Good Morning.  It’s Monday, April 7, 2008, and this is your first early morning briefing, coming to you from Cannes, France, at the MIP TV market! And if you prefer to watch this morning’s news instead of reading it, click here.

On Friday, the Justice Department filed a lawsuit in the U.S. District Court for the District of Columbia against eight FOX-owned or affiliated stations to collect indecency fines totaling $56,000 associated with a 2003 airing of Married by America.  Originally in October 2004 the FCC fined 169 FOX affiliated stations over this particular episode totaling $1.2 million. After FOX challenged this action, the FCC last month dropped all fines except those against 13 stations that had collected viewer complaints which lowered the fine amount to $91,000. FOX balked at paying the fine, citing the FCC’s ruling was “arbitrary and capricious, inconsistent with precedent and patently unconstitutional.” Since February, four stations went ahead and paid the fine and one was dropped, leaving eight stations (five owned by FOX and 3 owned by Sinclair) in violation and the $56,000 total due. Also on Friday, the FCC rejected another appeal from FOX to have the fines revoked saying FOX failed to file a request to exceed the page limit of the petition at least 10 days prior to the filing. Previously, the FCC did not take issue with FOX for failing to follow directions on another filing on the same complaint, when the network exceeded the page limit and did not provide 10 days notice.

Trifecta Entertainment & Media renewed the 60m syndicated show American Idol Rewind for a weekend time slot in more than 80% of the US. Stations clearing the program include those owned and operated by Fox and Tribune along with others from Meredith, Raycom, Belo, Clear Channel/Freeport.

Bravo’s Thursday night finale of Make Me A Supermodel drew in 899,000 A18-49 viewers and 1.3 million total viewers. Then Bravo’s series premiere of Step It Up & Dance (11p) had 574,000 A18-49 viewers as well as 826,000 total viewers.

Spike TV’s series premiere of DEA last Wednesday (11p) posted a 1.2 rating with 679,000 viewers among M-18-49 and a 1.2 rating with 341,000 viewers among M18-34.  Elsewhere at Spike, the network has picked up the off-net series Married … with Children, distributed by Sony Pictures TV. The sitcom will join the schedule this fall. According to Variety, the deal will cost Spike $12 million for its 5-year license to air all 257 episodes.  And finally, in the re-edited and updated version of Unsolved Mysteries distributed by HBO and set to air on Spike beginning in October, Dennis Farina has been engaged to host.

Oscar winning actor Charlton Heston, 84, died Saturday night at his home in Beverly Hills. Heston’s roster of roles and films include Ben-Hur for which he won the best actor Oscar in 1959; Moses in The Ten Commandments; Michelangelo in The Agony and the Ecstasy; and the title role in El Cid. During his career, Heston served as president of the Screen Actors Guild and chairman of the American Film Institute. In 1998, he also was elected president of the National Rifle Association for five years, during which he posed for well-remembered ads holding a rifle.

Equity Media Holdings Corporation’s subsidiary, EBC Southwest Florida, Inc. will sell five Southwest Florida low power and Class A televisions stations to Luken Communications, LLC. The $8 million transaction includes stations WUVF-CA, WLZE-LP, WBSP-CA, WEVU-CA and WTLE-LP. Equity Media also owns Retro Television Network.

here! made a development agreement with Elizabeth Keener (The L Word) to star in a new 60m drama series, and she will also be involved with developing the series along with the network. The drama is about a lesbian FBI agent played by Elizabeth who is sent undercover to a small town full of mystery and strange happenings. here! also tapped actress Julie Brown as one of the stars for its new campy soap opera Paradise Falls premiering this Friday. Julie will portray Mimi, a film diva who arrives in the town and promotes trouble.

MSG Network will introduce MSG at the Movies, adding films to its programming lineup.  Don’t worry sports fans, the network vows to remain 75% sports programming, reports Variety.  Among the film titles the network has picked up are Requiem for a Heavyweight, All the Right Moves, Girlfight, Sunset Park and Gracie.

Amid reports it would not reach its $1 billion revenue target for 2008, Fox Interactive Media announced an executive ranks shakeup as well as a new advertising network designed to offer advertisers “HyperTargeting” capabilities. FIM EVP/Technology & Production Adam Bain will take the reigns as President of the FIM Audience Network. CYNOPSIS KIDS – TODAY’S TOP STORYChorion signs a deal with UK broadcaster Five for the 3d CGI animated series Olivia (52×11).  Animated by Brown Bag Films, the series is currently in production and will air as part of Five’s Milkshake! programming block beginning fall 2008.  Commissioned by Nick Jr. (US), is based on author/illustrator Ian Falconer’s Olivia books.  Additional new international pre-sales for the preschool series include deals with ABC (Australia), YLE (Finland), SVT (Sweden), NRK (Norway) and RUV (Iceland). CYNOPSIS INTERNATIONAL – TODAY’S TOP STORY: Echo Bridge Entertainment (EBE) has signed on the dotted line to acquire Alliance Atlantis International Distribution (AAID) from Goldman Sachs Capital Partners through a share purchase. EBE will distribute rights to first run and catalog programming from AAID internationally, excluding Canada. The agreement is expected to close in the next 3 weeks.  The buy will add close to 7,500 titles and more than 5,500 hours of programming to EBE’s current catalog of over 3,500 titles.   With the new acquisition, international program sales efforts will be headed up by Daniel March, EBE’s EVP.  In the U.S. home entertainment market, new titles will be distributed by Echo Bridge Home Entertainment Co-Presidents, Nate Hart and Mike Newcomb.  Kevin Tannehill, Head/Domestic Television, will manage all U.S. TV, VOD and digital sales. Tribune Broadcasting appointed Bob Ramsey as VP/GM of Fox affiliate KTXL/Sacramento. Bob succeeds 20-year veteran Audrey Farrington, who announced her resignation from this position. Previously, Bob was VP/GM at KSWB/San Diego. Way to go, Bob!

Comcast Spotlight, the advertising sales unit of Comcast Cable advanced several staffers: Steve Feingld to SVP/Operations and Strategic Planning; Vicki Lins to SVP/Marketing and Communications; and Paul Woidke to SVP/Technology. All three report to Charlie Thurston, President, Comcast Spotlight. Additionally, Kevin Cuddihy was upped to SVP/Advertising Sales and will report to Hank Oster, SVP/GM, Comcast Spotlight.
