Good morning, it’s Friday, March 19, 2010, and this is your first early morning digital briefing.
The opening briefs of the $1 billion copyright infringement lawsuit brought by Viacom against YouTube in March 2007 were made public on Thursday. Revelations include that Viacom considered acquiring YouTube before Google agreed to pay $1.7 billion for the site in Oct. 2006, and that the company realized that its business model was based on capitalizing on professionally produced content without compensation. In a blog post by YouTube Chief Counsel Zahavah Levine, Viacom is accused of “continuously and secretly” uploading content to YouTube through the use of 18 different marketing agencies to benefit from its power as a promotional platform, even after publicly complaining about the presence of unauthorized clips. The Google subsidiary is charged with violating federal law by uploading more than 60,000 copyrighted videos without authorization, including versions of The Daily Show with Jon Stewart and South Park.
The Corporation for Public Broadcasting (CPB) announced it will unveil a major new journalism initiative to build the capacity of public broadcasting stations to produce in-depth local content and help offset the loss of original reporting in some media markets. The announcement will take place at The Newseum Knight Studio in Washington D.C. on Thursday, March 25th beginning at 10 a.m.
NBCU’s iVillage unveiled a new health vertical combining expert medical advice and original health content with community features and interactive tools. The launch is the fourth in a series of new vertical debuts, including iVillage’s new Entertainment, Food and Astrology sites.
Riffing off of March Madness, CBS‘ The Late Show With David Letterman is launching its own 19-day tournament bracket to determine viewers’ all-time favorite Stupid Pet Tricks.
CNBC‘s Fast Money version of March Madness applies to stock picks from the sectors of Technology and Telecom, Home and Healthcare, Financials and Insurers and Commodities and Industrials. Each bracket contains 16 teams seeded based on consensus analyst ratings and recent sentiment from “Fast Money” guests and traders.
Facebook has won approval this week to settle a $9.5 million class action lawsuit complaining of privacy violations of its controversial Beacon advertising program that allowed companies to track the online purchases of users. As part of the agreement, Facebook will establish a “digital trust fund” to hear and act on privacy, safety and security concerns.
Actor Rainn Wilson, best known as Dwight on The Office, has officially launched his SoulPancake.com website with partner Think Brilliant after beta testing it for more than a year. Exclusive videos, articles, interviews and creative challenges help users ponder life’s big mysteries.
European ad serving technology provider Videoplaza closed on a $5 million round of investment led by Nordic venture capital firms Creandum and Northzone. Videoplaza’s Monetizer ad server platform manages, displays and tracks advertising in and around publishers’ online video content.
Yahoo is working with Discovery to promote the upcoming Life event in a campaign that includes a number of firsts for the portal:
- The series will perform a home page takeover of Yahoo.com on March 21 that will enable users to see a customized Life-themed design each time they return to the page that day
- Discovery will utilize Yahoo’s Rich Ads in Search product, the first entertainment advertiser to do so
- Yahoo! Mail’s Tandem Mail units will alert users to the premiere, another first for an entertainment advertiser
Google is teaming with Intel and Sony to develop and promote a new open source Google TV platform to distribute broadband content and applications onto connected TVs, per the NYTimes. Computer peripherals manufacturer Logitech has been hired to build hardware around the solution, including a keyboard-equipped remote control. The platform, which would run on Intel’s Atom chips, would combine elements of Google’s Android mobile operating system and its Chrome web browser. The company faces stiff competition from multiple Over-The-Top hardware devices and software platforms, including Apple TV, Roku, Tivo, Slingbox, Boxee and Yahoo.
VOD and interactive TV vendor Concurrent and iTV partner FourthWall Media announced a multi-year agreement with Paul Allen’s Charter Communications to deliver an end-to-end interactive television and cross-platform data management solution utilizing FourthWall’s Enhanced TV Binary Interchange format (EBIF) platform and Event Stream Collection.
Digital music distributor The Orchard has launched a new interactive analytics tool utilizing daily and weekly sales activity generated from its retail partners, including iTunes, eMusic, Verizon Wireless, 24-7 Entertainment, Deezer, and YouTube.
MRB Productions announced a partnership with web and interactive production company UncleBob to develop future commercials and web productions.
Despite the diversity of news sites on the web, larger concerns continue to receive most of the traffic, according to a Pew Internet/Project For Excellence in Journalism analysis of Nielsen Net Ratings’ list of news and information sites. Collected number of unique visitors grew 9.25% in 2009 and of the 4,600 sites measured, the top 7% collected 80% of the traffic, with the top 20 sites attracting a majority. Of the news sites with a half million visitors a month or more, 67% are from legacy media, most of them (48%) being newspaper sites. And for all the activity on social media sites and blogs, new media outlets are largely filled with debate dependent on a shrinking base of reporting that began in the old media. An ongoing analysis of more than a million blogs and social media sites, for instance, found that 80% of the links are to U.S. legacy media sites.
In more research looking into the power of Facebook and Twitter as a news readers, Hitwise found that Twitter accounted for just 0.14% of upstream visits to News and Media sites last week, compared to 3.64% from Facebook and 1.27% from Google News. Facebook was the #3 source of visits to News and Media websites last week. Google News was the #11 site and Twitter.com ranked #39. However Upstream visits from Twitter.com to News and Media sites have grown by 54% over the past year.
Barnes & Noble.com President William Lynch has taken over as CEO of bookseller Barnes and Noble, replacing Steve Riggio who will assume the role of Vice Chairman. William, former GM of HSN.com, joined B&N.com in Feb. 2009 and has overseen the launch of the company’s Nook eBook reader.
Digital marketing agency LBi has hired Jonathan Isaac as its new Global Head of Planning, based out of LBi’s US headquarters in New York. He will report dually to Chris Clarke, Global CCO and Judith Carr, Co-President in the US.
New York-based media analytics firm LogicLab Inc. has hired Tony Sherman as Director of Product Operations, charged with developing and overseeing the company’s software quality assurance, client support services and technology delivery platform.
Apple announced that board member Jerome B. York, a veteran auto and computer industry executive, has passed away at age 71. Jerome joined Apple’s board in 1997 and is widely credited for his contributions at Chrysler and IBM during the companies’ turnarounds.
FCC Chairman Julius Genachowski has agreed to deliver a keynote speech during the 2010 NAB Show in Las Vegas.
Political junkies rejoice. In honor of its 31st birthday on Friday, C-SPAN.org is announcing that it is making available more than 160,000 hours of digital video on its website to create a free digital archive dating back to 1987. C-SPAN was launched by Lafayette, IN native Brian Lamb as the cable industry’s ultimate commitment to public service and democracy. The networks, a refreshing anecdote to slanted or sensational cable news networks, have recorded more than 11,320 days of posturing, rhetoric and balderdash in Washington while maintaining true objectivity. It’s a testament to C-SPAN’s commitment to public service that it is offering the archive for no charge, despite the impact to DVD sales. After all, CPAN.org has arguably become more valuable than its cable networks because of its ability to reach anyone with an internet connection, archive and cover live events while folks are at work (as seen recently during the one-day bipartisan meeting on Health Care Reform, streamed live on the site.) For now, the archives of all three channels can only be streamed but plans are underway to offer downloads in the future. The challenge will be to present a user interface that refreshes and recommends archived content relevant to the news of the day.
