Good morning. It’s Monday, October 16, 2006, and this is your first early morning briefing.

ABC has ordered up a full season of freshman series Ugly Betty. Ugly Betty has averaged #2 among A18-49 on Thursday nights at 8p following Survivor, with a 4.7/13 in the demo and total average viewership of 15.3 million.  It is also the top new series this season among Hispanic viewers who watch English-language TV by averaging 1.13 million total viewers and delivering 3.2/9 among A18-49.

* MORE GOOD STUFF *

Among the list of media giants who are potentially looking to sue YouTube.com for the unauthorized used of their material include NBC Universal, Viacom and News Corp.  Those are all pretty big dudes with pretty deep pockets to have ticked off at you. The legal eagles at each of these outfits have uniformly decided that a copyright penalty of $150,000 per each unauthorized video sounds about right, according to a story in today’s Wall Street Journal. Meanwhile, others argue YouTube.com is protected under the Digital Millennium Copyright Act of 1998 that basically says they have to take down a video upon receiving notice from the copyright holder. While these legal conversations are continuing, each of the three are also having their own content chats with the folks at YouTube.com about running their programming in exchange for a piece of the revenue pie, and some have already been successful in arriving at terms – CBS, NBC Universal and several music companies. YouTube.com is in the process of being purchased by Google for the amazing amount of $1.65 billion dollars.

Fox Baseball commentator Steve Lyons was fired after Game 3 of the ALCS game after making an inappropriate comment about former baseball manager and now Fox analyst Lou Piniella.  Stepping in to cover Lyons seat in the booth for the remainder of the series is Jose Mota, Los Angeles Angels announcer.  The comment came after Piniella equated asking a player to repeat a great performance night after night is like “finding a wallet on a Friday night” and hoping to find another on Sunday and Monday as well.  Shortly thereafter, Piniella used a Spanish term, “en fuego” describing a player’s hot performance in the playoffs, and Lyons followed with this comment:  “Lou’s habla-ing some Espanol there, and I’m still looking for my wallet. I don’t understand him, and I don’t want to sit close to him now.”  Fox executives informed Lyons of their decision shortly after the game.

Just in time for Halloween, VH1 has a new series that sends celebrities to haunted places in Celebrity Paranormal Project, set to debut October 22 at 10p. Each episode follows a team of five celebrities who will be left alone in a haunted location, armed with the latest in paranormal technology tools, cameras and recorders until sunrise to document any potential ghostly activity. The celebrity participants include Christopher Knight, Rachel Hunter, Gilbert Gottfried, Gary Busey among others. The series is from Mindless Entertainment and 51 Pictures.

* PRODUCTION & DEVELOPMENT *

ABC has a new production in the works – October Road.  Ordering six episodes, the series may show up on the either the spring or summer schedule.  The story is about a young novelist who returns to his hometown to teach at the local college.  The project is from Touchstone TV and GroupM Entertainment.  GroupM is made up of ad agencies Mediaedge:cia, Mindshare and Mediacom, and the three agencies will have a time bank of ad spots for use for their clients.

Also at ABC, Touchstone TV has signed a talent holding deal with Amy Brenneman for a project perhaps for the Fall 2007 schedule, according to Hollywood Reporter.

A handful of projects at The CW:

  • Ghosts from writer Adam Mazer, has received a put pilot order and it’s about a group of 20-something FBI agents who work in a special surveillance unit. The project is from Catapult Prods. 
  • A script order has been given to The Good Ship, about a Navy ship that goes to areas of the world where medical care is needed.  The story revolves around the medical civilians and military crew aboard the ship. 
  • An untitled family drama about an extended family, as seen through the eyes of the teenage daughter and her video blog.
  • A comedy with a working title of Steps has been picked up and given a put-pilot commitment.  The 60m project is from writer and co-creator of the sitcom Friends Marta Kauffman and Warner Bros. TV.  The project is based in a dance studio and focuses on the lives of the young dancers, some talented, some not so much, but all looking to add a little grace to their lives.
  • And back into development Rod Lurie’s Capital City, a pilot originally developed in 2004 for ABC. Per Hollywood Reporter, this project will be co-produced by Dreamworks, and the project is still at Touchstone TV where Lurie will produce through his Battle Plan Prods. The story is about a young woman navigating her way through the political world.

CBS is looking at a project from Jerry Bruckheimer and Danny Cannon, described in Variety as a National Treasure-esque adventure series in which archeologists are hired to find artifacts.  The project will be produced by Warner Bros. TV and Jerry Bruckheimer TV.

NBC has a new project called Life or Death, a medical drama from NBC Universal TV Studios, and current Law & Order SVU showrunner Neal Baer and writer Dawn DeNoon. The story revolves around two neighboring hospitals – one a city hospital, the other a private facility, both based in LA, and a surgeon who works at both.  Variety says Baer intends to stick with L&O: SVU even if this project is picked up.

Tim Matheson has been cast in USA Network‘s To Love and Die in LA.  The story is about a young woman who travels to LA to find her long lost father.  She discovers her dad is a hired assassin, and she also discovers that this just may be the right job for her as well.  Matheson stars as the assassin/father and playing the daughter/assassin wannabe is Shiri Appleby.

Casting Call: The fifth season of A&E Network’s Find and Design is looking for personable couples of any sort, of all ages and ethnicities who live in Nashville and have a room in desperate need of a cosmetic redesign. Couples will be given a cash budget and will work with a celebrity designer over a four-day period to put the room together. All types of rooms will be considered, except kitchens and baths. Bruce Angeli has accepted a new position as NY Manager/Strategic Accounts at Internet Broadcasting.
 
Comcast Corporation has upped Ted Harbert, President/CEO of E! Networks’ to President/CEO of Comcast Entertainment Group, a new division which will oversee Comcast’s West Coast entertainment properties that include E! Entertainment Television, Style Network and G4. Neal Tiles will retain his position as President of G4. Ted will step into his new role immediately, and it is expected that consolidation to Comcast Entertainment Group will be completed next year.

Thursday – A18-49 Analysis:  ABC eked out the win on Thursday night with 5.7/15 A18-49, according to fast affiliate ratings from Nielsen Media Research. CBS was a very close second at 5.6/15, and then NBC 4.3/11, FOX 2.4/6, CW 1.9/5, UNIV 1.6/4 and TELE 0.4/1. CBS’ Survivor: Cook Islands took the 8p hour at 5.4/15, with ABC’s Ugly Betty in second at 4.2/12. ABC then won at 9p by a healthy margin with Grey’s Anatomy at 9.3/22. Then at 10p, the evening’s second medical drama, NBC’s ER, kept its time period advantage by winning with 5.9/16, with CBS’s Shark in second at 4.0/11 and ABC’s Six Degrees in third with 3.7/10.

Friday – A18-49 Analysis: It was a lucky night for NBC as the network was #1 Friday with 3.4/11 A18-49, according to fast affiliate ratings from Nielsen Media Research. CBS was #2 with 2.8/9, and then came FOX 2.5/8, ABC 2.1/7, UNIV 1.4/4, CW 1.3/4 and TELE 0.4/1. NBC’s Deal or No Deal won the 8p hour with 3.2/11, followed by Ghost Whisperer on CBS at 2.8/10. The series premiere of 1 vs. 100 on NBC came out on top well ahead of the other nets at 4.1/13. At 10p CBS barely wedged in a win with Numb3rs at 3.0/9, a tenth of a rating point ahead of NBC’s Law & Order and the MLB NLCS game #2 on FOX at 2.9/9 each.
