Fubo issued a statement yesterday afternoon saying it has attempted to renew its Warner Bros. Discovery content agreement for networks including Discovery, HGTV, Food Network and TLC, and to obtain license rights for its Turner sports networks, to no avail. Fubo said it offered WBD market rates for the content, but received no counteroffer. ”Warner Bros. Discovery’s refusal to offer Fubo standard market terms and packaging flexibility are more examples of the unfair and anti-competitive practices it and other vertically integrated media companies have imposed on Fubo for many years,” said Fubo. In February, Fubo filed an antitrust lawsuit against Disney, FOX Corp., and WBD, alleging that the companies have engaged in a years-long campaign to block Fubo’s sports-first streaming business.

Cox Media Group and Dish struck a multi-year agreement that ends a lengthy blackout and puts Cox stations back on Dish. Twelve stations had been dropped in November 2022 in a retransmission dispute. “Dish and CMG greatly appreciate the patience of their subscribers and viewers,” said the companies in a statement.

There are common misconceptions and misunderstandings around ad fraud, transparency, and brand safety, along with confusion regarding who is ultimately responsible for monitoring these issues, according to “Exposed: 5 Inconvenient Truths We Learned From Marketers,” a VAB study from Advertiser Perceptions. Key findings include:
· No single party is willing to assume responsibility for addressing ad fraud. Thirty-two percent of marketers say brands are responsible for preventing ad fraud, and another 27% say agencies are responsible.
· Marketers face persistent ad fraud with little recourse or power to address it. The main recourse taken by marketers is to shift some ad dollars away from the offending digital platform; 88% of marketer respondents report having shifted some of their ad budget to another platform as a result of discovering digital ad fraud.
· Marketers are prioritizing low costs in campaigns. While over 80% of marketing professionals say ad fraud is a major concern, only 32% of brands and 27% of agencies are prioritizing brand safety over cost.
· A lack of transparency prevents marketers from understanding and identifying where the risks of ad fraud exist – more than half of marketers mistakenly believe the cost of their ad placements has no bearing on the likelihood of ad fraud.
· Marketers are unaware that some of their digital ad dollars are being inadvertently funneled to bad actors.

“From misaligned KPIs to an imbalance in power to limited oversight, most marketers are clearly struggling to understand the consequences of their digital investment decisions,” said Danielle DeLauro, EVP, VAB. “The good news is there is recourse and a path forward. By actively demanding transparency from media partners, marketers can reclaim true stewardship of their brands and work towards a business-building future.”

Fox Nation has removed the series “The Trial of Hunter Biden,” a mock trial based on Biden’s legal woes, from the service after attorneys for Hunter Biden claimed the use of sexually explicit images of their client was part of a conspiracy to defame him. Fox News Media’s initial response was to note, “Mr. Biden is a public figure who has been the subject of investigations by both the Department of Justice and Congress, has been indicted by two different US Attorney’s Offices in California and Delaware, and has admitted to multiple incidents of wrongdoing. Consistent with the First Amendment, Fox News has accurately covered these highly publicized events as well as the subsequent indictment of an FBI informant who was the source of certain claims made about Mr. Biden.” Later, Fox News Media said it was removing the program “out of an abundance of caution” as it reviews the matter.

National Geographic Content and the National Geographic Society announced the incoming class for the fourth year of its Field Ready Program, supporting early-career filmmakers. “In its fourth year, the Field Ready Program is proving to be a tremendous success. Netflix has ordered UK reality series “Cheaters: Unfinished Business” (w/t). Co-produced by Lifted Entertainment (“Love Island”) and 12 Yard, the show follows ex-couples who try to forgive and forget.

“The Forsyte Saga,” based on the novels by John Galsworthy, is being adapted as a TV series for the third time. The PBS Masterpiece series from Mammoth Screen (“Victoria”) will be written by Debbie Horsfield. Past versions premiered on the BBC in 1967, and ITV in 2002.

A new independent production company with a focus on premium scripted content has opened in London. Alef UK is headed by Gilles Bannier (“Blue Lights”) as Creative Director.

NEW & RETURNING SERIES

HBO comedy series “Fantasmas,” created, directed, written and starring Julio Torres (“Los Espookys”), debuts this June on HBO.

Oxygen True Crime is celebrating the 20th anniversary of “Snapped” with a special on Sunday, May 12 at 6p that reexamines the Internet’s first murder trial, taking viewers back to the days of internet chat rooms and clever screen names, VHS tapes sent via snail mail, and a scarcity of cell phones.

STREAMING

Paramount+ leads all streamers in ad impressions, peaking at 6.37 billion in 1Q24, according to data from AdImpact. HBO Max had the next highest level of impressions in the quarter, followed by Hulu and Disney+ and Prime Video. Disney+ and Amazon Prime saw declines in impressions from 4Q23 to 1Q24. “Our analysis shows a seasonal variance among streaming providers, with impressions at their highest around the holiday season which is typically a peak time for viewership and subscription,” said Don Norton, General Manager, Data Solutions, AdImpact. “Bundles have also grown in prominence as the streaming market evolves, and we expect this to continue with the coming joint sports venture and as streamers face pressure to maintain subscribers amid cost-cutting measures by consumers.”

TECH TALK

Among the announcements at Roku’s NewFront event was a deal with The Trade Desk, giving the DSP’s advertisers direct access to Roku via a private marketplace and enabling advertisers using the Trade Desk to “suppress incremental households that have seen their linear TV ads.” Roku also said it made iSpot a preferred third-party TV/streaming measurement partner, and ahead of the Paris Summer Olympic Games on NBCUniversal, has launched the NBC Olympic Zone on Roku, allowing users to browse through live and upcoming programming.

Samsung Ads took to the NewFronts to tout a new lineup of sports, music, family and entertainment content on FAST service Samsung TV Plus. Among the sports offerings are live streams of the games of American Hockey League team the Ontario Reign; a Major League Baseball channel with recaps and replays; and a channel dedicated to the PGA Tour. That’s in addition to new tools to enable advertisers to leverage AI for enhanced targeting and performance-driven outcomes. “Our AI and data-driven advertising solutions will better help advertisers meet their objectives across the full marketing funnel, from achieving mass reach to bottom-of-funnel outcomes like customer acquisition,” said Michael Scott, VP, Head of Ad Sales and Operations at Samsung Ads.

Launching an ad-supported tier on Prime Video helped boost Amazon’s bottom line, and beat analysts’ expectations for the quarter. The company reported advertising revenue for 1Q24 rose 24%, to $11.8 billion. Subscription services revenue rose 11% year-over-year, to $10.7 billion.

AC&M Group, a marketing agency specializing in connecting brands and consumers with cultural insights, announced the acquisition of Argentina-based Axlot, specializing in web development, digital advertising, analytics and digital innovation. The acquisition is aimed at enabling culturally relevant marketing strategies with advanced digital solutions such as web and app development, interactive experiences, programmatic media planning and buying and marketing automation. “This move is more than an expansion; it’s a commitment to our clients,” said Jaime Cardenas, co-founder and CEO of AC&M Group. “Together, we’re setting new benchmarks in multicultural marketing.”

Adtech company Sabio Holdings announced a streaming app partnership with SNN, a multimedia financial news portal covering the Nano, Micro, and Small-Cap markets. Sabio will leverage its end-to-end tech stack to power the SNN media network’s streaming apps to bring exclusive content from leading financial experts to streaming consumers across mobile, smart TVs and desktop devices globally.

RETAIL MEDIA

At its NewFronts presentation, T-Mobile announced it is launching a retail media network, with more than 20,000 screens in 11,000 T-Mobile and Metro by T-Mobile retail locations. “T-Mobile has a simple mission: Be the best in the world at connecting customers to their world,” said SVP and Chief T-Ads Officer Jean-Paul Colaco. “T-Mobile Advertising Solutions has the unique opportunity to propel the industry forward, delivering more personalized, customer-centric advertising driving higher engagement and superior outcomes for marketers.”

NBCUniversal is planning to make a bid in the neighborhood of $2.5 billion per year for a package of NBA games, reports The Wall Street Journal. The exclusive negotiating window for Warner Bros. Discovery to cut a deal for current partner TNT expired last week. TNT had paid an average of $1.2 billion under its deal. Disney is reportedly set to pay an average $2.6 billion per year, up from $1.5 billion.

Distribution company Lineup Industries has landed a commission from RTL Netherlands for “In Other News, Today,” a format that combines lighthearted topical news in a celebrity quiz. The show will air on RTL4 daily from mid-August.

GoQuest Media has inked an option agreement with Mumbai-based MadLab Films for the Lithuanian comedy-drama series “Troll Farm.” MadLab duo Abhijeet Khuman and Gaurav Shukla will develop the project and adapt the five-part drama for Indian audiences.

French animation production and distribution company Dandelooo has struck a deal with animation IP creator Dream Factory Studio, Korea for the new original preschool series “PongPong Dino.”

“Baby Reindeer” is getting bigger. The stalker series not only retained its position as Netflix’s most-watched English-language series of the week, it rose to 22 million viewers from April 22-28, up from 13 million.

Spectrum News was the most-watched news network among Spectrum households in April, averaging 1.8 million daily viewing households across its linear and digital platforms. Additionally, Spectrum News NY1 was the most-watched broadcast and cable news network during wall-to-wall coverage of the New York City earthquake on April 5 from 11a to 1p.
