Good Morning.  It’s Friday, November 30, 2007 and this is your first early morning briefing. 

November Sweep Highlights for 4 Broadcast Networks – ABC, CBS, FOX and NBC, 11/1-11/28/07:  ABC won the A18-49 demo, ABC and CBS tie with A25-54, and CBS as usual led in the total viewer category:
A18-49: ABC 3.7/10 (-8% vs. Nov 2006 sweep), CBS 3.4/9 (-8%), NBC 3.2/9 (-14%), Fox 3.1/8 (+3%)
A25-54: ABC 4.3/11 (+3% vs. Nov 2006 sweep), CBS 4.3/11 (-10%), NBC 3.6/9 (-16%), Fox 3.2/8 (+3%)
Total Viewers: CBS 12.01 million (-7% vs. Nov 2006 sweep), ABC 11.53 million (flat), NBC 8.51 million (-18%), Fox 7.88 million (+8%)

~ MORE GOOD STUFF ~

The news blackout has been lifted and statements were released late Thursday by both sides – the AMPTP and the WGA.  The AMPTP offered a new contract to the WGA containing clauses covering several areas of new media including streaming, content made for new media and programming delivered over digital broadcast channels. The AMPTP claims the entire value of the “New Economic Partnership” will deliver more than $130 million in additional compensation, though it’s unclear whether that’s per year or over the 3-year life of the contract. WGA is taking a close look at the proposal, but initially has categorized it as a “massive rollback.”  Meanwhile, WGA also presented the justification for their economic proposal on Wednesday which could cost the industry $151 million over three years, representing what WGA says is a 3% increase.  More on all this when the talks resume on Tuesday.  Here are excerpts of the statements provided by both sides:

AMPTP:

The AMPTP today unveiled a New Economic Partnership to the WGA, which includes groundbreaking moves in several areas of new media, including streaming, content made for new media and programming delivered over digital broadcast channels.  The entire value of the New Economic Partnership will deliver more than $130 million in additional compensation above and beyond the more than $1.3 billion writers already receive each year.  In response, the WGA has asked for time to study the proposals. … talks [resume] on Tuesday, December 4.
 

WGA’s responds first to the AMPTP proposal and then talks of their proposal presented on Wednesday:

Thursday morning, the first new proposal was finally presented to us.  It dealt only with streaming and made-for-Internet jurisdiction, and it amounts to a massive rollback.
 
For streaming television episodes, the companies proposed a residual structure of a single fixed payment of less than $250 for a year’s reuse of an hour-long program (compared to over $20,000 payable for a network rerun).  For theatrical product they are offering no residuals whatsoever for streaming.
 
For made-for-Internet material, they offered minimums that would allow a studio to produce up to a 15 minute episode of network-derived web content for a script fee of $1300.  They continued to refuse to grant jurisdiction over original content for the Internet.
 
In their new proposal, they made absolutely no move on the download formula (which they propose to pay at the DVD rate), and continue to assert that they can deem any reuse “promotional,” and pay no residual (even if they replay the entire film or TV episode and even if they make money). …

On Wednesday we presented a comprehensive economic justification for our proposals.  Our entire package would cost this industry $151 million over three years.  That’s a little over a 3% increase in writer earnings each year, while company revenues are projected to grow at a rate of 10%.  We are falling behind.
 
For Sony, this entire deal would cost $1.68 million per year.  For Disney $6.25 million.  Paramount and CBS would each pay about $4.66 million, Warner about $11.2 million, Fox $6.04 million, and NBC/Universal $7.44 million.  MGM would pay $320,000 and the entire universe of remaining companies would assume the remainder of about $8.3 million per year.  As we’ve stated repeatedly, our proposals are more than reasonable and the companies have no excuse for denying it.

Conan O’Brien will pay the salaries of his nearly 80 non-writing staff members of his show for the immediate future out of his own bank account. David Letterman’s company Worldwide Pants likewise is paying the non-writing staffers of The Late Show with David Letterman and The Late Late Show with Craig Ferguson. Staffers at NBC’s The Tonight Show with Jay Leno, however, will be laid off as of today. NBC had agreed to pay Tonight Show non-writing production staff through the end of November. As to the production staff of Saturday Night Live were laid off in the third week of the strike.

A tentative deal has been struck between the Writers Guild of America, East (WGAE) and ABC concerning approximately 250 ABC news writing employees who have been working under an expired contract since January 31, 2005. The deal the WGAE/ABC negotiating committee came up with will be voted on by members during meetings in New York and Washington, D.C. December 13.

Telemundo will debut Victoria, a story about an older woman who finds a second chance at love with a younger man. The telenovela starts off on December 4 at 9p.

A couple of premiere dates for you, courtesy of NBCAmerican Gladiators kicks off on January 6 with a two hour premiere, and then settle into its Monday 8p time period the following evening. (Chuck gets sidelined while the writers’ strike continues.) Celebrity Apprentice debuts on January 3rd at 8p (but you knew that already). 1 vs. 100 returns on January 4th at 8p, replacing the second weekly airing of Deal or No Deal.  And The Biggest Loser‘s current cycle has its finale scheduled for December 18th, and the fifth cycle begins on January 1st (with New Year’s resolutions?) at 8pm.

Viacom’s Logo is moving forward with three new reality series:

  • Transamerican Love Story – an eight-episode, one-hour dating competition series about transgender activist/artist/actress/author Calpernia Addams and her quest to find love. The show will include online voting through LOGOonline.com, however, Calpernia will get to ultimately decide. The series will premiere in February and is produced by World of Wonder Productions and Oh Really! Productions.
  • Gimme Sugar – six 30m episodes about five women looking for love in L.A. and trying to promote their own night club act. Debuting in summer 2008, this series is produced by Stone & Company.
  • Rockdogs (wt) – this six-episode, half-hour series is about a gay basketball team in San Francisco who works hard to defend their championship title. Set to premiere in summer 2008, the series is from Eddie October Productions. 


Fox Soccer Channel
will air live, exclusive English-language coverage of the FIFA Club World Cup 2007 from Japan starting December 7 through 16. The third consecutive airing of the tournament is sponsored by Toyota.

ESPN HD and ABC HD will present all 15 hours of Winter X Games 12 in hi-def from January 24 through January 27 live from Aspen. X Games 14 will also be shown in HD airing in early August 2008. Additionally, ESPN2 HD will air XCENTER the daily highlight show for both the X Games and Winter X Games.

Crown Media Holdings, Inc. renewed its distribution deal for Hallmark Channel with Comcast Corporation over a multi-year period. The new agreement allows Comcast to distribute Hallmark Channel and both the standard definition and hi-def versions of the Hallmark Movie Channel. The HD Hallmark Movie Channel will launch in March 2008.

~ PRODUCTION & DEVELOPMENT ~

Debmar-Mercury is working on a new daily television talk show hosted by New York radio announcer, Wendy Williams. Currently, Wendy leads the afternoon drive time on WBLS, and she has authored two books and has a CD. Her TV show, which would air just in New York initially before launching nationally, would feature a mix of celebrity interviews, entertainment news and personal advice.

A new projecting coming to Bravo Step It Up and Dance, with host Elizabeth Berkley.  This competition series features a group of players trying to ace a variety of dances, all in hopes of winning a cash prize.  Assisting the dancers in their teachings will be choreographer Jerry Mitchell.  No premiere date set as yet.

Jim Cramer, host of CNBC’s Mad Money with Jim Cramer, signed a new multi-year deal keeping him on the network. Jim will continue to do his Stop Trading segment with Erin Burnett during Street Signs and will also start contributing original content for the Mad Money homepage on CNBC.com.

~ EXECUTIVE MOVES ~

CBS Corporation appointed Jennifer Suarez to the new position of SVP/Workforce Development. Jennifer will supervise executive level search and development efforts across all company divisions. She will also initiate the integration of personnel for new business acquired by CBS. Jennifer will report direct to Anthony Ambrosio, EVP/Human Resources and Administration.

Horizon Media announced several recent advancements in its New York office: Holly Sokoloff moved to Brand Planning Director for The History Channel and A&E accounts; Lizzie Blades is now Account Supervisor; Ankit Bajaj was upped to Media Planning Supervisor; and Jennifer Dill is now Junior AE.

Nicole K. Piper joined Kahn Lucas as VP/Licensing in the company’s licensed apparel unit which creates styles for such brands as Dora the Explorer, Disney Princess, Mickey Mouse Clubhouse, Classic Pooh and Hannah Montana among others.

Anton Guitano, who has been with CBS for nearly 30 years, was named SEVP/Finance and Operations and CFO of CBS Radio. Until recently, Anton was EVP/Operations and CFO of the CBS Television Stations Group. In his new role, he will direct CBS Radio’s financial strategy and oversee all financial activities at the local station and corporate level. Anton follows Walter Berger who will remain with CBS working on special assignments under Fredric G. Reynolds, EVP/CFO, CBS.

Laurel Bernard returned to FOX as SVP/Marketing after a year-long stint at Fox Searchlight Films. She will manage the network’s national media buying, planning and promotional marketing teams. Additionally, Nick Belperio was upgraded to SVP and Michelle Garry to VP. Nick will manage the network’s affiliate marketing team and FOX’s All-Access Radio programming staff among other duties. Michelle will supervise the affiliate marketing staff and be the primary contact relating to marketing efforts for the 200+ network affiliates. Laurel and Nick will report to Joe Earley, EVP/Marketing and Communications and Michelle will report to Nick Belperio. Previously, these areas were supervised by Kaye Bentley who will take on an advisory role with the network.

Wednesday – A18-49 Analysis: ABC captured the last night of the November Sweep on Wednesday with a 4.4/11 A18-49, according to final national ratings from Nielsen Media Research. ABC’s holiday specials at 8p, Shrek the Halls and How the Grinch Stole Christmas averaged a winning 7.0/18. CBS came in first the last two hours as Criminal Minds at 9p did a 4.5/11 and CSI: NY at 9p delivered a 4.1/11.
