Good morning, it’s Friday, March 5, 2010, and this is your first early morning digital briefing.
An earlier decision by the Federal Circuit court that found Dish Network guilty of patent infringement for using Tivo’s “Time Warp” technology in its well-received DVRs. The ruling paves the way for Tivo to receive some $300 million in damages and contempt sanctions and may lead to Dish having to deactivate 8 million DVRs this year. The ruling sent Tivo’s share soaring up more than 50% in afternoon trading. The case dates all the way back to Jan. 2004.
Martha Stewart Living Omnimedia gave advertisers a first look at its vision for a digital magazine at an upfront presentation yesterday, scheduled to launch in late 2010. The special issue “Boundless Beauty” release, optimized for digital tablet devices like the iPad, will provide users with touch-optimized navigation with support of video as well as audio content.
The Mentor is NBC.com‘s latest web series spin off of The Office, revolving around Erin (Ellie Kemper)’s trials to better herself as an accountant.
An online version of MTV’s Unplugged is returning on March 10 on VH1.com with Adam Lambert with subsequent webisodes to be streamed on Unplugged.CMT.com, Unplugged.MTV.com and/or Unplugged.VH1.com. One performance from each episode will be added to the music video rotation on each linear network. A total of eight episodes will be taped overall, divided among MTV, VH1 and CMT.
E! Online is holding an “Autographs to Help Haiti,” online charity auction to help support relief operations, auctioning off framed Plexiglass panels signed by a wide range of TV, movie and music stars. The network will also auction off photos taken from this year’s Red Carpet coverage to raise money for Chilean relief efforts.
Discovery Networks Asia-Pacific announced the launch of the 24-hour Discovery HD channel, broadcast in English and currently available on Sun Direct, India’s first DTH platform.
In an advance that will make the video sharing site accessible to an even broader audience, YouTube announced that its speech recognition and closed-captioning technology is moving out of beta. A lion’s share of YouTube videos will now include a “CC” button that activates the closed-captioning functionality. Speech-to-text algorithms found in Google’s Voice Search app, used in Android’s voice search feature, will then automatically generate video captions when requested by a viewer. YouTube can only presently pick up spoken English to auto-generate the caption track, but Google’s always improving translation software can take a transcription and translate it to up to fifty languages.
Wellness-themed emerging cable network be has launched a web destination at benetwork.tv to showcase some its original programming. A segment from original show A Moment of Wellness explains how taking a holistic approach to writing a bio can bring a sense of balance and equanimity to one’s life.
Video ad company Freewheel, working to become a friendly middleman in the fragmented online video ad space, has formalized integrated partnerships with over 70 video distributors, ad networks, video player and content management platforms, creative technologies, and content ID companies including Roku, Brightcove, EyeWonder and ScanScout. The sheer range of partnerships should help FreeWheel’s PAVE initiative simplify the process of distributing, monitoring and measuring video ad effectiveness.
An amendment to the Digital Economy Bill (initially introduced last Nov.) proposed by the Liberal Democratic Party in the UK gives England’s High Court the power to issue injunctions to websites that are thought to contain large amounts of copyright-infringing content. The controversial bill could force video sharing sites such as YouTube and Dailymotion offline for good in the UK, per The Guardian.
Katherine Bigelow fans may find themselves getting their hopes up for Sunday. Based on analysis of chatter on Twitter by the Seattle-based WE twendz pro tweet-tracking service, The Hurt Locker will win over Avatar for best picture at The Academy Awards. The influence analytics service helps measure brand impact and engage audiences on Twitter by gauging tenor, themes and drivers of Twitter conversations. Influential users such as Roger Ebert, who has triumphed Hurt Locker, are given more weight. The We twendz analysis found that:
- Many of the supporting tweets for “Avatar” referenced its budget and sales
- the average number of followers for an “Avatar” Twitter voter was over 110
- Those supporting “Hurt Locker” focused on its plot, characters and director Kathy Bigelow’s directing capabilities
- The average number of followers for a “Hurt Locker” Twitter voter was over 220
The prediction by the WE twendz pro service is based on tweets noting a definitive vote for “Hurt Locker” or “Avatar,” while accounting for overall level of influence. “Hurt Locker” was the winner with over 460 votes, and “Avatar” received over 200 votes.
MLB.com‘s At Bat 2010 iPhone, Android and BlackBerry apps are out in time for the beginning of Spring Training with some new features and an additional $5 in its price tag (it’s $15 for the app this season.) The big perk for the iPhone app is the ability to listen to live audio streaming of all the games while using other applications, instead of having to switch off the game to check email or answer the phone -–a huge negative in previous versions. (To do this, the audio is piped through Mobile Safari.) Again, one live video game will be streamed each day.
Here’s a fun Flash based web or Facebook-based app developed by creative digital agency LBi for the upcoming CBS Films J-Lo comedy, The Back Up Plan. Upload photos of two adults to see what your love child would look like. There’s also a Space Invaders-type casual game.
Boston-based video ad network ScanScout has hired Adam Lichstein as SVP and General Counsel, a newly created position. The former ShopText COO will focus on managing client services, ad operations and finance as well as driving legal and regulatory efforts.
Former AOL executive Milissa Tarquini has joined Scripps Networks as VP/User Experience and Design of its digital media division, overseeing UI, interaction design and visual design across all Scripps’ sites and platforms. She is based in the company’s New York offices, reporting directly to Jen Goforth, SVP/Operations for Scripps Networks’ digital media group.
New York-based visual effects and original music studio Fluid has added Editor Micah Scarpelli to its editorial roster.
Disney-ABC TV Digital Media’s Oscar.com site is counting on a huge turnout this Sunday, hoping to attract fans with live red carpet video coverage (although E! Online has long been the go-to place for this) along with a Twitter tie in and a Facebook Connect app giving users the opportunity to pitch questions to their favorite stars through the Red Carpet hosts. ABC’s insider status will also get the site’s hosts backstage, capturing footage behind the curtain and in the press room where winners go after they grab their statuettes. These web components are well monetized this year, with Diet Coke sponsoring the Red Carpet coverage and Samsung sponsoring the Facebook chat feature. Too bad ABC isn’t streaming the actual Oscars telecast live -–that would be one way to superserve those (potentially) disenfranchised Cablevision subscribers. But then again the underlying goal of all of this is to drive eyeballs back to the telecast, which has been slowly hemorrhaging audience share for years.
