Good morning. It’s Thursday, December 7, 2006, a day that will live in infamy, and this is your first early morning briefing. 

Say what you want about the FCC, but don’t say it with profanity. The Commission filed its brief in the Second Circuit Court of Appeals in response to a suit brought by broadcasters (Fox, CBS and NBC) challenging the rulings of the FCC regarding certain incidents of profanity, and claims the FCC’s definition of profanity is vague and changes without notice.  In its response the FCC writes in part: “This case involves only two FCC adjudications – that Fox’s broadcasts of the 2002 and 2003 Billboard Music Awards were indecent and profane. Those adjudications and those adjudications alone are before the court.”  The FCC brief went on to say the court should reject any attempt by the plaintiffs to “change the subject.” Basically, Fox contends the use of profane language in the two live awards shows were “fleeting” expletives, and therefore should be excusable according to previous FCC rulings.   The FCC said its ruling on these two incidents was based on “contemporary community standards,” and you can expect them to find nearly all foul language as profane, particularly at a time of the evening when children could be watching.

A new study on television viewing habits commissioned by Warner Bros. Media Research and conducted by SmithGeiger has just been revealed. The study used online interviews, taken last summer, with 1,500 television viewers across the US. Key findings include:

  • Most TV viewers look to broadcast networks for originals series and to cable networks for acquired programs.
  • During primetime, viewers almost equally turn to cable networks (52%) as to broadcast (48%).
  • Viewers gravitate more to familiar acquired shows versus originals, 93% vs. 46%. When channel surfing, 70% of viewers most often stop on familiar shows.
  • 62% of viewers watch acquired series for the first time on cable networks, and then go back to the original broadcast airings.

The findings support the notion that the most familiar shows on cable are classic acquired series such as Seinfeld, Golden Girls, Full House, The Cosby Show and Friends, which haven’t been on broadcast television for years. These series perform just as well as more recent series like CSI, House and the various Law & Order versions.
 

VOOM HD Networks, available on DISH Network, will debut two new HD series on two of its channels in second quarter 2007:

  • Ultimate Tourist Scams – 13 half-hour episodes for the Equator HD channel alerts travelers to various scams and offers tips. A co-production with the UK-based Electric Sky.
  • Big Boutique in the City – 13 half-hour episodes acquired for the Ultra HD channel looks at the international style of cities worldwide from fashion to lifestyle.


Tribune Company
has finalized the sale of WCWN/Albany to Freedom Communications, Inc. for $17 million in cash. The sale of Tribune’s WLVI/Boston is expected to close this month as well.
 
TV One is approaching the year end with distribution, ratings, and online traffic growth.  The network grew its subscriber base by 39% this year so far, according to Nielsen Media Research universe estimates. Year to year, the young African American network added more than 9.5 million households, growing from 24.3 million to more than 33.8 million households. By year end, TV One will be carried in 45 of the top 50 Nielsen-ranked African American markets.

* BROADBAND & DIGITAL *

 
Meteor Worldwide has developed a new mobile content delivery service called Pliq, which will make its debut in first quarter 2007. In addition, Meteor has made an agreement with Reveille LLC to air original and repurposed television shows via Pliq. Some of the programs will include The Restaurant, 25 Million Dollar Hoax and Meet Mr. Mom.

* PRODUCTION & DEVELOPMENT *

HGTV has deals with Vern Yip and Carter Oosterhouse for both to host new shows in 2007. Yip will return as a judge for the second season of HGTV Design Star and will host his own series set to debut in third quarter. A new show featuring Oosterhouse is in development for fourth quarter. His deal includes a programming partnership with HGTV and DIY Network where he will host a new series on each network.
 
CBS is developing a new primetime game show that will pit adults against kid prodigies in a battle of wits.  The show is from Allison Grodner Prods, and will include a steady cast of genius kids, with a revolving group of adults.  The specifics of the game are still in development, but the goal is to win a million bucks, according to Variety.

ABC has added to the cast of Ugly Betty with the addition of Rebecca Romijn.  Her role will be as a mystery woman looking to take over the company in a conspiracy with Wilhelmina. If you’re a fan, you’ve already seen her on the show, but well hidden behind gauze.

Fox has signed Thomas Dekker to play the role of 15-year old John Connor in its pilot project The Sarah Connor Chronicles, which stars Lena Headey.

Casting Call: CMT is going cross-country for The Ultimate Coyote Ugly Search which will debut its second season in second quarter 2007. One female bartender will receive a prize of $25,000 along with the fame of winning. The next audition date is this Saturday in Charlotte and the final two are in New York City on December 11 and in Ft. Lauderdale on December 14. * EXECUTIVE MOVES *

Turner Broadcasting Inc. has upped Jeff Pomeroy to Senior Director/Public Relations for the Turner Sports unit. Jeff will continue to direct all media relations efforts for Turner Sports which includes the NBA, NASCAR, Major League Baseball and professional golf. Based in Atlanta, he reports to Sal Petruzzi, SVP/Public Relations, Turner Sports and Turner Ad Sales.
 
Susan Butler has been added at E-Poll Market Research as VP/Research. Previously, she was at Synovate Diversity as VP/Research.
 
Rainbow Media has hired Mary-Liz McDonald as VP/Programming and Production for both its on-demand networks Mag Rack and sportskool. In addition, Danielle Montalbano has been promoted to Director/Development and Acquisitions for Mag Rack.
 
The Africa Channel
has appointed Darrell Smith as VP/Community Development and Marketing where he will execute local marketing initiatives for the network and will report to Bob Reid, EVP/GM.
 
Sam Schoemann has joined Concrete Pictures as VP/Client Development. Based in the company’s Santa Monica office, Sam will be charged with developing new revenue outlets, in addition to concentrating on the company’s key business.
 
Turner Network Sales, the domestic distribution, sales and marketing division of Turner Broadcasting System, Inc., has added Kelly Ryan as its VP/Affiliate Ad Sales. Kelly will supervise and create strategies for the affiliate ad sales group, and will also work closely with Turner Broadcasting’s national ad sales team.
 
Barbara Blangiardi has been bumped to SVP/Strategic Marketing for NBC Universal. In this new role, Barbara will head a centralized marketing team which will create programs for marketing clients and advertising agencies.
 
Scott D. Macdonald has been made SVP/Finance, Accounting and Controller for Starz Media, where he will be based at the Starz, LLC office in Englewood, CO, reporting to Glenn Curtis, EVP/CFO, Starz, LLC.
 
IMG has named Douglas Perlman as President/IMG Media, North America, effective January 1. He will report to Theodore J. Forstmann, Chairman/CEO and will oversee IMG Media’s North American projects. In addition, Robert Dalton, current President/IMG Media, North America has been made Chief Creative Officer of IMG Media Worldwide and reports to Forstmann.
 
Warner Bros. Consumer Products (WBCP) has appointed Richard Goldsmith as SVP/New Business Initiatives and Preston Lewis as VP/International Licensing. Furthermore, WBCP has promoted Maribeth Towers-Toth as SVP/New Business Initiatives; Mike Gibbs to VP/Licensing Business Development and Worldwide Brand Assurance; and Patti Buckner to VP/Apparel and Accessories.

Tuesday – A18-49 Analysis: FOX came out best Tuesday night with 3.5/9 A18-49, according to fast affiliate ratings from Nielsen Media Research. ABC was second at 3.0/8, and then NBC 2.7/7, CBS 2.5/7, CW 1.5/4, UNIV 1.5/4 and TELE 0.4/1. At 8p, the long-time holiday favorite Santa Clause is Comin’ to Town on ABC swept into first with 3.9/11. Despite being a rerun, House on FOX beat the competition at 9p with 4.7/12. Then at 10p, NBC’s encore of Law & Order: SVU with a 3.1/9 edged out ABC’s Boston Legal in second at 3.0/8.
