California Governor Jerry Brown signed legislature that restores open-Internet rules in his state, forbidding Internet providers from blocking legal websites, slowing Internet traffic or charging for faster service. The Justice Department responded with a suit, arguing that states don’t regulate interstate commerce, the government does. “Once again the California legislature has enacted an extreme and illegal state law attempting to frustrate federal policy,” said Attorney General Jeff Sessions. The Writers Guild of America, on the other hand, applauded Brown’s move, for “once again proving that if our federal government fails to protect its citizens, California will step in and lead the way.”
 
Gary Newman is in final negotiations with 21st Century Fox to remain with “New Fox” after the company’s deal with Disney is finalized. Disney will acquire assets including 20th Century Fox Television, which Newman, as co-head of Fox Television Group, oversees with Dana Walden. Walden is expected to jump to Disney’s linear TV division.
 
FX renewed Mayans M.C. for a second season. Through the first three episodes, the Kurt Sutter biker drama is the most-watched program in primetime on Tuesdays, including broadcast, among M18-49 and M18-34 in Live+7, and is averaging 8.2 million viewers per episode across platforms.
 
CBS’s The Late Show will broadcast live on midterm election night, Tuesday, November 6. It’s the 18th time the late nighter has broadcast live – most recently after President Trump’s January 30 State of the Union address.
 
The Wall Street Journal topped Simmons Research’s News Media Trust Index, ranking 38 news sources on the percentage of respondents who found them trustworthy or very trustworthy. 57.7% of those surveyed ranked the WSJ as trustworthy, followed by 55.9% for ABC News, 55.4% for CBS News, 55.2% for BBC News, 54.2% for Forbes and 54.1% for NBC News. Among cable news nets, after BBC News, MSNBC had the highest score (47.4%), followed by CNN (46.1%) and Fox News (44.7%). Thirteen percent of Americans found none of the news sources to be trustworthy. Labeled “doubters” by Simmons, they were less likely to vote overall, but 62.2% reported voting for Donald Trump versus 27.8% for Hillary Clinton in 2016.
 
IFC unveiled a new network brand look that “embodies the unique, smart and surprising voice that embraces the unexpected.” The “slightly off” network worked with studio Gretel on the brand creative. To mark the network’s new look and feel, every day during the first week of October, an episode of IFC’s absurdist talk show Comedy Bang! Bang! will air followed by a marathon of an IFC original series.
 
Did The Talk host Sharon Osbourne talk too much? Osbourne, set to appear on the live shows of the UK version of The X Factor, has stepped down. Osbourne’s exit comes after she called contestant’s “little s—s” and asked, “Is this f—ing karaoke?” in an interview with Howard Stern, but Osbourne said the decision came because didn’t think she was needed.  “After watching the new season The X Factor unfold, I’ve seen the new judges finding their rhythm and are doing brilliantly,” said Osbourne. “I would honestly feel odd coming in at this point.” Osbourne has appeared on The X Factor on and off since 2004.
 
Satellite operators Intelstat, SES, Eutelsat and Telestat have created the C-Band Alliance, to facilitate the clearing of U.S. mid-band spectrum for 5G wireless, along with a pledge to protect broadcasters, cable operators and others who use the band now. The FCC aims to open up the C-band, currently used for satellite delivery of broadcast and cable programming, to wireless broadband. 
 
Jemele Hil, who left ESPN in January after two suspensions for political tweets, has joined The Atlantic as a staff writer for the magazine and TheAtlantic.com. You can’t talk about sports without talking about race, class, gender and politics,” said Hill. “I want to explore the complications and discomforts with a publication that has a long history of supporting this kind of work.”
 
The Christian Broadcast Network has launched CBN News Channel, a 24-hour news channel “from a Christian perspective.” For its debut yesterday, the net was available over the air in 15 markets, including LA, Atlanta, Detroit and Nashville.
 
In recognition of Domestic Violence Awareness Month and the anniversary of the #MeToo hashtag going viral last October, Lifetime has re-launched its public affairs campaign, “Stop Violence Against Women.” Under the initiative, supporting upcoming programming, the net will roll out a PSA featuring survivors of sexual abuse.
 
“There is a direct correlation between the people America sees and the stories being heard in film and on TV, and the outcomes of the hard fought policy battles happening here in Washington, D.C.,” said Fuse Media president and CEO Michael Schwimmer In his opening remarks for a Washington, DC, screening around documentary Indivisible. The event was hosted by Fuse Media, UnidosUS and the NAACP. Fuse Media has also announced the launch of Fuse Films, an independent film initiative that, similar to its Fuse Docs series, will look to showcase emerging artists and content creators of color, and share stories that inspire action.

Channel Frederator Network, the multi-channel network for animators, artists, gamers, and entertainers, has dedicated a $1,000,000 creative fund for its 3000 network members. This fund will act as a resource for members to use for producing new projects; all members will have the opportunity to pitch their ideas for a portion of the funding.
 
Netflix has its first Mandarin-language original, Nowhere Man, about Taiwanese gangsters and a jailbreak, set to start shooting this week. Meanwhile, eight-part mystery drama High Seas is headed to Spain in 2019.
 
Genius Brands entered into an agreement with Bank Leumi USA for a new $6 million facility geared towards production of the recently greenlit season two of Llama Llama. Netflix animated preschool series stars Jennifer Garner.
 
 
NEW & RETURNING SERIES
 
Season two of Nat Geo’s Mars has a launch date: Monday, November 12 at 9p. The hybrid six-episode arc alternates between scripted drama and documentary sequences to predict what life will be like on the Red Planet in 2042.
 
As part of its co-production partnership with the BBC, PBS’s AutumnWatch – New England will air Wednesday-Thursday, October 17-18 at 8p, and Friday, October 19 at 8:30p. Similar in format to PBS’ previous Big Blue Live and Wild Alaska Live, the new series will include a mix of live feeds and pre-taped footage but this time around will focus on cultural traditions and historical sites in addition to local wildlife.
 
Bravo’s The Real Housewives of Atlanta is back for season eleven on Sunday, November 4 at 8p. Cynthia Bailey, Kandi Burruss, NeNe Leakes and Porsha Williams will be joined by four new housewives.
 
Anthology series Room 104 returns to HBO for season two on Friday, November 9 at 11p. Set in a room at a chain motel, show tells the stories of the assorted characters who pass through.
 
The brood moves to a new house when TLC’s 7 Little Johnstons returns for season four on Tuesday, October 30 at 8p, only to discover appearances can be deceiving.

Ten-year Facebook vet Adam Mosseri has been appointed head of Instagram. He succeeds co-founders Kevin Systrom and Mike Krieger, who resigned last week – and appear to approve of their replacement. “We are thrilled to hand over the reins to a product leader with a strong design background and a focus on craft and simplicity,” said the departed duo.
 
Telemundo, E! and Universo have teamed for Latinx Now!, the first-ever total-market entertainment program produced in English and Spanish for bicultural audiences across U.S. and Latin America. Premiering tomorrow, October 3, the 30-minute show focuses on culturally-relevant content that provides crossover appeal and addresses Hispanic passion-points and interests. “In order to harness the full power of the NBCUniversal portfolio on behalf of our clients, it will become increasingly important to create opportunities for brands to reach their target consumer across our properties,” said Laura Molen, EVP, lifestyle and Hispanic advertising sales, NBCUniversal. “LatinX provides the E! and Telemundo consumers, who are young, mobile and social, with content they crave, as well as affords marketers the opportunity to engage this powerful consumer group.”
 
Netflix is going interactive, developing specials that will let viewers choose the next storyline in a series or movie, reports Bloomberg – including on an upcoming episode of Black Mirror. The streamer has already released some choose-your-own-adventure episodes in animated kids’ programs.
 
Google announced game streaming service Project Stream, a “technical test” to address issues like graphic degradation and buffering. Google is partnering with Ubisoft to to stream Assassin’s Creed Odyssey to a test group of users.
 
Despite all the focus on news on Facebook, nearly half of local news sites offering video stream it through YouTube, opened by Google, according to the Tow Center for Digital Journalism study, “Digital Adaptation in Local News.” A survey of 2361 local news publishers shows that one in ten don’t have a website.
 
Comcast customers can talk into their X1 voice remote to vote for the E! People’s Choice Awards, airing Sunday, November 11 at 9p. The new interactive feature builds on previously announced voting integrations with NBC’s The Voice and America’s Got Talent.
 
Outdoor Sportsman Group has launched its subscription-based, streaming service MyOutdoorTV on Amazon Fire TV and Apple TV. MOTV launched on Roku this summer.
 
XO Group, owner of The Knot, The Nest, The Bump, GigMasters and How He Asked, is being bought by WeddingWire for $933 million. The company will maintain both brands.
 
IFC is taking it slow with the launch of Sloth, a slow TV “channel” across the network’s OTT apps. The free, unauthenticated offering includes topical, curated content that will roll out monthly. First up: “Black Cats Watching Scary Movies,” starting Monday, October 8 on Amazon Fire TV, and available across all OTT platforms on Monday, October 22. Said IFC SVP, digital and integrated marketing, Kim Volonakis Granito, “With today’s relentless news cycle, this is a chance for viewers to tune-in and zone out.”
 
Oprah’s SuperSoul Conversations podcast will feature a special presentation of Suze Orman at The Apollo: Women and Money on podcast platforms, including Apple, beginning tomorrow. The second part of the podcast will be available beginning Monday, October 8. OWN premiered the TV version last night.
 
Global pay-TV and SVOD subscriptions will hit 1.877 billion by 2023, according to a new report from Digital TV Research. That’s an increase of 505 million (37%) from the end of 2017. Traditional pay-TV is expected to add 94 million subscribers, to 289 million.
 
Raycom Media OTT app InvestigateTV announced a new content partnership with inewsource, a non-profit organization based in California.
 
FOX News Digital hit highs on Friday with coverage related to coverage of the Senate Judiciary vote on Brett Kavanaugh accounting for 47 percent of all Politics Page Views and 89 percent of all Politics Video Initiates, according to Adobe Analytics. FOX News Digital delivered its highest day of Video Initiates on OTT this year (6.6 million) this year. 
 
 
ADVERTISING
 
In a keynote presentation for Advertising Week yesterday, Brian Lesser, CEO of Xander, said streaming services like Netflix won’t kill advertising because when it comes to OTT video, “SVODs can’t pay for all that content without some advertising model.” For the most part, people accept the tradeoff between content and advertising, said Lesser, adding “We will never get to a world where everything is subscription based.”
 
Nutritionists aren’t the only ones urging people to “read the label.” The  Association of National Advertisers’ Data Marketing & Analytics (DMA) division, the Interactive Advertising Bureau’s Tech Lab, the Coalition for Innovative Media Measurement and the Advertising Research Foundation (ARF) unveiled the beta version of a “data transparency label” that looks like the Food and Drug Administration’s packaged food labels, but includes info like source, collection, and segmentation criteria for data products and services. The trade groups will be collecting public comments on the proposed label for six months.
 
Music streamer Pandora announced the launch of the Insights Lab, an initiative to help advertisers navigate the audio advertising space and deliver audio campaigns that are hyper-personalized. The Lab will include data-backed insights, the development of scaled 1P tools and products, a platform for bringing 3P research to market when tied to proprietary analysis, and activations that demonstrate Pandora’s data.
 
Marketers should not accept fraud as an inescapable cost of digital advertising, says Abbey Thomas, CMO, Tremor Video DSP. “If platforms refuse to accept fraudulent inventory and make this position known to their partners, they could drive significant change,” says Thomas in the new Cynsiders. YouTube is planning extensions to its TrueView ad formats that will allow users to research a business and complete a purchase without leaving the platform. In addition, new tools within Google Ads or Display & Video 360 will let marketers conduct brand lift studies within the platform in real time.

Stay toon-ed: Comedy Central launched its Animated Shorts Program, a new development initiative designed for creators to submit short form animated ideas directly to the network and provide them with the potential to sign a development deal. Comedy Central is taking a page from Viacom sib Nickelodeon’s program, from which sprung Loud House. “We are grateful to the very smart people at Nickelodeon who originated this incubator, and we are excited to put the Comedy Central touch on it with hopefully the same successful results Nickelodeon has found,” said Sarah Babineau and Jonas Larsen, EVPs and co-heads of talent and development, Comedy Central.

French studio Xilam Animation inked a trio of deals with free-to-air German broadcast partner Super RTL for the rights to upcoming animated series Mr Magoo and Moka, as well as the third season of slapstick comedy Zig & Sharko.
 
Viasat World announced Bulgaria telecommunications operator Vivacom  is launching its Epic Drama channel on Vivacom TV. The SVOD catalogue related to the channel will also be available to subscribers by the end of the year.  
 
Netflix struck a deal with Warner Bros. Television for international rights to upcoming live action drama Titans, launching in the U.S. on October 12 on DC Universe.
 
APC Kids signed its first European licensing deals for its global children’s animated series Kid-E-Cats. Egmont picked up the publishing rights to the property for the Central and Eastern Europe region.
 
Paris-based animation production and distribution company Dandelooo announced that it has acquired worldwide distribution rights of the preschool animated series, Pompon Little Bear, in development with producer Supamonks in partnership with France Televisions.
 
RGTV acquired the worldwide rights to My Misdiagnosis, produced by Farpoint Films, about people who get life-altering news from their doctor.

CBS’s God Friended Me started its run with a 1.4 rating among A18-49 and 10.4 million viewers, even in the demo with last year’s time slot entry, Wisdom of the Crowd, and up in viewers.
 
The returns of Fox’s Empire and Star delivered their most-watched episodes since their Spring premieres last season. In Live+3, Empire scored 7.62 million viewers and 2.5/11 among A18-49, while Star delivered 5.66 million and a 1.8/8 rating.
 
This fiscal year, BET is claiming bragging rights as the number one cable entertainment network in growth Y-o-Y for the 2017-2018 season among A18-49, according to Nielsen Live+SD data, and #1 in growth Y-o-Y on cable and broadcast among W18-34 demo this season.
 
Sunday night’s Liga MX matchup on Univision between Guadalajara and Club America averaged 1.7 million total ziewers 2+ and 876,000 A18-49, making it the second most-watched regular-season club soccer match on TV this calendar year. Immediately following the match, Nuestra Belleza Latina, in a special 9p airing, averaged 1.6 million viewers, 669,000 A18-49, 275,000 A18-34 and 351,000 P12-34.

Brian Robbins has been named President of Nickelodeon. Robbins, founder of AwesomenessTV,  most recently served as President of Paramount Pictures Players division, which worked with Nickelodeon and other Viacom brands to identify talent and properties to be developed into feature films. Robbins replaces Cyma Zarghami, who stepped down in June.
