Win some, lose some: A judge issued a permanent injunction that forces Apple to allow iOS apps to direct users to payment options other than Apple’s. The ruling comes in the Epic v. Apple case centered on Apple’s App Store rules. “The Court concludes that Apple’s anti-steering provisions hide critical information from consumers and illegally stifle consumer choice,” wrote US District Court Judge Yvonne Gonzalez Rogers. “When coupled with Apple’s incipient antitrust violations, these anti-steering provisions are anticompetitive and a nationwide remedy to eliminate those provisions is warranted.” In a separate ruling that favored Apple, the court said Epic Games was in breach of its contract with Apple when it implemented the alternative payment system in the Fortnite app, and must pay Apple 30 percent of all revenue collected through the system since it was implemented (over $3.5 million).

In more Apple news, the company is holding its next hardware event, “California Streaming,” tomorrow, September 14 at 10a. Apple is rumored to be introducing a new iPhone 13 line, the series 7 Apple Watch, and third generation AirPods.

Facebook introduced smart glasses in partnership with Ray-Ban that allow users to record what they are seeing as both photos and videos, as well as take calls and listen to music. Ray-Ban Stories is the social media giant’s answer to Snapchat Spectacles.

Google rolled out Android 12 Beta 5 ahead of the public launch of its new mobile operating system. Among the changes are new Material You Clock widgets, a “Paint Chips” widget Easter Egg and relocated smart home controls.

The first Amazon-built smart TVis here, along with Amazon’s latest Fire TV device. The 4K Ultra HD sets, under the moniker Amazon Fire TV Omni Series, touts hands-free voice controls via Alexa. Sets are priced starting at $409.99.

BuzzFeed sales soared 51 percent last quarter to $89 million on gains in its advertising and commerce businesses, which jumped 79 percent and 82 percent, respectively. The digital media publisher is prepping to go public via a SPAC merger and acquire Complex Networks.

Media intelligence company Ad Fontes Media and Sightly announced strategic partnership that brings to market the power to assess, decide and activate the foundational requirements of “brand safety and suitability” around news, opinion and similar content. Sightly’s Brand Mentality platform fuses a brand’s DNA with AI and NLP algorithms to recommend real-time actions that avoid threats or seize marketing opportunities..

Endemically matched ads – those that align with and match the surrounding content based on vertical (e.g. auto ad near auto content) – drove a 23% lift in activation within the part of the brain responsible for memory of practical details, according to a study from Integral Ad Science and Neuro-Insight that revealed the role neurophysiology plays in advertising. Other key insights include:
* Informational ads perform best when matched with an article’s key message. According to the findings, matching informational ads with an article’s message creates a very strong detail memory response, and drove a 36% lift in detail memory compared to when there was no match.
* Ads focused on an emotional response are best paired with content themes. Ads that aim to leave an emotional memory, a particular feeling or overarching brand perception among consumers performed best when placed alongside articles with a matching theme.
* Consumers recognize ads as part of their online experience – 63% of consumers viewed ads as part of their online reading, not disruptive or a distraction.

Sixty-eight percent of consumers prefer to watch shows on demand, versus 12% who prefer linear channels, according to a survey from Future Today. Many also consider ad-supported services as a good way to reduce subscription fees, with 35.5% of respondents saying they plan to decrease the number of services they pay for. But free trials can pay in the long run – 41% of those surveyed who signed on for a free trial offer became subscribers when the trial ended.

Tubi has launched a new science fiction, the DUST channel. The channel offers a selection of comedies, dystopian thrillers and visions of the future from Gunpowder & Sky’s sci-fi DUST collection.

Root Sports and fuboTV inked a deal that will have fuboTV stream Root Sports’ coverage of Northwest professional sports, including 300 live regular season games of the Seattle Mariners, Seattle Kraken and Portland Trail Blazers, as well as other ancillary programming and behind-the-scenes content.

AVOD Canela has partnered with Hyundai to bring the Ecuador World Cup Qualifier matches to viewers for free. The qualifier matches will run from September-December. “The World Cup is incredibly important to Latinos and presents an opportunity to connect with their heritage and support their country,” said Angela Zepeda, CMO, Hyundai Motor America. “Soccer is a big part of many of our lives and the world cup is the most exciting time for soccer (or football) fans!” The free, VOD content will include some of the most followed and watched teams for US Latinos with key South America teams.

The app offers on demand programming from a catalog of factual entertainment, science, history and engineering programs, and adventure-reality series and is available on Roku, Fire TV, Apple TV, Android and iOS.
