his new duties of new media, marketing and special projects. Furthermore, the company has reorganized management duties and has promoted Glenn Meehan to VP/Development and Sarah Poage to Executive in Charge of Production.

Tuesday – A18-49 Analysis: NBC pulled off a victory Tuesday night at 3.5/10 A18-49, according to fast affiliate ratings from Nielsen Media Research. CBS was second at 2.6/7, then ABC 1.8/5, FOX 1.8/5, UNIV 1.4/4, WB 0.7/2, UPN 0.6/2 and TELE 0.5/1. The premiere of Last Comic Standing on NBC netted a first place position at 8p with 3.2/10. The second hour of Last Comic Standing won again at 9p with 4.2/11. At 10p, NBC was prevented from earning a clean sweep as the network tied for first with CBS. NBC with an encore Law & Order: SVU and CBS with 48 Hours Mystery each delivered a 3.1/8.
