Good Morning.  It’s Monday, January 28, 2008, and this is your first early morning briefing, coming to you all this week from the 2008 NATPE Convention in Las Vegas.

On Friday, the FCC fined 52 ABC affiliates $1.4 million for airing a brief nude scene contained in a 2003 NYPD Blue episode. The ABC affiliates which were targeted are located in the Central and Mountain time zones and therefore aired the episode before the 10p hour. In a statement released by ABC, the network said the FCC’s ruling is “inconsistent with prior precedent from the Commission, the indecency statute, and the First Amendment, and we intend to oppose the proposed fine.” The network further stated it broadcast NYPD Blue with “appropriate parental warnings as well as V-chip enabled program ratings from the time such ratings were implemented.”

News from NATPE:

  • The Ski Channel, the VOD mountain sports network set to launch the first half of this year, made a long-term distribution partnership deal with Cox Communications. The agreement puts The Ski Channel on all Cox VOD enabled systems, and the added subscribers will put the network in at least 13 million cable households. The network expects to have more than 20 million households at launch time. The network has also created The Ski Channel Film Festival featuring celebrities, a red carpet and films and programming focused on various mountain sports genres. The network is currently talking with U.S.-based ski resorts and mountain towns to find a host location.  If you’re in Vegas for the NATPE convention, be sure to check out Ski’s interactive media boards – wild stuff!
  • Producer and syndicator Connection III Entertainment Corp.’s news magazine series Made In Hollywood, currently in its third season, is available in 77.9 million homes and has been sold in more than 75% of the US. Recent clearances and renewals on stations in broadcast groups include ABC, CBS, Hearst-Argyle, Belo, McGraw Hill, Gannett and Sinclair.
  • Timeless International received green lights in syndication for American Legacy Television, hosted by Tim Reid; Know Your Heritage, Black College Quiz Show, hosted by Greg Allan Williams; and the 23rd Annual Stellar Music Awards Show, co-hosted by Cece Winans, Kirk Franklin and Byron Cage.
  • Television Syndication Company (TVS) announced its own production, Real Life 101, a weekly hi-def teen series that explores three different professions each episode, has clearances in more than 80% of the U.S. in its eighth season this fall. TVS carries several other E/I series about kids and teens available in syndication:

    • Kid Guides, in its third year, is an action series by kids and for kids that reveals a behind the scenes look at zoos, aquariums and museums; Ultimate Choice where eight young adults engage in challenging adventures and discuss today’s hot topics;
    • What’s Up! Que Pasa, a bi-lingual series for 13-16 year olds that teaches language, cross-cultural awareness and making positive choices;
    • and TVS’ newest E/I program is Jane’s Sew and So that teaches teens how to design and sew their own creations with self-esteem coaching added in.
  • In addition, TVS offers two lifestyle programs, P. Allen Smith Gardens in its eighth year and Junk’d in its fourth year. Correction: in last Friday’s edition, we inadvertently omitted TVS as the distributor of two docu-dramas, The FBI Files and The New Detectives, both produced by New Dominion.

The WGA signed an interim comprehensive deal with RKO Productions, Inc., a subsidiary of RKO Pictures. RKO Productions’ current production schedule will be announced next week and includes several original screen projects in the works. The company also finances, produces and distributes new versions of classic films from RKO’s library of 1,300 films. Terms of this deal are similar to others the WGA recently made with Lionsgate, Marvel Studios, The Weinstein Company and United Artists among others.

BET will debut stage plays for the first time from creator/writer/director/producer, David E. Talbert. After the first one which aired Sunday, others to follow include He Say, She Say on February 10 at 1p and Love On Layaway on February 17 at 1p.

NBC announced a few premiere updates: its online series Quarterlife will air February 18 to February 26 at 10p, then starting March 2 it will air on Sundays at 9p. From Marshall Herskovitz and Edward Zwick, quarterlife is the first network-quality series that was first produced for the internet. NBC has also moved up its premiere dates for Monk and Psych from USA Network to April 6 at 8p and 9p respectively.

CYNOPSIS KIDS – TODAY’S TOP STORYImagi Studios’ has inked a deal with director David Bowers (Flushed Away) to helm it’s CG animated movie adaptation of AstroBoy.  Slated to be release by Warner Bros. and The Weinstein Co. in 2009, Bowers takes over the reins for Astro Boy from Colin Brady (Everyone’s Hero), who had originally been named as director.  Bowers has worked on feature films for Cosgrove Hall, Steven Spielberg’s Amblimation, DreamWorks and Aardman.   Full edition: CYN KIDS.

CYNOPSIS INTERNATIONAL – TODAY’S TOP STORYThe Asian American-targeted AZN Television is being shuttered by Comcast as of April 9.  The reasons given by the parent company were issues picking up advertising revenue and distribution past Comcast’s nearly 13.9 million footprint.  The network’s 15 employees will either be relocated within the Comcast system or let go.  AZN was purchased back in 2004 from Liberty Media.  Asian programming will continue to be offered through International Networks and other indie providers.  The annual Asian Excellence Awards show that AZN broadcasts will air on E! Thursday – A18-49 Analysis:  FOX claimed the top spot Thursday with 3.2/9 A18-49, according to fast affiliate ratings from Nielsen Media Research. At 8p, FOX was head of the pack with Are Your Smarter at 3.2/9. NBC took control the rest of the night as Celebrity Apprentice won at 9p with 3.7/9 and at 10p with Chuck at 2.9/8 which was just a smidge in front of CBS’ Without a Trace encore at 2.8/8.

At 9p, FOX claimed the same ratings, winning with its House repeat at 2.3/7. It was back to NBC for the last hour as Las Vegas delivered the winning numbers at 2.1/6.

Saturday – A18-49 Analysis:  FOX’s “bad boy” line-up won Saturday night with 2.2/7 A18-49, according to fast affiliate ratings from Nielsen Media Research. FOX took the lead the first two hours as the back-to-back Cops episodes averaged a 2.1/7 at 8p and America’s Most Wanted did a 2.2/6 at 9p. Then at 10p, ABC’s movie repeat looked good at #1 with 2.0/6.

Connection III Entertainment Corp. added industry veteran Bill Trotter as NSM, coming from Trifecta Media & Entertainment where he was Head/Sales.

Regent Worldwide Sales, the sales arm of Regent Entertainment, promoted Meggan Kimberley and hired Adam Wright as Co-Presidents. Jointly they will share all management and distribution efforts and duties.

Worcester, MA-based Davis Advertising added Ami Cadugan as Media Buyer for TV, radio, print, online and to handle SEO/SEM for the agency’s clients. Ami will report to Ben Thaler, Media Director.

Christina Wayne advanced to SVP/Scripted Series and Mini-Series at AMC. In her new role, Christina will supervise all development of the network’s original series and movies, working in tandem with creators and writers to find and nurture projects for production. Both Christina and Vlad Wolynetz, VP/Production will report direct to Charlie Collier, EVP/GM, AMC.

Crocmedia America tapped Amy Prenner as VP/Communications, West Coast to head up the company’s Los Angeles public relations division. Amy joins from The Ellen DeGeneres Show where she was Unit Publicist and handled daily publicity efforts and Ellen’s public role during the writer’s strike. In its Australian office, Crocmedia also hired sports journalist Frances Murphy as Program Director/Media Training.

National Public Radio’s former SVP/Programming, Jay Kernis, left radio for CNN/US to become the news network’s Managing Editor. Based at the CNN/US office in New York, Jay will oversee content development and will be responsible for news planning, health, technology and environment, entertainment and guest bookings. Starting in his new position February 4, he will report to Nancy Lane, SVP/Editorial, CNN/US. Way to go, Jay!
