Steven A. Miron and Steven O. Newhouse have resigned from Warner Bros. Discovery’s Board of Directors. The exits come after the US Department of Justice informed them that it was investigating whether their service on the Board of Directors violated Section 8 of the Clayton Antitrust Act, which prohibits a board-appointed director from serving on the board of a competing corporation. Miron and Newhouse are members of the Newhouse family, which owns about 8% of WBD’s outstanding shares. They informed WBD that in light of the changing dynamics of competition in the entertainment industry, they would resign rather than to contest the matter. “From our investment in the Discovery Channel in the earliest days of cable, through Bob Miron’s service as Discovery’s Board Chair and Steve and my service on this board, and with the enormous efforts of John Malone and David Zaslav, we are proud to have played a role in the building of this great company and remain a large stockholder,” said Newhouse. “We are disappointed to leave the Board, but wish to do the right thing for WBD.” As for WBD, “On behalf of our Board and WBD’s leadership team, I want to thank Steve Miron and Steven Newhouse for their extraordinary service and longstanding commitment to Discovery and Warner Bros. Discovery,” said CEO David Zaslav.

Google will destroy browsing data it collected from users in incognito mode to settle a $5 billion class action lawsuit, according to federal court filings. Google is also required to revise its disclosure about incognito mode. The 2020 privacy lawsuit accused Google of secretly amassing data from users when they thought their browsing was private. Google argued the case should be dismissed on the grounds that users “expressly consented” to data collection by accepting Google’s privacy policy and other terms of service, a position the court denied in August. Court papers about the agreement were filed in December, but not revealed until now.

Earth Month has a champion in The Walt Disney Company and National Geographic, who are offering a new global cross-platform campaign, ourHOME, that spotlights creators, storytellers and cast members for their contributions to the planet. Among the offerings is a new digital series spotlighting three Disney Planet Possible stories, with Nat Geo talent visiting Walt Disney World Resort to see the work firsthand. “Disney is committed to putting possibility into practice and inspiring optimism for a brighter, cleaner and more environmentally sustainable future,” said Yalmaz Siddiqui, VP, Environmental Sustainability, The Walt Disney Company. “We hope the ourHOME campaign with Nat Geo helps bring greater awareness of the beauty and majesty of our planet to audiences everywhere.”

Sinclair Broadcast Group announced a new broadcast affiliate distribution agreement with ABC Owned Television Stations. The deal makes Charge!, one of Sinclair’s free, over-the-air, national broadcast TV networks, available on ABC Owned Television Stations’ Diginet 3.

Felicity Huffman (“Desperate Housewives”) will guest star on Paramount+ procedural “Criminal Minds: Evolution.” Huffman will play the ex-wife of Mandy Patinkin’s character on “Criminal Minds” (2005-2020).

EarthxTV, dedicated to sustainability and conservation, is marking Earth Month with special programming blocks and the return of two series, “Bike to Bites” on April 4 at 9p, and “Kill Your Lawn” on April 11 at 10p.

Dating series “MILF Manor” returns for a new season on Sunday, April 28 at 10p. In a lakefront chalet, the MILFs participate in a series of activities from relay races to mud wrestling.

Fox Nation has debuted “Unsolved with James Patterson,” a true crime series focused on three unsolved murder cases. “I was totally gripped by these cases. The fact that they are real-life stories – and that we may help bring justice to the victims and their families – is very special,” said Patterson.

New seasons of “Wildfed” and “The Fishmonger” premiere Monday, May 6 at 7:30p and 9:30p, respectively, on The Outdoor Channel.

Adult Swim’s “Smiling Friends” returns for a second season on Sunday, May 12 at midnight. Adult Swim continued its annual April Fools’ Day tradition yesterday with the unexpected debut of three episodes of “Smiling Friends” re-created in various styles of puppetry, followed by a surprise airing of the season two premiere episode, “Gwimbly: Definitive Remastered Enhanced Extended Edition DX 4k (Anniversary Director’s Cut).”

What goes up, must come down? Shares of newly formed Trump Media & Technology Group fell 25% on Monday, following the news that the company’s social media platform, Trump Social, lost over $58 million in 2023. Trump Media’s accountants warned the losses raise “substantial doubt” about the company’s ability to continue as a going concern. Regulatory documents also showed that a six month lock-up preventing majority shareholder Donald Trump and other insiders from selling their shares is still in place. The stock jumped 50% last week when it began trading, and shares are still up 200% this year.

In a challenge brought by AT&T Services, Inc., BBB National Programs’ National Advertising Division determined that Cox Communications provided a reasonable basis for the claim that Cox Mobile provides “Unbeatable 5G Reliability” as well as other express claims about its host network and implied claims about third-party testing of Cox Mobile. The challenged “Unbeatable 5G Reliability” claims appeared in a 30-second television commercial and on the Cox Mobile website.

Cadent announced a definitive agreement to acquire all outstanding shares of AdTheorent, a machine learning company. “Together, Cadent and AdTheorent will enable our customers to drive performance across all strategic audiences, no matter where they consume media or where they are in the sales funnel,” said Nick Troiano, CEO of Cadent. “We will connect the worlds of programmatic and TV, providing solutions across our partner ecosystem that will drive next-generation omnichannel reach and performance results.”

Outdoor America’s FAST service is expanding with prime-time programming blocks known as Outdoor America Shorts. Outdoor America plans to program prime-time shorts two nights per week in the second quarter of 2024.

Liberty Media, owner of Formula 1, struck a $4.5 billion deal to acquire a majority stake in Madrid-based Dorna Sports, commercial rights holder for motorcycle racing circuit MotoGP. “MotoGP is a global league with a loyal, enthusiastic fan base, captivating racing and a highly cash flow generative financial profile” said Greg Maffei, Liberty Media’s president and CEO. “The business has significant upside, and we intend to grow the sport for MotoGP fans, teams, commercial partners and our shareholders.”

Monumental Sports Network announced a slate of live alternate broadcasts for Washington Capitals and Wizards games on the local media platform. Through the end of the 2023-24 seasons, five alternate Capitals broadcasts and three Wizards alternate broadcasts will be available to sports fans throughout the DMV region, starting on Thursday, April 4 at 7p when the Capitals play the Pittsburgh Penguins. The alternate broadcasts will follow a format similar to ESPN’s “ManningCast” broadcasts and feature a rotation of hosts, analysts, and special guests.
