Good morning. It’s Thursday, July 27, 2006, and this is your first early morning briefing.
In a precedent setting pact, Fox Entertainment Group, MSN, HDNet and G4 will make all three seasons of Arrested Development available online, on hi-def TV and on basic cable at the same time. In a three-year term, MSN will have the portal rights to syndicate the program on the internet. MSN will also produce interactive segments to help build a new audience, and later this year each of the episodes will be streamed on MSN Video and available free on demand to MSN customers. HDNet will air the series exclusively for three years starting this September. The hi-def net is available both via cable and satellite. And, finally G4 has acquired the basic cable rights for the series in a three year deal beginning in October. Arrested Development is produced by Twentieth Century Fox Television and Imagine Entertainment and ran for three years on FOX with 53 episodes in total. To paraphrase Jason Bateman at the Emmys one year, it was the most critically-acclaimed show no one ever saw.

WE tv will premiere its original documentary series Secret Lives of Women on August 1 at 10p. This one-hour series focuses on intimate topics and issues challenging women today. Secret Lives of Women is produced by Kaos Entertainment as well as CBS for two of the episodes.
PBS will now have many of its most popular programs available on the Internet via Google Video, including Antiques Roadshow, Nova, Now and Scientific American Frontiers. Several PBS Kids and PBS Kids Go! shows are also available including Arthur, Cyberchase and Fetch!. PBS is also using this as a fundraising tool, as viewers will be encouraged to become members of their local PBS station in a special spot downloaded with their program.
In a related note, PBS also launched an initiative with Open Media Network (OMN) allowing viewers to download and purchase PBS programs via the internet for viewing on a variety of devices including laptops, portable media players, mobile phones and set top boxes. OMN is a non-profit with a mission to make public broadcasting and educational programming available on the internet via their web site at www.omn.org. Other non-profits and service institutions can utilize this download ownership service free of charge.
The N has ordered a second season of the pro surfing drama Beyond the Break. Ten new half-hour episodes are scheduled to premiere in early 2007. The entire first season of nine episodes will air in a marathon beginning tonight at 8p, all in preparation for the season finale tomorrow night at 830p. The series is produced by MarVista Entertainment, BME and The N.
Mark Burnett and Emilio Estefan have decided to join forces with their launch of a new company, Estefan/Burnett Entertainment. They will work on television, internet and wireless programming development for English-speaking Hispanic viewers with crossover appeal, says Variety. The company will initially focus on the U.S. market, with international expansion to other Spanish-speaking countries a good possibility in the future. Mark and Emilio will also collaborate on other entertainment-focused initiatives including a partnership with Zumba Fitness, a Latino-leaning exercise company.
A contentious story involving new cable network ReacTV and Nielsen Media Research is unfolding just days before the launch of the network on August 8. Nielsen has officially declined ReacTV’s request to purchase ratings data. ReacTV says that denial is due to public criticism against Nielsen’s methods and management leveled by Frank Maggio, the owner of ReacTV. Maggio, who also owns Nielsen rival erinMedia, says this action by Nielsen is typical of its “capricious monopolistic control over the TV industry” and is threatening action against Nielsen if it doesn’t reverse its decision. Maggio has already filed two federal suits against Nielsen, with depositions in one expected to begin in August. It is not unusual for Nielsen to deny its data to new networks based on size, so says Nielsen spokesman, Jack Loftus. “[Networks] have to reach a significant penetration level before they even start to show up in the national sample. So the smaller guys usually don’t subscribe. So they don’t ask, and if they do, when we explain this, they quickly understand,” says Loftus. Loftus also pointed out that Maggio’s request for ratings data came as a result of the legal process connected to the lawsuit, and that all interaction with Maggio has been through the party’s respective lawyers. That said, this voicemail was left a week ago for ReacTV by Sara Erichson, Nielsen’s GM/National Services: “Given the public statements made by your owner that Nielsen service cannot provide adequate audience information about ReacTV viewers, as well as public disparaging remarks that [Maggio] has made about our services, as well the management at Nielsen at the time, we don’t think it is appropriate to commence a business relationship with ReacTV.” Reportedly, a letter with the same message was sent to ReacTV.
Harmony Channel, a new network designed to elevate the senses, has just launched on Comcast’s Select On Demand networks and is accessed through Comcast’s Music category. Available now to 9 million digital cable Comcast households, Harmony Channel will showcase visual and musical artists through art, cinematography, computer animation and special effects for a virtual “spa experience”. Harmony Channel is free to Comcast digital cable customers in most markets.
Fox has ordered up a comedy pilot called The Nut, penned by Ron Shelton. The story is about a regular guy who is working as hard as he can to stay just a few steps ahead of his bills while taking care of and supporting his slightly off-beat family. The project is being produced by Sony Pictures Television and Krasnoff Foster Entertainment.
NBC has ordered a legal drama script, Anonymous Lawyer which began as a blog by a guy who worked as a summer intern in an NYC lawfirm. The the blog was completely a work of fiction by writer Jeremy Blachman, and was soon published as a book. Rights for the book were then picked up by Krasnoff Foster Entertainment and Sony Pictures Television, and here we are full circle with NBC ordering the script.
HBO plans to move ahead with five episodes of a new project called In Treatment, based on an Israeli show of the same name, according to Hollywood Reporter. The show will be exec produced by Mark Wahlberg, and is about a successful therapist who reveals his less than successful self when he becomes the patient and gets himself a therapist. Production begins next month.
AOL RED and 2C Media, Inc. has announced its production team for Be a RED Star, the new web series, starting with Chris Sloan and Malcolm Bird as Co-Executive Producers; Timothy J. Hamilton, Show Runner; Mark Clark, Producer; Josh Mutchnick, General Manager/RED; Deanna M. Murray, Programming Director/RED; and Rebecca Rosichan, Casting Director.
Tim Healy has been upped to VP/Production at MTV, where he will manage the production of several MTV programs from the network’s Times Square studios including Total Request Live and other specials. He will also oversee production for weekend programming, artists’ specials and events such as MTV’s Spring Break. In addition, he will lead the development of short form programming for the network across multiple platforms.
NBC Universal has made Paula Madison the EVP/Diversity which adds to her current positions of President/General Manager of KNBC and Regional General Manager of KVEA and KWHY. In this new role, Paula will be the liaison to political and public interest groups and will head the company’s diversity initiatives both internally and nationwide.
ABC News has appointed Jim Murphy as Senior Executive Producer/Good Morning America, reporting to Phyllis McGrady, SVP/Morning, Primetime and Development, ABC News. Jim came from CBS where he was News Producer/Executive Producer of The CBS Evening News. Additionally, Tom Cibrowski has been promoted to Executive Producer/GMA starting in September and he will report to Jim Murphy. Both will work in tandem to oversee the daily content and operations of the program.
Shayna Kossove is the new Director/Advertising Sales for CODE TV. Prior to this position, she worked for Conde Nast in L.A. as an Account Executive for Domino and Men’s Vogue.
Tuesday – A18-49 Analysis: Despite a tight race, FOX skated by with a #1 Tuesday night at 2.8/9 A18-49, according to fast affiliate ratings from Nielsen Media Research. NBC fell in second place at 2.7/8, and then right behind was CBS 2.6/8, followed by UNIV 1.6/5, ABC 1.1/3, WB 0.7/2, UPN 0.5/2 and TELE 0.4/1. At 8p, CBS broke from the pack to win with Big Brother with a 2.9/9; while a rerun of House on FOX came in second with a 2.4/8. FOX’s second repeat of House at 9p and NBC’s Last Comic Standing tied, each pulling a with 3.2/9. At 10p NBC led the charge with its encore episode of Law & Order: SVU at 2.8/8.
