Good morning, it’s Friday, March 12, 2010, and this is your first early morning digital briefing.

Another brick has been placed in the wall being built to define digital music rights. Pink Floyd won its court case with EMI related to the digital sales of the British rock band’s music, per Reuters. The judge in the case agreed that EMI was unable to sell singles on digital platforms or pieces of individual songs as ringtones without the band’s written consent, per a previous contract that limited sales to full albums only. The two parties continue back-room negotiations over back royalties from digital sales.
 

~ MULTIPLATFORM CONTENT NEWS ~

 
Extending a deal that was scheduled to run out next year, Starz and Disney-ABC Domestic Television signed a new, exclusive long-term licensing agreement for theatrical releases from The Walt Disney Studios through 2015. The extension provides Starz with exclusive pay TV rights to Walt Disney Studios live-action and animated feature films (including Marvel Entertainment titles) on its Starz, Encore and MoviePlex linear channels, and its related on-demand and IP-based services – both in standard and high definition.
 
Capitalizing on Facebook’s growing influence as a news reading platform, MSNBC Digital Network launched a new Breaking News Facebook page aggregating headlines from multiple sources. 
 
AG Interactive
, the online division of American Greetings Corporation, is teaming with digital comedic content producer Comedy Time to produce a selection of new video e-cards like this one about Hot Flashes. The e-cards include both live and studio performances from a variety of stand-up comics and sketch performers featured at ComedyTime.tv.
 
Discovery’s Military Channel is sourcing the crowd to choose its programming schedule for April for the first time. Every Thursday night’s prime time line-up will be determined by viewer feedback on Military Channel’s website where users can choose among thematic categories.
 

~ INNOVATORS & START-UPS ~

 
Call for Content: Babelgum‘s 3rd annual Online Film Festival, which will feature simultaneous online and mobile viewing for the first time this year, is accepting submissions through March 28 for short films in 4 categories: Animation, Narrative, Non-narrative and Documentary. Indie directors Richard Linklater and Sally Potter are among this year’s Jurors. Independent filmmaker group Shooting People is helping to promote the competition this year and Stolichnaya is sponsoring.
 
Champion is sponsoring the new “Journey to the Tourney,” project on sports-themed blog network Yardbarker. Bloggers will file video, tweets and photos from parties, NCAA tournament venues and from around town. FoxSports.com has also signed on as sales and promotion partnership for the effort.
 

~ DIGITAL ADVERTISING ~

 
Contextual advertising start-up Vibrant announced that it recorded record revenues and profits in 2009 despite the challenging climate, achieving double digit EBITDA margins with category growth in Consumer Packaged Goods topping 68% Y-Y. Vibrant claims that Q4 growth hit 34%.
 
Semantic advertising provider Peer39 signed a deal with Akamai to utilize the CDN’s broadband infrastructure and software services.
 

~ TECHNOLOGY DEALS, MERGERS AND SKIRMISHES ~

 
In what could be a huge win for Microsoft’s new Bing search technology, Microsoft inked a deal with leading handset maker Motorola to power search and mapping functions on all the company’s smartphones that run on Google’s Android mobile operating system. Bing-powered Motorola phones, which will begin to hit the market later this spring in China, will also include a new embedded search app that launches a mobile-optimized version of Bing.
 
WGA West President John Wells warned senators in a final Congressional committee meeting on the Comcast/NBC Universal merger that the new entity would constitute a media “superpower” that could limit access to TV shows over the internet, cut back on news and raise cable prices even more, per The Wrap.
 

~ TRENDS, RESEARCH, ETC.  ~

 
Motorola continued as the leading handset manufacture in the U.S. over the past three months through Jan. 2010 with a 22.9% overall market share and a 43% market share among smartphone platforms, per ComScore. Smartphone penetration increased to 42.7 million users, up 18% from the previous 3 months with BlackBerry maker RIM the leading platform. Microsoft and Palm lost the most ground dropping to 15.7% and 5.7% of the smartphone market, respectively. Apple held steady with a quarter of the market.

Twitter fans have always suspected that celebrities farm out their tweeting to others. But a new study from online security firm Barracuda Labs analyzing 19 million Twitter accounts suggests that only 21% of Twitter users are “True Twitter Users,” defined as those who have at least 10 followers, follow at least 10 people and have tweeted at least 10 times. The company identifies the Twitter “Red Carpet Era” as a period of huge growth; in April 2009 the site’s growth rate spiked to 21.17% in large part due to celebrity participation but malicious, suspicious or otherwise spurious accounts also grew by 66%, peaking at 12% of all accounts by Oct. 2009.
 

~ GADGETS & APPS ~

 
Sony’s PlayStation “Move” controller is the company’s answer to the Wii motion sensor, complete with an “Eye” camera that detects precise movements of a player within the 3D space of a game. Sony says that 36 game developers are working with the Move platform at that 20 games are due out later this year.
 
Turner Sports‘ SportsNOW iPhone app is more geared toward socializing than keeping up on scores. Social media messaging from Twitter or Facebook are integrated on the screen so viewers can watch games live on TV then trash talk during the action. The app supports NCAA hoops, NBA and NHL games initially but subsequent updates will add additional sports.
 
Foursquare released an updated version of its “check in” iPhone app, featuring improved navigation and easier viewing of check in histories. There’s also a “pull to refresh” feature.
 
Power-in-numbers online couponing site Groupon launched a new iPhone app that eliminates the need of having to print up coupons purchased from the service.
 

~ EXECUTIVE MOVES ~

 
Tremor Media Chief Financial Officer Mark Pinney has been promoted to Chief Operating Officer at the online video ad network. Mark joined the New York-based firm 2 years go from AOL’s Platform A.
 


~ WEBSITE OF THE DAY ~

 
Don’t look now but MySpace is reinventing itself again. The social networking site, which is now controlled by a pair of Presidents after the departure of Owen Van Natta, is placing a renewed emphasis on casual gaming. MySpace unveiled a revamped Games Gallery yesterday at the Games Developers Conference in S.F., along with a new API that will enable third party developers to build 3D-quality games that combine the look of arcade games with social functionality. The platform includes requisite analytics to measure and monetize usage – it’s important to not only measure who’s playing, but also how players are sharing. The system will incorporate a cloud-based technology dubbed GroovyCortex to help cut down on latency for multiplayer networked games. Finally, the new MySpace Neon iPhone app will give users access to their MySpace games on the go. It’s no secret that casual gaming is a hugely popular phenomenon; games like Zynga’s Mafia Wars are the glue that keep folks engaged in Facebook when they tire of sharing trivial matters. A new study commissioned by Lifetime featured on Business Insider suggests that women play more often and longer than men, and that they treasure online gaming as “me time” – words marketers love to hear. The problem is that MySpace is more than a bit late to the party.
